Indonesia has stepped up its campaign of repression against West Papuans peacefully rallying for full membership of the Melanesian Spearhead Group (MSG), says a Papuan advocacy leader.

Benny Wenda, interim president of the United Liberation Movement for West Papua (ULMWP), said a “massive military and police presence” greeted Papuans who had taken to the streets across West Papua calling for full membership.

In Sorong, seven people were arrested — not while raising the banned Morning Star flags of independence and shouting Merdeka (“freedom”), but for holding homemade placards supporting full membership, according to Wenda.

In Jayapura and Wamena, protesters were chased by security forces, beaten and dragged away into police cars, Wenda said in a statement.

During a protest in Dogiyai, 20-year-old Yosia Keiya was alleged to have been summarily executed by Indonesian police on July 13 while he was peacefully sitting on the roadside.

“Eyewitnesses reported seeing two police cars arrive in the vicinity and shoot Keiya without provocation,” Wenda said in the statement.

“This crackdown follows the mass arrest of KNPB (West Papua National Committee) activists handing out leaflets supporting full MSG membership on July 12.

‘Ocean of violence’
“But Keiya and those arrested are only the latest victims of Indonesia’s murderous occupation — single drops in an ocean of violence West Papuans have suffered since we rose up against colonial rule in 2019.”

Both Indonesia and the ULMWP are members of the MSG – the former as an associate and the ULMWP as an observer.

The full members are Fiji, FLNKS (New Caledonia’s Kanak and Socialist National Liberation Front), Papua New Guinea, Solomon Islands and Vanuatu.

“Melanesian leaders must ask themselves: is this how one group member treats another? Is this how a friend to Melanesia treats Melanesians?” asked Wenda.

“The fact that they brought an Indonesian flag to the Melanesian Arts Festival in Port Vila, only shortly after their soldiers shot Keiya dead, is an insult.

“They’re dancing on top of our graves.”

Wenda said West Papua was entitled to campaign for full membership by virtue of Melanesian ethnicity, culture, and linguistic traditions.

“In all these respects, West Papua is undeniably Melanesian — not Indonesian,” he said.

“While Indonesia won its independence in 1945, we celebrated our own independence on December 1, 1961. Our separateness was even acknowledged by Indonesia’s first Vice-President Mohammed Hatta, who argued for West Papuan self-determination on this basis.

“More than anything, this crackdown shows how much West Papua needs full membership of the MSG.

“Right now, we are defenseless in the face of such brutal violations; only as a full member will we be able to represent ourselves and expose Indonesia’s crimes.

“West Papuans are telling the world they want full membership. By coming out onto the streets with their faces painted in the colours of all the Melanesian flags, they are saying, ‘ We want to return home to our Melanesian brothers and sisters, we want to be safe.’ It is time for Melanesian leaders to listen.”

The MACFEST 2023 — the Melanesian Arts and Culture Festival — ends in Port Vila today.

The MSG meeting to decide on full membership is due to be held soon although the dates have not yet been officially set.

The Melanesian Spearhead Group (MSG) Leaders Summit proposed to be held from yesterday until July 21 has been postponed to another date, which is yet to be confirmed.

This was confirmed by Foreign Affairs Minister and Deputy Prime Minister Jotham Napat.

He said the MSG Foreign Affairs Ministers Meeting had last month proposed this date pending confirmation from each member country.

Napat said the government of Solomon Islands noted there was a clash with the sitting of Parliament and asked for the meeting to be rescheduled.

“Vanuatu’s Prime Minister [Ishmael Kalsakau] as Chair of the MSG will write to the members for them to reschedule the meeting on another date where every leaders are available to complete their issues,” he told the Vanuatu Daily Post.

“For Vanuatu, July is already full of activities. The President of France is arriving soon. We are looking at organising the meeting in August.”

Asked to confirm whether the endorsement of the United Liberation Movement for West Papua (UMLWP) as a full member of MSG was going to be on the agenda at this Leaders’ Meeting, Napat replied that this had not been discussed at the MSG Foreign Affairs Minister Meeting.

Budget only discussed
He explained that the Foreign Affairs Minister Meeting discussed only the budget and its approval.

However, the application for UMLWP full membership would be discussed in a retreat by the MSG Prime Ministers before any adoption.

Vanuatu has been strongly supporting this agenda.

The Jakarta Globe reported that Foreign Affairs Minister Napat had discussed the possibility of Vanuatu opening an embassy in Indonesia with his Indonesian counterpart during his visit there last month.

He said he told his counterpart about Vanuatu’s push for West Papua to be part of MSG.

“Indonesia has been very frank about this matter. They consider West Papua as part [of Indonesia] and they told us that we [Vanuatu] are undermining their sovereignty.

“This does not stop us to keep pushing this agenda to the MSG Leaders to decide on it. It’s a sensitive issue that needs to be agreed by all leaders.

