The PANG media team at this month’s Pacific International Media Conference in Fiji caught up with independent journalist, author and educator Dr David Robie and questioned him on his views about decolonisation in the Pacific.

Dr Robie, editor of Asia Pacific Report and deputy chair of Asia Pacific Media Network (APMN), a co-organiser of the conference, shared his experience on reporting on Kanaky New Caledonia and West Papua’s fight for freedom.

He speaks from his 40 years of journalism in the Pacific saying the United Nations and the Pacific Islands Forum need to step up pressure on France and Indonesia to decolonise.

This interview was conducted at the end of the conference, on July 6, and a week before the Melanesian Spearhead Group (MSG) leaders called for France to allow a joint United Nations-MSG mission to New Caledonia to assess the political situation and propose solutions for the ongoing crisis.

The leaders of the subregional bloc — from Fiji, FLNKS (Kanak and Socialist National Liberation Front of New Caledonia), Papua New Guinea, Solomon Islands and Vanuatu — met in Tokyo on the sidelines of the 10th Pacific Islands Leaders Meeting (PALM10), to specifically talk about New Caledonia.

They included Fiji’s Sitiveni Rabuka, PNG’s James Marape, Solomon Islands’ Jeremiah Manele, and Vanuatu’s Charlot Salwai.

In his interview with PANG (Pacific Network on Globalisation), Dr Robie also draws parallels with the liberation struggle in Palestine, which he says has become a global symbol for justice and freedom everywhere.

“I should mention Palestine as well because essentially it’s settler colonisation.

“What we’ve seen in the massive protests over the last nine months and so on there has been a huge realisation in many countries around the world that colonisation is still here after thinking, or assuming, that had gone some years ago.

“So you’ll see in a lot of protests — we have protests across Aotearoa New Zealand every week —  that the flags of Kanaky, West Papua and Palestine fly together.

“The people see these as symbolic of the repression and injustice all over the world.”

Activists have protested at Indonesia’s Ternate Police headquarters in North Maluku demanding that the security forces release eight people arrested while commemorating West Papua Independence Day on December 1.

December 1 marked 61 years since the first raising of West Papua’s symbol of independence, the Morning Star flag.

Tabloid Jubi reports Anton Trisno of the Indonesian People’s Front for West Papua (FRI-WP) saying the demonstration where the group was arrested was a peaceful one.

“We expressed our aspirations peacefully. Some ojek (motorcycle taxi) drivers infiltrated the crowd to disperse the protesters. This is a violation to our freedom of speech,” he said.

Trisno asked the police to immediately release eight of his colleagues.

“We urge the Ternate police chief to immediately release the eight activists who are still detained. We demand the police release them unconditionally,” he said.

Different tactic
Meanwhile, an activist group has reported a different tactic used by the security forces, which it says is concerning.

“The Papuan People’s Petition Action (PRP) in commemoration of the 61st anniversary of the ‘West Papua Declaration of Independence’ received escort and security unlike usual actions from the Indonesian Security (colonial military),” a statement said.

“Apart from vehicles such as patrol cars, dalmas, combat tactical vehicles, sniffer dogs, intelligence/bin, bais, and tear gas launchers or other weapons.

“There is also security in the form of hidden security, such as a [sniper] placed on the balcony of Ramayana Mall and Hotel Sahit Mariat which are near the location or point of action.

“This certainly shows that there is something planned to actually push back and close the democratic space for the people and resistance movements in the Land of Papua, especially in the city of Sorong.”

In Port Vila, Vanuatu’s Minister of Climate Change and a long-time supporter of the West Papua people, Ralph Regenvanu, attended the West Papua flag-raising day.

In line with Vanuatu’s stand in support of West Papua freedom, the Morning Star flag was raised to fly alongside the Vanuatu flag outside the West Papua International Office.

Papua People’s Petition (PRP) protesters have braved brutal police blockades, forced dispersals and assaults while staging simultaneous mass actions across Papua.

