Many who witnessed the horrific police violence in Sydney’s CBS on the evening of February 9 say they had never seen anything like it before.

After a week of broadcasts of police “kettling”, viciously assaulting and pepper spraying peaceful protesters, the NSW Law Enforcement Conduct Commission (LECC) announced an independent investigation into the police conduct.

It will examine the policing operation as well as individual cases of unlawful policing.

One of the matters LECC should investigate is which politicians and senior police were involved in organising a massive increase in available police powers shortly before Herzog’s arrival, and what instructions were given to police on the ground about those powers.

The legislation that was used is a little-known act called the Major Events Act 2009, under which the NSW Minister for Tourism, Stephen Kamper, approved a new regulation which transformed Herzog’s visit into a “major event”.

Major Events Act
The objects of the Act are to bring “benefits” to spectators and enhance NSW’s reputation for holding events. The Act grants special powers to plan and regulate major events, including shutting off access to areas, searching people, and using “reasonable force” to compel citizens to comply with directions.

It relieves the state of most liability for damage caused in the exercise of these powers.

The powers have the potential to severely impact the exercise of citizens’ political rights, which is probably why the Act includes a section that a political protest must not be declared a major event. The Act is designed to cover events of a “sporting, cultural or other nature”.

These police powers triggered the lack of restraint witnessed last Monday. This does not mean that police actions were lawful, but that these were the powers under which they thought they were acting.

As one constable who was part of two lines blocking protesters from entering Town Hall Square said when questioned, “I heard something about a major event.”

Court challenge failed
The new regulation was announced on Saturday, February 7, just 48 hours before Herzog arrived.

The Palestinian Action Group (PAG), represented by Hanna Legal, had 24 hours to challenge the regulation.

PAG’s case was that the regulation was “unreasonable”, “disproportionate” and was created for an improper purpose of suppressing protests. Within an hour of NSW Supreme Court Justice Robertson Wright dismissing the challenge, NSW Police were already using the Major Event powers.

Before dismissing the Palestinian Action Group challenge on Monday, Justice Wright said that he found both sides’ arguments persuasive and that it was difficult to decide. But there was no hint of uncertainty in his judgment, which adopted almost all of the NSW government’s case.

The judge, who is near retirement, was described on his appointment as “a soldier, a historian and a gentleman”. His reasons were not published until two days later.

By that time, protesters had been violently flung to the ground while praying, and hundreds had been trapped and assaulted in Town Hall Square. People were blinded or choked with pepper spray. Others had been hospitalised with broken limbs or bleeding wounds.

Journalist and filmmaker James Ricketson, 76, had been injured in an assault by six officers and held in a cell for five hours without water before being released without charge. Videos of NSW police punching people had gone viral around the world.

Premier Chris Minns, Minister for Police Yasmin Catley and Police Commissioner Mal Lanyon defended the police actions as “reasonable” in the circumstances.

Not a political event?
Few would disagree that Herzog’s visit to Australia was the key political event of last week. Yet key to the judgment was Wright’s determination that the Herzog visit wasn’t.

Before he arrived, Herzog defined the purpose of his visit as rebuilding Australia’s relationship with Israel. He brought a top-level delegation from Jewish national institutions with him. This was in evidence before the judge.

Also in evidence was the fact that Chris Sidoti, who had sat on a UN Commission of Inquiry that found Israel was committing genocide in Gaza and that Herzog had incited it, had called for his arrest in Australia.

But Justice Wright found that politics was not a “defining” or “dominant” purpose for the visit and that it was a “cultural event”.

Herzog’s tour did have cultural aspects, such as a trip to Bondi to meet victims of the December massacre and visits to a synagogue and school. But Herzog and Zionist leaders also consistently stressed that an important purpose was to encourage the Australian government to stand with Israel.

The act has never been used for a foreign dignitary visit before or at such short notice.

Until last week, no one would have imagined that this law would be used to enable police violence to be unleashed on peaceful citizens protesting against a controversial visit by a foreign head of state.

But a bright idea by the NSW Police changed this.

Police concerns
As public opposition to Herzog’s visit grew and likewise support for a peaceful march from Town Hall to Parliament House during Herzog’s visit, senior police became concerned that the new anti-protest law passed on December 23 might not be sufficient to stop a big march in Sydney.

The ban over most of the CBD and the Eastern Suburbs was extended on February 2. On the same day, according to evidence tendered in last week’s court case, NSW police advised the government that the Major Events Act, with its extensive powers, could help avoid any risks to Herzog during the visit, advising “Police will be empowered to address any behaviour which poses a security threat or risk to the Presidential Visit.”

It is worth noting that nothing was ever planned at the protest related to a security threat or risk to Herzog. That was also in evidence.