“Every decision is to be taken by consensus, it will be very difficult if some of the leaders are reluctant to support the agenda,” he said.

Indonesia has been providing scholarships for Papua New Guineans and Fijians to study abroad.

Vanuatu’s push for West Papua
Asked if such assistance could jeopardise Vanuatu’s push for West Papua, Minister Napat said: “Vanuatu is a sovereign country and it must decide on its own destiny and future.

“It is the same for PNG, it has its own sovereign right.

“Somewhere we have to find what is our interest, whether we continue pursuing the idea or we decide on a different path but continue advocate.

“You cannot be shouting from outside. You have to sit at the roundtable with them and talk so that they can hear you.

“It’s an interest for Vanuatu to pursue the matter, but when it comes to MSG its a collective decision.”

The Jayapura High Court has found West Papuan human rights and social justice activist Victor Yeimo guilty of treason and sentenced him to one year in prison in an appeal judgement this week.

The verdict was delivered during a public session held by the panel of judges headed by Paluko Hutagalung, with Adrianus Agung Putrantono and Sigit Pangudianto, serving as member judges.

The charges against Yeimo, the international spokesperson of the West Papua National Committee, stem from his alleged involvement in the Papuan anti-racism protest condemning racial slurs targeting Papuan students at the Kamasan III Student Dormitory in Surabaya on August 16, 2019.

Yeimo was accused of leading the demonstrations that occurred in Jayapura City on August 19 and 29, 2019.

The Jayapura High Court imposed a harsher criminal sentence than the previous verdict on May 5, 2023.

In the previous ruling, the court found Victor Yeimo guilty of violating Article 155 paragraph (1) of the Criminal Code, which pertains to the public display of writings or images containing expressions of hostility, hatred, or contempt towards the Indonesian government.

Yeimo was then sentenced to 8 months’ imprisonment.

Stirred controversy
The earlier verdict stirred controversy because the charge of Article 155 paragraph (1) of the Criminal Code was not initially brought against Victor Yeimo. Also, the legal article used to sentence him had already been invalidated by the Constitutional Court.

On May 12, 2023, both the public prosecutor and the Coalition of Law Enforcement and Human Rights for Papua, representing Yeimo as his legal counsel, appealed against the court ruling.

In the appeal decision, the Jayapura High Court overturned the previous decision, found Yeimo guilty of treason, and upheld the initial one-year prison sentence requested by the public prosecutor.

The panel of judges at the Jayapura High Court stated that the time Yeimo had already spent in arrest and detention would be fully deducted from the imposed sentence and ordered him to remain in detention.

A West Papuan leader, defending himself against treason charges, has denounced “systemic racism” by Indonesian authorities in the Melanesian region in a court hearing.

Viktor Yeimo, the international spokesperson of the West Papua National Committee (KNPB), presented his defence statement — pledoi — in a hearing at the Jayapura Class 1A District Court in Papua Province last Thursday.

He claimed that the treason charge against him was discriminatory and had political undertones.

Yeimo also argued that the trial conducted at the Jayapura District Court had failed to provide evidence of any wrongdoing or violation of the law — let alone treason — on his part.

The accusation of treason against Yeimo was linked to his alleged involvement in the anti-racism protests in Jayapura City on August 19 and 29, 2019.

These protests were made to condemn derogatory remarks made towards Papuan students at the Kamasan III Student Dormitory in Surabaya on August 16, 2019.

On August 12, 2021, the Jayapura District Court registered the alleged treason case under the case number 376/Pid.Sus/2021/PN Jap. The trial was presided over by chief judge Mathius and member judges Andi Asmuruf and Linn Carol Hamadi.

Witnesses ‘proved innocence’
When reading his defence statement, Yeimo said that all witnesses presented by the prosecutor had actually proven the fact that he did not plan or coordinate the demonstrations against Papuan racism that took place in Jayapura City.

“At the August 19, 2019 action, I participated as a participant in the action against racism, and took part in securing the peaceful action at the request of students until it was over,” Yeimo said.

During the hearing, Yeimo argued that the witnesses produced by the prosecutor had actually corroborated his innocence. Their testimony had shown that he did not organise the protests in question.

Yeimo maintained that he had simply participated in the protests as a supporter of the cause and had helped ensure their peaceful conduct.

“During the protest on August 19, 2019, I merely acted as a participant and helped maintain a peaceful demonstration until it ended,” Yeimo said in his defence.

Yeimo highlighted the testimony of Feri Kombo, the former head of the Cenderawasih University Student executive board in 2019, who affirmed that Yeimo was not involved in the planning or coordination of the anti-racism protests.

Kombo was summoned as a witness on February 7, 2023, and testified that Yeimo had only given a speech at the event when requested by the protesters, and that the speech was intended to maintain order among them.

Delivered speeches
“I delivered speeches expressing my disappointment with the acts of racism in Surabaya. This aspiration is protected by the country’s laws as a constitutional right,” Yeimo said.