The actions were held on Thursday to demonstrate the people’s opposition to revisions of the Special Autonomy Law on Papua (Otsus), the creation of new autonomous regions (DOB) and reaffirming demands for a referendum on independence.

Jayapura
A PRP action in Jayapura was held under tight security by police who subsequently broke up the rally, resulting in several people being hit and punched by police.

Four students — Welinus Walianggen, Ebenius Tabuni, Nias Aso and Habel Fauk — were assaulted by police near the PT Gapura Angkasa warehouse at the Cenderawasih University (Uncen) in Waena, Jayapura when police forcibly broke up the student protest.

According to Walianggen, one of the action coordinators, scores of police officers used batons and rattan sticks to disperse them.

Meanwhile, PRP protesters arriving from different places conveyed their demands at the Papua Regional House of Representatives (DPRP) office. Although they were blocked by police, negotiations were held at the main entrance to the Parliament building.

Several DPRP members then met with the demonstrators who handed over a document stating their opposition to the creation of the three new provinces (South Papua, Central Papua and the Papua Highlands) — ratified by the House of Representatives (DPR) during a plenary meeting in Senayan, Jakarta, on Thursday, June 31 — and and demanding that revisions to the Special Autonomy law be revoked.

Timika
In Timika, a PRP action was held in front of the Mimika Indonesian Builders Association (Gapensi) offices but this was broken up by police.

Despite not having permission from police, several speakers expressed the Papuan people’s opposition to Otsus, the DOBs and demands for a referendum. The speakers also called for the closure of the PT Freeport gold and copper mine and the cancellation of planned mining activities in the Wabu Block.

Nabire
In Nabire, PRP protesters held their ground against the police but many people who had gathered at Karang Tumaritis, SP 1 and Siriwini were arrested and taken away by the Nabire district police.

A short time later, demonstrators from several places headed towards the Nabire Regional House of Representatives (DPRD) office where they packed into the Parliament grounds.

While they were giving speeches, the demonstrators who had been arrested rejoined the action after being dropped off by several Nabire district police vehicles.

Meepago
Speakers representing various different organisations and elements of Papuan society in the Meepago region took turns in expressing their views.

PRP liaison officer for the Meepago region Agus Tebai said that the Papuan people, including those from Meepago, rejected Otsus and the DOBs in the land of Papua. Speakers also said that Otsus and the recently enacted laws on the creation of three new provinces in Papua must be annulled.

Tebai said that the Papuan people were calling for an immediate referendum to determine the future of West Papua. These demands were handed over to the people’s representatives and accepted by three members of the Nabire DPRD.

Manokwari
In Manokwari, PRP protesters gathered on the Amban main road and gave speeches.

The hundreds of demonstrators were blocked by police and prevented from holding a long march to the West Papua DPRD offices. Negotiations between police and the action coordinator achieved nothing and the demonstrators then disbanded in an orderly fashion.

Similar mass actions were also held in Yahukimo, Boven Digoel, Sorong and Kaimana in West Papua province.

Wamena
In Wamena, meanwhile, the Lapago regional PRP conveyed its support for protesters who took to the streets via video. According to PRP Lapago Secretary Namene Elopere there was no action in Wamena for the Lapago region in accordance with the initial schedule because they were still coordinating with the Jayawijaya district police.

Aside from protest in Papua, simultaneous actions were also held in Bali, Ambon (Maluku), Surabaya (East Java), Yogyakarta (Central Java), Bandung (West Java) and Jakarta.

Scores of Papuan activists have held a protest in front of the Army Strategic Reserves Command (Green Berets) headquarters in Central Jakarta, demanding that President Joko “Jokowi” Widodo withdraw military troops from Papua, reports CNN Indonesia.

The protesters, who came from the Pro-Democracy Alliance and the Greater Jakarta Papua Student Alliance (IMAPA), accused the military in Papua of assaulting a primary school child for allegedly stealing a firearm and causing the child’s death.