The Cabinet office then prepared a minute setting out arguments, including ones for and against protests, for the Minister for Tourism Kamper to consider before making his decision. He was then told to sign but not date his recommendation, which was agreed to by the NSW Executive Council and gazetted on Friday, February 6.

In arguing that the regulation had been declared for the improper purpose of suppressing protests, PAG’s barrister Felicity Graham relied on the timing of events and material in the Cabinet minute. She also relied on Premier Chris Minns’ media conference on Saturday, February 7, in which he announced the “Major Event”.

Minns talked about 3500 police, fines of more than $5500 for disobeying directions and needing to prevent “the clash of mourners and protesters”. The latter seemed to be an idea of Minns’ own making because there was never any plan for protesters to be near mourners.

Suppressing protests to keep us safe
Justice Wright agreed that it would be improper for the purpose of the regulation to be the suppression of protests. But he found that protests could be suppressed if it was consistent with the goal of facilitating “safety and crowd control” and that there was no intention on the part of the Minister or any other relevant person to “adversely affect any protest or right to protest except to the extent reasonably appropriate to facilitate the conduct of the visit”.

He agreed that there was no evidence that the protest would interfere with the President, but found that it did not matter.

When PAG’s barrister Felicity Graham argued that the powers in the Regulation could lead to unjust treatment of citizens, even those who were not protesters, the judge appeared mildly exasperated.

He assumed that officers act “reasonably”.

That turned out to be wildly optimistic. If the purpose was to keep us all safe, it had the opposite effect.

PAG is considering an appeal. The event is over, but there are many potential cases against the police, and the Act restricts liability and compensation. It might also be possible to raise implications of the Major Events Act on “freedom of expression”, which was not attempted in the short one-day hearing.

A protest was held near Parliament on Friday evening with a speech delivered from her hospital bed by a woman who suffered broken vertebrae: “We will not be silent. He [MInns] needs to take full responsibility for this and the laws that were passed. The police who did it need to take responsibility.”

If the Major Events Act can validly be used in protests, it needs reform. Imagine if the UN decided to hold a major climate conference backed by fossil fuel interests in Sydney? The whole city could be shut down to protesters.

Accountability for this disaster must start at the very top and run through to the police on the ground.

On the eve of his Australian tour, Israel’s President Isaac Herzog faces huge opposition to his visit.

In a “National Day of Protest”, hundreds of thousands are expected to march in 30 cities around Australia, including every state capital city tomorrow evening.

Herzog’s visit has been opposed by Green Party and several Labor and Independent MPs, some of whom are expected to join the marches.

The NSW Minns government has gone to extraordinary lengths to stop the Sydney protest by declaring it a “major event” under the Major Events Act. The organisers, Palestinian Action Group, will challenge the validity of this action in the Supreme Court tomorrow before the protest.

Herzog’s visit follows the anti-semitic massacre in Bondi on December 14 when 15 people were killed and many more injured by two allegedly Islamic State-inspired gunmen. One gunman was killed and the other is now facing multiple charges of murder.

The idea of bringing Herzog to Australia originated with senior Australian Zionists, including the president of the Zionist Federation of Australia Jeremy Liebler, who is a personal friend of Herzog.

Prime Minister Anthony Albanese then invited Herzog to make an official visit “to support the Jewish community at what has been a very difficult time”. He has justified his decision as reflecting a “need to build social cohesion in this country.”

Conflict rather than unity
In fact, the visit was always likely to create conflict rather than unity in Australia.

Scores of community and activist groups, including the progressive Jewish Council of Australia and NSW Council for Civil Liberties, have condemned the Herzog visit.

Amnesty International Australia urged the Australian government “to comply with its international and domestic legal obligations and investigate Herzog for genocide… As President of Israel, Herzog has overseen and legitimised Israel’s genocide and has made statements amounting to genocidal incitement.”

Federal Labor MP Ed Husic, who was previously a Minister in the Albanese government, told The Guardian that he was “uncomfortable” with the visit and did not think it would build social cohesion. He pointed to findings by a United Nations Commission of Inquiry that Herzog and other Israeli officials were “liable to prosecution for incitement to genocide” for comments made after the October 7 attack by Hamas in 2023.

Australian human rights lawyer Chris Sidoti was a member of the UN Commission of Inquiry; he told Michael West Media that:

“There is both a legal scope and a moral duty to arrest Isaac Herzog on arrival.”

Adding to the controversy over his visit, President Herzog will bring with him Doron Almog, a retired Israel Defence Forces major-general. Almog, who is currently chair of the Jewish Agency for Israel, has formerly faced arrest warrants over allegations he committed war crimes in Gaza in 2002.

A coalition of legal groups has asked the Australian federal police to investigate and arrest Almog over war crimes allegations.

War crimes challenge
Members of this coalition, including the Australian Centre for International Justice, the Palestinian Centre for Human Rights, and the Al Mezan Center for Human Rights have lodged a submission with the Australian Federal Police (AFP) arguing that Almog should be investigated for crimes committed during his time as an IDF Commander between 2000 and 2003.