“As stated by the state administration expert witness and the philosophy expert witness, this right has a scientific basis.”

In addition, Yeimo stressed that he had never been involved in participating, let alone planning, in the protest that occurred on August 29, 2019, which was confirmed by all the witnesses presented in the trial.

Yeimo admitted that he had taken photos and videos in front of the Papuan People’s Assembly (MRP) office and the Governor’s Office, but did not join the protest.

Yeimo clarified that he captured photos and videos to share with journalists and the public outside of Papua since the internet network was cut off by the central government at the time.

He added that President Joko Widodo had been found guilty of unlawful acts by a judge in the State Administrative Court in relation to the internet blackout.

Response to racism
Yeimo said that the anti-racism demonstration was a spontaneous action taken by both Papuan and non-Papuan people in response to the racial insults that had been directed at Papuan students in Surabaya.

“The 2019 anti-racism protest that spread throughout Papua was a spontaneous response by Papuans and non-Papuan sympathizers from various backgrounds including private sector workers, students, farmers, military and police, and others.

“Everyone was reacting to the racist remarks in Surabaya. The demonstration in Jayapura was organised by students and the Cipayung group, and there was no planning, conspiracy, or treason as alleged.

“My speech was to represent the Papuan people who felt outraged by the racist insults. I deny all accusations that link me to my organizational background and other activities that have no direct connection to the facts of the anti-racism protest,” Yeimo said.

Yeimo stated that during the protest on August 19, 2019, he spoke about the issue of racism and discrimination in Indonesia. He emphasised that these problems were not merely personal issues but rather systematic problems that were perpetuated for the benefit of the ruling economic powers.

“It is evident that racist views have led to Papuans being treated differently in all aspects of their lives. The negative stigma attached to Papuans is what led the mass organisation and state apparatus to attack the Papuan Student Dormitory in Surabaya.”

In his statement, Yeimo’s arguments revolved around the issue of racial discrimination that Papuans have faced and how it is seen as a normal occurrence that the State tolerates.

Papuans standing up to injustices
He highlighted that when Papuans stood up against these injustices, they were met with accusations of provocation and charged with treason.

“This trial case proves it. Racism really exists in all these accusations and charges. Could the State explain why the Papuan race is a minority, with only 2.9 million people remaining, while in Papua New Guinea there are already 17 million Papuans?” Yeimo asked.

In his pledoi, Yeimo not only defended himself against the treason allegations but also criticised Indonesia’s lack of development in Papua.

He raised questions about why the poverty rate in Papua remained the highest among all provinces in Indonesia and why the Human Development Index in the region had consistently been the lowest.

Yeimo pointed out the contrasting approaches taken by the Indonesian government in resolving the conflict in Aceh and in Papua.

Differences with Aceh
While the Aceh conflict was resolved through peace talks, Papua’s aspirations for independence have been met with violence and imprisonment.

Yeimo questioned why the government treats the two regions so differently.

Yeimo said that although Indonesia had enacted several laws to address issues of discrimination, freedom of expression, and special autonomy for Papua, these laws do not seem to be enforced in Papua, and their implementation did not benefit the indigenous Papuans.

“Isn’t that a structured crime against us Papuans? Can the government answer these questions? Or do the answers have to come from the muzzle of a gun?” asked Yeimo.

“Why is the government avoiding solutions recommended by state institutions such as the Indonesian Institute of Sciences, the National Research and Innovation Agency, and others who present the studies on Papua problems?”

Linguist witness competence in Yeimo’s trial questioned
During the hearing, Viktor Yeimo’s legal team, represented by the Papua Law Enforcement and Human Rights Coalition, presented a defence read by advocate Emanuel Gobay.

Gobay argued that the prosecutor’s conclusion that Yeimo had committed treason relied solely on the testimony of a linguist witness who lacked the necessary expertise to prove the elements of the crime of treason as outlined in Article 106 jo Article 55 paragraph (1) to 1 of the Criminal Code, which Yeimo had been charged with.

“As a matter of fact, during the trial, the prosecutor never presented a criminal expert witness. Instead, the prosecutor relied on a linguist and then concluded that Viktor Yeimo was guilty of treason,” said Gobay.

According to Gobay, Yeimo’s legal team had presented multiple expert witnesses who explained the components of the treason offence, which included the elements of intent, territorial separation, and participation.

“All elements mentioned in Article 106 are not proven based on the testimony of both the prosecutor’s witnesses and the expert witnesses we presented,” Gobay said.

Gobay expressed the hope that the judges would review all the facts presented in Yeimo’s trial.

He asked the judges to re-examine the data provided by legal philosophy expert Tristam Pascal Moeliono, human rights expert Herlambang P Wiratraman, conflict resolution expert in Papua Cahyo Pamungkas, and criminal law expert Amira Paripurna.