“[We] demand that the president immediately withdraw the military from the land of Papua,” said one of the speakers in front of the Kostrad building on Monday.

“The primary school kid’s didn’t know it was a firearm. They didn’t know it was theft,” he said.

In an official release, the group also said that joint TNI (Indonesian military) and Polri (Indonesian police) operations following the fatal shooting of Papua regional National Intelligence Agency (BIN) chief Gusti Putu Danny in April last year have resulted in civilian casualties.

They said that the security forces have set fire to residents’ homes and committed violence against local people.

As a consequence, residents have chosen to flee their homes in order to save themselves.

“To the president, immediately withdraw the military in the land of Papua,” called the speaker. “Jokowi is responsible for the oppression in Papua.”

Earlier, on Sunday, February 20, a class 4 primary school student with the initials MT died after being allegedly assaulted by security personnel in the Sinak sub-district of Puncak regency, Papua.

Based on information received from Amnesty International Indonesia, the incident began when MT and six other children were arrested for allegedly stealing a firearm belonging to a TNI member in Sinak.

“Based on local media reports on February 26, two youths allegedly took a firearm belonging to a TNI member in the vicinity of the Tapulinik Sinak Airport, Puncak regency, Papua, on the evening of February 20,” read a tweet on the Twitter account @amnestyindo on Monday February 28.

Papuan activist Victor Yeimo has been receiving medical treatment in hospital following a police crackdown on a protest in the provincial capital Jayapura demanding that he be released from detention to be treated for illness.

Hundreds of protesters had gathered at the Papua chief public prosecutor’s office on Monday to demand that West Papua National Committee (KNPB) spokesperson Yeimo be released from detention to be given hospital treatment.

Yeimo’s detention was finally deferred on Monday afternoon and he was taken to Jayapura public hospital for treatment.

The protesters arrived from the direction of Abepura, Jayapura city. They arrived at the chief public prosecutor’s office and began giving speeches on the street leading into the office.

In speeches, the demonstrators demanded that chief public prosecutor Nikolaus Kondomo immediately defer Yeimo’s detention.

Yeimo is currently being tried at the Jayapura District Court in a criminal case related to anti-racist demonstrations in Papua in 2019.

On Friday, August 27, the panel of judges, presided over by Eddy Soeprayitno S Putra, with judges Mathius and Andi Asmuruf, ruled that Yeimo’s detention be deferred and that he receive medical treatment because he was ill.

Demand for treatment
The rally at the prosecutor’s office on Monday was because Yeimo had still not been released from detention. They demanded that the prosecutor release Yeimo immediately and allow him to be treated.

The police had already closed the main gate to the office and prohibited the protests from entering the grounds. About 1 pm police forcibly broke up the rally which was coordinated by the KNPB.

A number of protesters were injured, including Gad Holanue, Varra iyaba, Hengki Giban, Leti Soll, Egenius Tebay and Jufri Dogomo. Three protesters — Soleng Soll, Beni Orsa and Bayage — were arrested by police.

Papua Regional House of Representatives (DPRP) member John NR Gobai said he deplored the police actions. Gobai, along with DPRP member Laurenzus Kadepa, had been accepted by the court as guarantors for Yeimo to be released and treated in hospital.

“I was blocked by police, then I was pulled away by the demonstrators. I wasn’t able to get in and convey my wishes,” Gobai said.

A Regional Representatives Council (DPD) member from Papua, Herlina Murib, was also barred from entering the office.

“We hope that the police will not repeat this inhuman attitude which was shown by blocking us and removing people who wanted to convey their aspirations. This violates the law”, Murib said.

Second demonstration
The demonstration at the prosecutor’s office on Monday was the second one held by activists demanding that Yeimo be allowed to receive hospital treatment.