“Under his command, the Israeli military was responsible for countless and extensive human rights violations and grave breaches of the Geneva Conventions inside the illegally occupied Gaza Strip,” the submission alleges.

The AFP has referred the submission to its Special Investigations Command. Almog has previously denied the allegations and a UK warrant for Almog’s arrest was previously withdrawn.

The Zionist community is meanwhile celebrating Almog’s visit.

According to a Zionist Federation of Australia promotion, Almog was due to arrive before Herzog and appear at a conference at a Sydney Synagogue yesterday alongside Zionist Liberal MP Julian Leeser to discuss anti-semitism education.

3500 police to flood Sydney’s CBD
Tension is high in Sydney where Premier Chris Minns has announced a “massive policing presence” to flood the CBD with 3500 armed police during the Herzog visit.

Premier Minns has warned Sydney’s residents against travelling to the CBD even for work on Monday, predicting disruption and even riots, despite the fact that hundreds of pro-Palestinian protests over more than two years have been uniformly peaceful.

Despite his warnings, many thousands are expected to attend a protest at Sydney’s traditional weekday protest place Town Hall Square at 6 pm tomorrow, from which they plan to march to Parliament House.

Popular 2021 Australian of the Year and campaigner against sexual assault Grace Tame and Greens Senator Mehreen Faruqi are among the advertised speakers. NSW Labor MP barrister Stephen Lawrence and Cameron Murphy are also attending and expected to speak.

The NSW government tried to deter the protesters by using unprecedented laws passed in late December to declare that no protest permits will be granted to a large swathe of Sydney which includes Town Hall Square. The ban has been in place since the laws were passed.

Although the ban does not stop people peacefully assembling, it grants the police full powers to make “move on” orders to disband protests and prevent marches.

These powers were used when mounted police prevented hundreds of peaceful Deaths in Custody campaigners conducting a short march on the pavement last month.

A coalition of groups including the Palestinian Action Group and Jews Against Occupation 48 has challenged the laws as unconstitutional.

‘Major event’ status
With support for the march growing despite Minns’ warnings, his government took a further extraordinary step yesterday and declared Herzog’s visit a major event under the Major Events Act. The legislation is typically invoked to manage crowds during sporting events or very large festivals.

The act gives the police powers to issue directions to people not to enter an area, and to search people.  Anyone who fails to comply with police directions may face penalties, including fines of up to $5,500.

But the Act states that it is not intended to be used against political protests. Today, the Palestinian Action Group announced that it will make an urgent application to the NSW Supreme Court tomorrow to declare the “major event” declaration invalid.

While in Sydney, Herzog and his delegation will visit families whose family members were killed in the Bondi massacre and will attend an invitation only “Solidarity and Light” event at the ICC centre in Darling Harbour.  He will then travel to Melbourne and Canberra.

On Friday, the independent media outlet Lamestream reported that  Prime Minister Albanese had invited him to visit Parliament although he is not expected to address Parliament.

New Zealand pro-Palestinian demonstrators marched peacefully on The Warehouse in downtown Auckland today to protest over the sale of products by the genocidal state of Israel.

Palestine Solidarity Network Aotearoa (PSNA) co-chair Maher Nazzal and fellow protesters delivered a giant letter calling on the management to stop selling SodaStream products.

SodaStream — an Israel-based company since 1978 — is at the centre of the global BDS (Boycott Divestment and Sanctions) campaign.

The letter was reluctantly accepted by The Warehouse city branch duty manager Alyce, who needed to take a management phone call before agreeing to take the letter mounted on a board.

“The Warehouse’s complicity in Israel’s war crimes must stop,” said Nazzal in the letter. “I know you will be appalled as we are at Israel’s cruel and depraved war crimes against Palestinians.”

The letter was handed over by a small deputation on behalf of about 200 protesters who stood peacefully by the shop entrance escalator in Elliott Street as they chanted “Blood on your hands” and other condemnation of Israel over the genocide in Gaza that has killed at least 69,000 people, mostly women and children.

The letter addressed to The Warehouse management said that “trading in SodaStream products . . . supports Israel to continue its war crimes against Palestinian people. It encourages Israel to expand its illegal occupation and its genocidal oppression of Palestinians.”

One third of aid trucks
In spite of the so-called “ceasefire” brokered by US President Donald Trump commencing on October 10, only one third of the promised 600 aid trucks a day had been allowed into Gaza.

“Arrest warrants have been issued by the International Criminal Court against Israel’s Prime Minister Benjamin Netanyahu and former Defence Minister Yoav Gallant for war crimes and crimes against humanity. But this is not enough,” said the letter, signed by scores of the protesters.