Ultimately, Gobay made a plea to the judges to exonerate Viktor Yeimo, stating there was no proof of the alleged offences.

He requested restoration of Yeimo’s reputation and the State to bear the trial costs.

Yeimo was sentenced on Friday to eight months in prison for his involvement in an anti-racism protest in Papua in August 2019.

In a statement, Amnesty International is calling for the immediate and unconditional release of Yeimo and all Papuans imprisoned for peacefully expressing their political opinions.

Amnesty Indonesia executive director Usman Hamid said the arbitrary arrest and detention of Victor Yeimo and many other Papuans was discriminatory and constituted a failure of the Indonesian state to uphold and protect the democractic and human rights of its citizens.

“The fact that he and many Papuans have been arrested and detained for peacefully expressing their political opinion represents the state’s neglect on human rights protection,” he said.

Hamid said data collected between 2019 and 2022 indicates an alarming escalation in efforts to silence and intimidate Papuan activists in Indonesia with at least 78 people facing criminal charges and prosecution for allegedly violating treason articles under the Penal Code.

Carolyn Nash, Asia advocacy director at Amnesty USA, said human rights were under attack in the autonomous region.

‘Escalating efforts to silence Papuans’
“These escalating efforts to silence and intimidate Papuan activists should alarm the US government, which has repeatedly looked to Indonesia as a regional example of democratic norms commitment to human rights principles,” she said.

“But the reality is clear: these human rights principles are under attack.

“The treatment of Papuan activists is the measure by which the US can assess the Indonesian government’s commitment to protect free expression — and the Indonesian government is demonstrating how weak that commitment truly is.”

Previously, West Papua Action Aotearoa spokesperson Catherine Delahunty said Yeimo’s only crime had been to stand up against the abuse of West Papuan students in Indonesia.

In March, a West Papuan advocacy group claimed 20 Papuans who were fundraising for the victims of tropical cyclones in Vanuatu were arrested by Indonesian police in the provincial capital Jayapura.

The daughter of West Papuan human rights advocate Filep Karma who died on Tuesday aged 63 has confirmed that he died in a diving accident.

Andrefina Karma said she followed the external post-mortem process of Filep Karma’s body.

The results showed that Filep Karma had died from drowning while diving.

Andrefina Karma asked people not to protest over the death of her father.

Human rights watch researcher Andreas Harsono told RNZ Pacific Waves Karma was a master diver and had dived regularly at the same beach.

Harsono said Karma often encountered problems at sea.

He said that on the day of his death he was with two relatives and they were swimming together. The relatives went home as Karma wanted to fish alone, which Harsono said was dangerous for a diver.

Suspicions mount
However, some Papuan activists want a full investigation into the death.

West Papua National Committee (KNPB) activist Ogram Wanimbo, said the complete chronology of Filep Karma’s death must be revealed transparently to the public.

Wanimbo said they were dissatisfied with the post-mortem results.

“We need an explanation of who went to the beach with him and what exactly happened,” he said.

Papuan People’s Petition spokesperson Jefri Wenda also asked for a more detailed explanation.

The chairman of the Papua Customary Council, Dominikus Surabut, said his party also did not fully believe that Filep Karma’s death was purely an accident.

“The family said it was a pure accident but until now, I don’t believe it. Let there be an investigation into it,” Surabut said.

Indonesian human rights lawyer Veronica Koman said: “There were too many strange circumstances around his death and questioning police’s influence on the family. We are not accepting this as an accident.”

Papua Legal Aid Foundation (LBH) director Emanuel Gobay says a participant of a demonstration in Jayapura opposing the creation of new autonomous regions (DOB) in Papua is in a critical condition after being shot by a rubber bullet allegedly fired by a police officer.

Earlier, police forcibly broke up a demonstration opposing new autonomous regions in Papua.

“Yes [the critical injury] was at an action in Waena,” said Gobay when contacted by CNN Indonesia.

Although Gobay said he did not know the exact chronology of events leading up to the shooting, he confirmed that the victim was taking part in an action in front of Mega Waena department store in Jayapura.

“So right when they arrived in front of Mega Waena [the protest] was forcibly broken up, it was at this time that police used rubber bullets and the like. When a rubber bullet was fired it hit one of the protesters,” he said.

According to Gobay, the victim was immediately taken to a Mimika boarding house for treatment by students. He did not have any further information on the victim’s condition.

Gobay added that aside from the person shot by a rubber bullet, another participant suffered injuries after being assaulted by police.

Kicked in the chest
He said the victim was kicked in the chest by a police officer.

“This person ended up unconscious, then they were picked up and taken to the boarding house. Earlier I managed to meet with them, they complained that their chest still hurt because of being kicked. There were several others who were injured,” said Gobay.

Demonstrations against the creation of new autonomous regions and Special Autonomy (Otsus) in several parts of Jayapura were forcibly broken up by police on Tuesday.