Protesters had also gathered at the prosecutor’s office on Saturday, August 28, because the prosecutor was seen as ignoring the court’s ruling that Yeimo receive treatment.

Because the prosecutor’s office was empty on Saturday, the protesters went to the prosecutor’s private residence where they again called on Kondomo to immediately postpone Yeimo’s detention.

However, Kondomo refused the request, saying Yeimo could only be released on Tuesday, August 31.

About 3.20pm on Monday, Yeimo was finally allowed to leave the Papua regional Mobile Brigade command headquarters detention centre and was taken to Jayapura public hospital. The ambulance transporting Yeimo was escorted by two police patrol cars and three black minivans.

Around 20 police officers escorted Yeimo to the hospital. Public prosecutors Adrianus Tomana and Valerianus Dedi Sawaki were also present at the hospital.

Advocate and lawyers
Yeimo was accompanied to the hospital by advocate Emanuel Gobay and a number of other lawyers, Laurenzus Kadepa and John NR Gobai along with Yeimo’s wife and mother.

Speaking to Tabloid JUBI at Jayapura hospital, Tomana said the medical examination was in accordance with the court’s ruling. Tomana stated that how long Yeimo’s detention will be deferred would depend on the examination and the doctor’s diagnosis.

“How long the deferment will be depends on the results of the doctor’s examination. If the doctor declares that he is well, then we will revoke the deferment, and Yeimo will be returned to his detention cell,” he said.

West Papua regional police spokesperson Assistant Superintendent Adam Erwindi said that the people arrested on Friday were currently being questioned by police.

“The Manokwari Polres [district police] backed up by West Papua Polda Brimob [Mobile Brigade paramilitary police] have secured them and are taking information,” said Erwindi .

Erwindi said that the protesters did not provide prior notification of the rally with police. The police claimed they had the authority to break up the protest as a result.

In addition to this, Erwindi said, the protest action was disrupting public order and blocking roads so that road users were unable to pass.

“The substance of the demo violated Article 6 of Law Number 9/1998 [on demonstrations]”, he said.

This article stipulated that in conveying an opinion people must respect the rights and freedoms of others, respect morality and safeguard security and public order.

Protesters told to consider security
Erwindi asked that those who wanted to hold protest actions pay attention to the security situation and public order. He also warned that all protest actions must be in accordance with regulations.

“If they’re not in accordance with the above then police in accordance with mandated laws are obliged to break them up,” he said.

At least two Brimob members were injured after being hit by stones when the rally was being broken up.

According to the Antara state news agency, the demonstrators refused to disperse and pelted police with stones and bottles until they were pushed back by teargas.

The demonstrators who were forced back became even more brutal and continued pelting police with rocks and bottles. They also ignited firecrackers and threw them at police.

The demonstrators shouted “Free Papua” as they threw stones in the direction of police.

Australia West Papua Association protest
The Australia West Papua Association has protested to Foreign Minister Marise Payne, saying Indonesian police threats against Papuan protesters ahead of the December 1 flag-raising protests are of “grave concern”.

Association spokesman Joe Collins wrote a protest letter to Payne, saying:

“Dear Foreign Minister,

“I am writing to you concerning the issue of West Papua and in particular regarding comments made by the Indonesian national police spokesperson, Brig. Gen. Awi Setiyono on the 23 November 2020, which is of grave concern.

“Tempo News (24 November) reported the police spokesperson as saying that the “The Indonesian national police (Polri) together with the National Armed Forces (TNI) will conduct massive joint patrols ahead of the commemoration day of the 1 December. He also made an announcement that locals should not participate in the annual anniversary.

“I am sure you are aware that the 1st of December is West Papuan National day or National Flag day and it is of great importance to the West Papuan people. Fifty-nine years ago on the 1st of December in 1961, the Morning Star flag was flown for the first time officially beside the Dutch Tricolor. The Dutch were finally about to give the West Papuan people their freedom. However, it is one of the great tragedies that at their moment of freedom it was cruelly crushed and West Papua was basically handed over to Indonesia in 1963. After 6 years administration of the province, Indonesia held a sham referendum called the “Act of Free Choice” under UN supervision. The Papuans call this the’ act of no choice’.