One incident, in which police forcibly broke up a peaceful action using a water cannon, was recorded on video and shared on Twitter by Papuan People’s Petition (PRP) spokesperson Jeffry Wenda.

At least seven people were arrested by police during the action, including Wenda, West Papua National Committee (KNPB) spokesperson Ones Suhuniap and Omizon Balingga.

Police have yet to provide detailed information on the person shot by the rubber bullet.

So far they have only announced that they sized a number of pieces of evidence in the form of sharp weapons and materials with the banned Morning Star independence flag motif on them, which were confiscated during a sweep of demonstrators in the Sentani area of Jayapura regency.

West Papuan human rights defender Victor Yeimo has been formally indicted on charges of “treason” by Indonesian authorities at the Jayapura District Court.

The authorities have been trying to get Yeimo, who is the leader of the pro-independence West Papua National Committee (KNPB) in court since May last year.

In the indictment he is accused of treason for pushing for West Papua’s independence.

The court hearing was on Monday and he is due to appear again on Friday.

Yeimo had been arrested by police in Jayapura in May last year after they had been seeking to arrest him for two years.

The arrest was because Yeimo called for a referendum on Papuan independence during anti-racism protests which ended in riots in Papua and West Papua provinces in 2019.

He had initially gone to court in August last year but he was very ill and his lawyers sought a postponement.

Yeimo’s international lawyer, Veronica Koman, said at that time that he was so ill he could die at anytime.

The Papuan People’s Petition — “Petisi Rakyat Papua” — has called on the Indonesian government to release detained human rights advocate Victor Yeimo and to revoke the special autonomy law (version 2).

Yeimo, international spokesperson of the National Committee of West Papua (KNPB), was arrested by the Indonesian police in Tanah Hitam, Abupura-Jayapura. He was serving as spokesperson of the Papuan People’s Petition.

Yeimo is a prisoner of the Papua High Prosecutor’s Office and is currently being treated at the Jayapura Regional General Hospital Dok II.

Previously, he was detained in the detention cell of the Mobile Brigade Headquarters in Kota Raja Jayapura, Papua.

Yeimo has been receiving treatment at the hospital because of public pressure both nationally and internationally over serious concerns for his declining health.

The Petisi Rakyak Papua (PRP) is aimed to call upon the central government of Indonesia in Jakarta to revoke the special autonomy law (Otsus) that was passed prematurely by Jakarta in November 2021 without public hearings and considering the voices and demands of the Papuan people brought by 113 organisations.

The call of rejecting the extension of the special autonomy law which expired last year was echoed a few years ago.

No benefit for Papuans
The petition says that since the central government granted the special autonomy law, the indigenous people of West Papua have not benefited. The law itself has become controversial.

The national spokesperson for the petition, Jefry Wenda, said that apart from the 113 organisations making submissions, 718,179 votes of grassroots people opposed support for extension of the special autonomy law. However, the central government of Indonesia has refused to listen.

Before the widespread rejection of the law from the grassroots level, the provincial government of Papua had tried to negotiate with the central government many times, but Jakarta has been reluctant to consider the provincial government’s aspirations.

This year, the Papuan People’s Petition reaffirms the call by stating:

1. PRP is a manifestation of the political stance of the West Papuan people who reject the existence and sustainability of Otsus in West Papua;
2. The PRP will oversee the attitude of the people of West Papua in fighting for the right to self-determination peacefully and democratically;
3. PRP rejected Otsus and agreed to continue raising the Papuan People’s Petition (PRP) for the third stage;
4. The PRP rejects all forms of compromise and political representation outside of the attitude of the West Papuan people;
5. The PRP is committed to promoting democratic unity in the struggle for the national liberation of West Papua; and
6. PRP urges the release of international spokesman Victor Yeimo and all West Papuan political prisoners without conditions!

“Since it was first established on November 19, 2008, the West Papua National Committee (KNPB) has always been confronted by many challenges, including attempts at criminalisation and disbandment by the state through the institutions of the TNI [Indonesian military] and Polri [Indonesian police].”

The above was written by West Papua National Committee KNPB national spokesperson Ones Suhuniap in his notes in the lead up to the 13th anniversary of the KNPB on Friday.

“Attempts at criminalisation since 2009 until now in 2021 are still being continued through the TNI and Polri,” wrote Suhuniap.

The first challenge, he said, was the first coordination post at the grave of assassinated independence leader Theys Hiyo Eluay in Sentani, Jayapura regency, which was forcibly dismantled by Indonesian security forces on the orders of the Jayapura regent at the time.

“Because the fist coordinating post was dismantled on December 30, 2008, in the end the KNPB established the Papua task force headquarters near Bapak [Mr] Theys Eluay’s grave,” he said.

Following this in 2009, the KNPB was listed by the government as a “terrorist” and “criminal” organisation.

“Australian academic Dr Jason MacLeod clarified that the KNPB was a civil movement organisation conducting a peaceful urban struggle. In the end, the KNPB’s status as a terrorist and criminal organisation was removed,” said Suhuniap.

Activists on ‘wanted’ list
When it was declared a terrorist and criminal organisation, all of the KNPB’s activists were put on the police wanted persons list (DPO). As a consequence, they all sought refuge in the forests, on Abe Mountain, some even hid in Sabron, Jayapura.

“In the forests on Abe Mountain, the KNPB held its first mass consultation (Mubes) in the jungle,” he said.

A year later, in 2019, Suhuniap said that the KNPB began promoting its first congress which was eventually held in Sentani.

“The congress gave birth to three resolutions, including diplomatic unity, Papuan military unity and civilian unity through representative institutions,” he said.

Attempts at criminalisation did not, however, end. In 2021 the KNPB was again accused of being an anarchist and criminal organisation.

“Several criminal actions which were part of a plot were concocted, and then KNPB’s chairperson Mako M Tabuni was shot dead by members of the Special Forces (Kopassus) and the Indonesian police at the State Housing Company (Perumnas) 3 complex in Waena. Then Hubertus Mabel was killed by the Indonesian military in Wamena.”

Suhuniap revealed: “The state through the security forces pushed through a proposal and proposed to the DPRP [Papua Regional House of Representatives], the DPR [House of Representatives] and the Mendagri [Ministry of Home Affairs] that they hold a plenary session to disband the KNPB after the murder of its chairperson and deputy chairperson.”

Extraprdinary congress
In the same year, despite pressure from the military, the KNPB held an extraordinary congress (KLB) in Timika.

“In 2016 the Papua regional police issued a proclamation prohibiting the KNPB from holding demonstrations and proposed to the central government that the KNPB be immediately disbanded,” said Suhuniap.

None of these efforts by the state made the KNPB retreat a single step.

Quite the opposite, said Suhuniap, the KNPB defied the regional police’s proclamation by occupying the Papua Mobile Brigade (Brimob) Command Headquarters in Kotaraja on May 1, 2016.

Despite ongoing mental terror and repression by the security forces and their accomplices, in 2018 the KNPB aggressively built a consolidation until it succeeded in holding the 2nd Congress at the Vietnam Village in the State Housing Company 3 Complex.

“The second congress gave birth to a political resolution, namely a national civil strike (MSN),” said Suhuniap.

In 2021 the KNPB was criminalised by blaming them for attacks committed by the West Papua National Liberation Army (TPNPB) and incessant propaganda by buzzers accusing the KNPB of wanting to thwart the 20th National Games in Papua.

Accusations ‘just nonsense’
“These accusations were just nonsense, because they were indeed not proven,” he said.

Finally, he said, last week plain clothes police arrived at the home of a resident in the Expo Waena area after hearing that KNPB activists were eating a meal together.

In the first incident on November 9, police arrived at the home of KNPB general chairperson Agus Kossay who was eating a meal. In the second, on November 13, police returned to the same location and, according to Suhuniap, raided local residents’ homes.

“Efforts at criminalisation, propaganda and plots which continue to be played out by the colonialists against the KNPB have made us stronger, more confident and even more mature in confronting the challenges of the struggle for West Papua,” said Suhuniap.

“None of these efforts have made the KNPB retreat from the struggle, rather what has been done by Indonesia against the KNPB has provided the strength to maintain the struggle for West Papua national liberation.”

KNPB chairperson Warpo Sampari Wetipo said that the KNPB as a media of the West Papuan ordinary people continued to be consistent in its mission of urban civil struggle.

Right to self-determination
“Regardless of the attempts and actions by Indonesian security forces against the KNPB it has never broken our spirit of struggle. The KNPB believes in the agenda of the right to self-determination which has been fought for up until now,” he said.

Wetipo said: “For as long as the Papuan people are not given the democratic space to determine their own future (self-determination), the KNPB will continue to exist throughout the land of Papua.

“The KNPB has broadened its roots in Papua, from Sorong to Merauke. together with the oppressed people fighting to regain West Papuan independence.”

The West Papua National Committee (KNPB) claims that an attack on a military post in Maybrat regency earlier this month is being used as a pretext to “force the KNPB into a corner” and to criminalise them, reports Suara Papua.

The September 2 attack on Kisor sub-district military post in Maybrat regency, West Papua province, killed four soldiers.

“There are vested interests and a plot by certain parties behind the killing for four TNI [Indonesian military] members at Kisor, Maybrat,” claimed KNPB spokesperson Ones Suhuniap in a statement sent to Suara Papua newspaper.

“First multinational palm oil companies, which are currently challenging [the cancellation of] permits in the western Birds Head region,” he said.

“Second, the construction of [new] Koramil [sub-district military commands] in several districts in South Sorong and Maybrat regencies.

“Third, the additional deployment of troops on the grounds of securing the PON XX Papua [20th Papua National Games].”