“The West Papuan people continue to raise their flag as an act of celebration but also of protest against the injustices they suffer under Indonesian rule. They can face up to 15 years jail for doing so. Just two weeks ago 23 Papuans were given jail terms of between 1 and 2 years. They were arrested in December 2019 while on their way to take part in a flag raising ceremony on the 1 December (2019) in Fak Fak.

“The human rights situation in West Papua is deteriorating with the security forces conducting operations to intimidate local people. There is also an increase in violence towards villagers who the security forces suspect of supporting independence or to those they believe have what the security forces term “separatist” sympathies. There have been a number of killings and arrests by the security forces in the past few weeks in West Papua. Indonesian police arrested 54 participants at a public hearing organised by the Papuan People’s Council (MPR) in Merauke on the 17 November. They were arrested for alleged makar (treason). Yet all they participants were doing were holding a meeting to discuss Indonesia’s intention to extend the Special Autonomy laws. Although they were eventually released the arrests show there is no freedom of expression or freedom of assembly in West Papua.

“There have been reports that on 20-21 November 2020, 4 West Papuan school students aged between 13 and 19 and 1 West Papuan man aged 34 were shot by the Indonesian Security Forces. Eighteen year-old Manus Murib, who survived the shootings remains in a critical condition in hospital. When he was first shot Manus passed out and when he came to reported that he found that men wearing black uniforms, vests and helmets were placing guns across his chest and taking photographs. The troops were possible Detachment 88 troops which are trained by Australia.

“There have been ongoing security force operations in West Papua in the regencies of Nduga, Intan Jaya, Mimika and Puncak Jaya since the end of 2018 resulting in the loss of civilian life not only by armed conflict but also by sickness and malnutrition as these operations have created a large number of internal refugees who are reluctant to return to their villages because of their fear of the security forces.

“As recently as the 27 November 36 people were arrested by the police after being involved in rallies in Manokwari and Sorong. They were simply commemorating the anniversary of the West Papua New Guinea National Congress (WPNGNC).

“Twenty civil society organisations that are members of the Papua Civil Organisation, Solidarity (SOS), have called on the Indonesian president to “withdraw all organic TNI-Polri troops from the areas in Nduga Regency, Intan Jaya Regency, Mimika Regency and Puncak Jaya Regency which have given birth to serious human rights violations in the form of refugees and violations of the right to life”.

“I urge you to support the call by the West Papuan civil society groups and raise the matter of the human rights situation in West Papua with the Indonesian President.

“I also urge you to use your good offices with the Indonesian Government asking that it control its military in West Papua and asking it to inform the security forces that it should allow any rallies called to celebrate West Papuan National flag day to go ahead peacefully, without interference from the security forces.”

Indonesian special forces are turning West Papua into “more of a hunting ground”, warns an exiled Papuan leader in response to the shooting of protesting university students this week.

“These were live rounds.”

Earlier, Benny Wenda, the London-based chair of the United Liberation Movement of West Papua (ULMWP), said Indonesia was effectively imposing martial law.

More than a dozen students were wounded in the crackdown in the Papuan capital, Jayapura, on Tuesday with witnesses claiming Indonesian troops opened fire to disperse a peaceful rally, reports Virginia Langeberg of SBS News.

A young man was also severely beaten during the rally, according to video clips broadcast by SBS World News and shared widely on social media.

Months of fresh demonstrations have gripped the region as thousands of indigenous West Papuans renew calls for an independence referendum amid repression in the Indonesian-ruled Melanesian provinces.

Some 13 university students were injured in Jayapura on Tuesday, with victims and witnesses claiming Indonesian troops opened fire to disperse a peaceful rally of about 20 people.