Suhuniap said the incident was a plot and a trap which had been arranged to distract public attention from a challenge by four palm oil companies with the Jayapura State Administrative Court (PTUN) against Sorong Regent Jhony Kamuru’s decision to revoke their permits.

Legalising Trans-Papua Highway posts
The “plot” was also to legalise and accelerate the construction of sub-district military posts and TNI and Indonesian police posts on the Trans-Papua highway connecting Manokwari and Sorong.

Suhuniap said that for the KNPB such a plot was nothing new and these methods were often used in Papua, especially against the KNPB.

As has been reported, the police claimed that a member of the civil society KNPB was involved in the attack, namely the movement’s chairperson in the Kisor sector.

However, what their alleged motive was and why they were involved, along with who the mastermind was behind the 19 people declared responsible for the attack had not been cited by the police.

Suhuniap said that if there were KNPB Maybrat members involved then there was a third party which provoked or trapped them into it and so it was necessary to discover the mastermind and what their interests were.

The KNPB did not kill or act in a hostile way towards other people, including the TNI and police, Suhuniap said.

“There is no agenda of murder directed against the authorities or special organisational instruction to attack members of the TNI and Indonesian police,” he said.

Investigation needed
“So the police must delve into and investigate this case further. Who was the mastermind behind the attack? Don’t criminalise the KNPB.” he said.

If the investigation found that KNPB members were proven to have been involved in the attack then their actions were taken as individuals, not the organisation.

“We as an organisation [the KNPB] have never carried out sabotage or urban guerrilla actions,” he said.

Suhuniap also said the attack was part of an Indonesian effort to counter public demands from within Papua and internationally for the release of KNPB international spokesperson Victor Yeimo.

“The state is shaping public opinion to distract the Papuan people’s attention from Victor Yeimo’s release and creating a sense of fear,” he said.

“Indonesian colonialism through its intelligence [services] are shaping public opinion and distracting the Papuan people’s attention by accusing the KNPB of being involved in the attack on the soldiers in Kisor.

“We believe that this effort to distract public attention is a cheap sort of intelligence propaganda to destroy and criminalise the KNPB.”

Suhuniap called on colleagues from West Papua’s 112 resistance movement organisations and all Papuan people to remain solid and not be influenced by the manipulation of public opinion.

“The Papuan people must be consistent in rejecting the extension of special autonomy, the unconditional release of Victor Yeimo and demanding the right to self-determination,” he said.

Papuan activist Victor Yeimo has been receiving medical treatment in hospital following a police crackdown on a protest in the provincial capital Jayapura demanding that he be released from detention to be treated for illness.

Hundreds of protesters had gathered at the Papua chief public prosecutor’s office on Monday to demand that West Papua National Committee (KNPB) spokesperson Yeimo be released from detention to be given hospital treatment.

Yeimo’s detention was finally deferred on Monday afternoon and he was taken to Jayapura public hospital for treatment.

The protesters arrived from the direction of Abepura, Jayapura city. They arrived at the chief public prosecutor’s office and began giving speeches on the street leading into the office.

In speeches, the demonstrators demanded that chief public prosecutor Nikolaus Kondomo immediately defer Yeimo’s detention.

Yeimo is currently being tried at the Jayapura District Court in a criminal case related to anti-racist demonstrations in Papua in 2019.

On Friday, August 27, the panel of judges, presided over by Eddy Soeprayitno S Putra, with judges Mathius and Andi Asmuruf, ruled that Yeimo’s detention be deferred and that he receive medical treatment because he was ill.

Demand for treatment
The rally at the prosecutor’s office on Monday was because Yeimo had still not been released from detention. They demanded that the prosecutor release Yeimo immediately and allow him to be treated.

The police had already closed the main gate to the office and prohibited the protests from entering the grounds. About 1 pm police forcibly broke up the rally which was coordinated by the KNPB.

A number of protesters were injured, including Gad Holanue, Varra iyaba, Hengki Giban, Leti Soll, Egenius Tebay and Jufri Dogomo. Three protesters — Soleng Soll, Beni Orsa and Bayage — were arrested by police.

Papua Regional House of Representatives (DPRP) member John NR Gobai said he deplored the police actions. Gobai, along with DPRP member Laurenzus Kadepa, had been accepted by the court as guarantors for Yeimo to be released and treated in hospital.

“I was blocked by police, then I was pulled away by the demonstrators. I wasn’t able to get in and convey my wishes,” Gobai said.

A Regional Representatives Council (DPD) member from Papua, Herlina Murib, was also barred from entering the office.

“We hope that the police will not repeat this inhuman attitude which was shown by blocking us and removing people who wanted to convey their aspirations. This violates the law”, Murib said.

Second demonstration
The demonstration at the prosecutor’s office on Monday was the second one held by activists demanding that Yeimo be allowed to receive hospital treatment.

Protesters had also gathered at the prosecutor’s office on Saturday, August 28, because the prosecutor was seen as ignoring the court’s ruling that Yeimo receive treatment.

Because the prosecutor’s office was empty on Saturday, the protesters went to the prosecutor’s private residence where they again called on Kondomo to immediately postpone Yeimo’s detention.

However, Kondomo refused the request, saying Yeimo could only be released on Tuesday, August 31.

About 3.20pm on Monday, Yeimo was finally allowed to leave the Papua regional Mobile Brigade command headquarters detention centre and was taken to Jayapura public hospital. The ambulance transporting Yeimo was escorted by two police patrol cars and three black minivans.

Around 20 police officers escorted Yeimo to the hospital. Public prosecutors Adrianus Tomana and Valerianus Dedi Sawaki were also present at the hospital.

Advocate and lawyers
Yeimo was accompanied to the hospital by advocate Emanuel Gobay and a number of other lawyers, Laurenzus Kadepa and John NR Gobai along with Yeimo’s wife and mother.

Speaking to Tabloid JUBI at Jayapura hospital, Tomana said the medical examination was in accordance with the court’s ruling. Tomana stated that how long Yeimo’s detention will be deferred would depend on the examination and the doctor’s diagnosis.

“How long the deferment will be depends on the results of the doctor’s examination. If the doctor declares that he is well, then we will revoke the deferment, and Yeimo will be returned to his detention cell,” he said.

The panel of judges hearing the case against a West Papuan activist accused of treason have ordered the prosecution to prioritise the defendant’s health, reports Suara Papua.

At the second hearing on Thursday when the charges were supposed to be read out against West Papua National Committee (KNPB) international spokesperson Victor Yeimo, the judges ordered the prosecution to take him to a hospital for intensive treatment because of his deteriorating health.

The first and second court hearings this week were postponed because of Yeimo’s worrying state of health and because he was unable to attend the hearing.

On Friday, Yeimo was taken to the Jayapura public hospital in Dok II for an examination and treatment.

John NR Gobay and Laurenzus Kadepan — two members of the Papua Regional House of Representatives (DPRD) — have declared that they are ready to stand as guarantors for Yeimo while he is being treated.

Papua Legal Aid Foundation (LBH) director Emanuel Gobay has also declared that he is ready to become a guarantor.

This was conveyed to the panel of judges at the Jayapura District Court on Thursday who subsequently granted the request.

Pressure from prosecutor
When contacted by Suara Papua on Friday, Gustaf Kawer, one of the members of Yeimo’s team of defence lawyers, revealed that after Yeimo had been taken to hospital there was pressure from the prosecutor who said Yeimo was not allowed to receive inpatient care.

“It is correct that Victor was taken to hospital earlier. But on the matter of inpatient care this is still being debated with the prosecutor because he doesn’t want Victor Yeimo to be treated at the Doc II hospital,” he told Suara Papua.

According to Kawer, there was a debate between Yeimo’s lawyers and the prosecutor at the hospital.

Yeimo and his lawyers wanted him to be treated at the hospital while the prosecutor did not.

Kawer said that the administrative requirements could be completed and would be handed over on Monday.

“What we are asking and urging is that Victor Yeimo’s health [be prioritised]. His state of health is not good,” Kawer aid.

‘He must be treated in hospital’
“He must be treated in a hospital. We already have the guarantors. The administrative requirements can be handed over on Monday. What we want is for Victor to be treated. Victor’s health is most important.”

A video received by Suara Papua on Friday evening shows Yeimo at the Dok II Jayapura hospital emergency unit. Several photographs received also show Yeimo being examined by a team of medics at the hospital.

Meanwhile, another video received by Suara Papua shows Yeimo debating with the authorities and the prosecutor who are insisting that Yeimo not be treated at the hospital.

The state itself has created a stalemate and is now creating new problems that are increasingly complicated and spiralling out of control.

The incident which took place on August 16, 2021, when Rev Dr Benny Giay, chair of the Kingmi Synod in Papua and also moderator of the West Papua Council of Churches (WPCC) was refused entry to the Papuan People’s Representative building is a very embarrassing incident for the Indonesian police.

Is this the face of the Indonesian police — they blockaded a church leader who wanted to pray at the office of the Papuan People’s Representatives and also the blockaded a peaceful demonstration of the Papuan people?

The breaking up of the West Papuan National Committee (KNPB) demonstration to demand the release of Victor Yeimo in Jayapura and in Yahukimo on August 16, 2021, which reportedly killed one person, shows that the police are not only unprofessional and uneducated, but that they are also violent and criminal.

This kind of cruelty and violence by the security forces has led to an increase in the Papuan people’s distrust of Indonesia.

I strongly condemn the security forces in Yahukimo who killed one person in Yahukimo and wounded the chairman of KNPB, Agus Kossay, and several KNPB members in Jayapura.