Cause of tension
Indonesia’s control of the provinces has long been a cause of tension among indigenous locals with low-level conflict and independence movements simmering for decades.

Despite a heavy military presence in the region and the threat of covid-19, demonstrations calling for an independence referendum reignited in July.

It came after hundreds of thousands rallied in August and September of 2019, only to be silenced by a flood of more armed troops.

The mounting death toll of West Papua’s latest escalation in violence has seen Australia being pressured to take a stronger stance.

It’s estimated up to 70,000 people have been displaced and 250 killed in the past two years of violence.

Victor Yeimo from the West Papua National Committee said action would continue.

“Our message is very clear, West Papuan people need a political solution,” Yeimo said.

“We’re calling on our Melanesian and Pacific leaders to upgrade its resolution to get the people of West Papua free from colonial power.”

For West Papuan refugees who fled to Papua New Guinea in the 1970s, there is still hope they will one day be able to return.

“We will stay in PNG for the rest of our life, or if West Papua independence is decided, we go back to our home,” said Olof Wayabgkau, who fled Jayapura in 1975.

SBS News contacted the Indonesian embassies in Sydney and Canberra but did not receive a response.

Miss Universe NZ 2019 beauty queen Diamond Langi is being trolled by thousands of Indonesians on social media for speaking up about discrimination against West Papuans.

“The post I had made was #FreeWestPapua with a video showcasing the discrimination West Papuans have had to endure for years,” she declared on Coconet TV’s Facebook and Instagram pages two days ago.

On her “Women of the Islands – Diamond Langi” webpage on the Coconet TV website, the Auckland-born Tongan beauty queen is quoted as saying:

“I shared it because I wanted to bring awareness with what was happening with West Papuans, especially now with the Black Lives Matter movement.

“I had kindly asked Miss Indonesia (Frederika Alexis Cull), who I had met last year in America while competing at Miss Universe, to speak to the president of her country [Joko Widodo] to free the seven activists who were found guilty of treason for protesting against racism. 

She says that from that one post she has been hounded by Indonesian trolls who still exist on her Facebook page.

While there was support for her stance, some of the abuse from some Indonesians bordered on plain hatred, whereas others claimed the Melanesian region of West Papua belonged to Indonesia [it was annexed by Jakarta in in 1969 in a disputed colonisation process that has resulted in armed struggle and peaceful resistance ever since – Pacific Media Watch].

‘My Instagram was flooded’
“From that one post, my Instagram was flooded with abusive comments (at least 10,000 comments in a day) and they also started abusing my family, close friends, and even organisations that I work with,” she says on her Coconet TV webpage.

“I was like, wow if this is happening to me just from making a post, imagine what is happening to the people of West Papua!

“I’ve had to deactivate some of my social media for a little bit but don’t worry I’ll be back,” she says.

But she also had support for her stance.

“Very concerning that our beautiful Pacific sister, Diamond Langi’s public Facebook page is under attack by a few propaganda-fuelled keyboard warriors from Indonesia, because she’s chosen to use her emerging platform and political freedom to stand in solidarity with our indigenous whanau in West Papua,” @Oceania Interrupted said on Facebook.

“Black Lives Matter all over the world, even in the Pacific – and bullying someone for standing in solidarity with indigenous people in our Pacific context, who continue to be brutally oppressed, exploited, silenced and killed in their own land is sickening!

“If you haven’t already, please go on her page, show some love for what she is standing in solidarity for; And if you know a thing or two about THE REAL WEST PAPUA [sic] situation, please school the ignorant bullies on her page and in our world,” the cultural activist group says.

Earlier this year, Langi acted in a Polish-American feature film titled, Sosefina. The film is written by Manu Tanielu and Namualii Tofa and directed by Hinano Tanielu.

The theme of Sosefina has been to tell the story of a marginalised and overlooked Polynesian community. The movie was released in the United States on 31 January 2020.

In the document, the Public Prosecutor concluded that Irwanus Uropmabin was proven to have violated Article 106 in conjunction with Article 55 paragraph (1) of the Criminal Code, and stipulated a five-year prison sentence for the defendant.

Irwanus is a student activist who was arrested on August 29, 2019, for participating in an anti-racism protest in West Papua in September last year.

In the demonstration, he was appointed as the security coordinator.

Papuans Behind Bars reported that Irwanus, along with six other political prisoners, were moved from Mako Brimob Jayapura to BalikPapan Class IIB East Kalimantan prison on October 4, 2019.

The transfer violated the Criminal Procedure Code.

Accused of ‘being the brains’
On the same day, the Public Prosecutor also read out charges against Buchtar Tabuni, a leader of “National Parliament of West Papua” accused of being the brains behind the Papua Uprising of 2019.

Despite maintaining his innocence of involvement in organising the Uprising, Tabuni has been charged with Articles 106, 110, and 160 of the Criminal Code, including treason charges.

The District Prosecutor’s office has demanded 17 years imprisonment for Buchtar Tabuni.

Tabuni is a prominent leader who has been repeatedly imprisoned for peaceful protests demanding independence for West Papua.

He has been repeatedly tortured by the Indonesian authorities during these imprisonments. This latest detention is his third.

“These sentences are excessive and at best an attempt to make examples out of West Papuan political activists who are simply trying to exercise their civil and political rights,” said TAPOL in a statement.

“These rights are protected by international principles as well as Indonesia’s national Constitution.

“West Papuans have been denouncing the injustice of these heavy sentences, as the racist perpetrators in Java who triggered the mass protests were either freed or only sentenced to 5, 7, and 10 months imprisonment.”

A panel of judges at the Jakarta State Administrative Court (PTUN) has granted a lawsuit filed by civil society groups against the Indonesian government’s decision to impose an internet blackout during weeks of protests in Papua and West Papua provinces last year, declaring that such a move violated the law.

The petitioners – the Alliance of Independent Journalists (AJI), the Southeast Asia Freedom of Expression Network (SAFEnet) and the Indonesian Legal Aid Foundation (YLBHI), among other groups – filed a lawsuit against President Joko “Jokowi” Widodo and the Communications and Information Ministry in January.

They said the blackout, which officials argued was put in place to prevent fake news from spreading, was flawed in authority, substance and procedure.

“The court declares [the internet blackout] was a violation of the law by government bodies or officials,” the presiding judge said reading the verdict during the hearing yesterday, as reported by YLBHI activist M Isnur through his Twitter account, @madisnur.

The judges argued the government had imposed the internet blackout without the prior declaration of a state of emergency; therefore, violating the 1959 State of Emergency Law.

The bench said the government failed to prove during the trial that Indonesia was in a state of emergency that required authorities to shut down the internet.

Judges also said any decision that limited people’s right to information should be made in accordance with the law and not merely based on the government’s discretion.

Use Criminal Code for fake news, says bench
The government initially claimed that its move to shut down internet access across Papua was in line with the Electronic Information and Transactions (ITE) Law. However, judges said the law could only be enforced to block access to electronic information and documents violating the law, not the entire internet.

The bench also argued that fake news should be handled by using provisions in the Criminal Code or blocking the accounts spreading such false information, rather than shutting down internet access.

The petitioners lauded the court for the verdict. “The verdict also opens the possibility for affected parties to sue the government and ask for compensation,” Isnur tweeted.

The government throttled back internet access in parts of the country’s easternmost provinces on August 19, 2019 between 1 pm and 8:30 pm shortly after widespread protests escalated in the regions in response to incidents of racial abuse suffered by Papuan students in Surabaya, East Java.

According to the lawsuit, the government imposed a blackout between August 21 and September 4, affecting 29 cities and regencies in Papua and 13 cities and regencies in West Papua.