“On 19 July 2024 the International Court of Justice, in a landmark ruling, declared Israel’s occupation of the Palestinian territories — the West Bank, East Jerusalem and Gaza strip — is illegal and no one should give ‘aid or assistance’ to Israel in maintaining its illegal occupation.

“However, The Warehouse is giving direct ‘aid and assistance’ to Israel’s racist policies through selling SodaStream. This must stop.

“Since 2005, Palestinian civil society organisations have called for BDS (Boycott, Divestment and Sanctions) against Israel, to build international, non-violent pressure on Israel to end its brutal oppression of Palestinians.

“BDS aims to pressure Israel to end its illegal occupation of the Palestinian territories, end its apartheid policies towards Palestinians and allow Palestinian refugees to return to their homes and land in Palestine.

The PSNA letter said the protesters supported BDS against Israel — “just as we supported the international boycott of apartheid South Africa in the 1970s and 1980s”.

‘New Zealanders support sanctions’
“New Zealanders support sanctions against Israel by the ratio of two to one amongst those who give an opinion. New Zealanders expect The Warehouse to end its collaboration with Israeli apartheid and genocide and swap out of SodaStream for alternative brands,” the letter said.

The Warehouse Group’s says “ethical sourcing” policy was cited in the letter, quoting in part: “Like our customers,  we  care about doing the right thing — not only here in New Zealand but everywhere we operate.

“Our aim is to ensure our customers have confidence  that  our products have been ethically sourced.”

The letter continued: “Selling SodaStream directly violates this policy. So why do The Warehouse and it’s subsidiary, Noel Leeming, continue to sell these products linked to ethnic cleansing and genocide?”

Nasser said PSNA wanted the opportunity to speak with The Warehouse management directly about the stocking of SodaStream and looked forward to hearing from the business.

Earlier, at a rally in Te Komititanga Square several speakers about BDS policies included PSNA secretary Neil Scott and South African-born activist Achmat Esau, who explained how global sanctions had forced the brutal racist minority white regime in his homeland to abandon apartheid and bow to genuine democracy.

Esau recalled how in 1968 white South African Prime Minister John Vorster banned a tour by the England cricket team because it included a mixed-race player, Cape Town-born Basil D’Oliveira.

Boycott of apartheid South Africa
“After this incident, South Africa was excluded from international cricket until the release of political prisoner Nelson Mandela 22 years later.

“The anti-apartheid boycott of the South African regime from the 1960s until the 1980s was instrumental in bringing the racist apartheid regime to its knees,’ Esau said.

He said the success of the anti-apartheid struggle in South Africa was an indicator of how it could also succeed through the BDS movement against apartheid Israel.

“We must draw in the politicians and political parries to isolate, expose and oppose this evil Zionist regime that is guilty of state terrorism.”

“Grow a spine for Palestine!” was a frequent theme among about 5000 people protesting in the heart of New Zealand’s largest city today as the protesters demanded that the coalition government should recognise the state of Palestine and stop supporting impunity for Israel.

More than 62,000 people, mostly women and children, have been killed in Israel’s war on Gaza in the past 22 months and the country’s military have doubled down on their attacks on residential areas in the besieged enclave.

Several speakers, including opposition parliamentarians, spoke at the rally, strongly condemning Israel for its genocidal policies and crimes against humanity.

Protesters against the Israeli genocide in Gaza and occupied West Bank targeted three business sites accused of being “complicit” in Aotearoa New Zealand today.

The Palestine Solidarity Network Aotearoa’s “End Rocket Lab Genocide Complicity” themed protest picketed Rocket Lab’s New Zealand head office in Mt Wellington.

Simultaneously, protesters also picketed a site in Warkworth where Rocket Lab equipment is built and Mahia peninsula where satellites are launched.

In a statement on the PSNA website, it was revealed this week that the advocacy group’s lawyers have prepared a 103-page “indictment” against two business leaders, including the head of Rocket Lab, along with four politicians, including Prime Minister Christopher Luxon.

They have been referred to the International Criminal Court (ICC) in The Hague for investigation on an accusation of complicity with Israel’s genocide in Gaza.

Rocket Lab chief executive Sir Peter Beck is one of the six people named in the legal brief.

“Rocket Lab has recently launched geospatial intelligence satellites for BlackSky Technology,” said PSNA co-chair John Minto in a statement.

High resolution images
“These satellites provide high resolution images to Israel which are very likely used to assist with striking civilians in Gaza. Sir Peter has proceeded with these launches in full knowledge of these circumstances”

“When governments and business leaders can’t even condemn a genocide then civil society groups must act.”

The other business leader named is Rakon Limited chief executive officer Dr Sinan Altug.

“Despite vast weapons transfers from the United States to Israel since the beginning of its war on Gaza, Rakon has continued with its longstanding supply of crystal oscillators to US arms manufacturers for use in guided missiles which are then available to Israel for the bombing of Gaza, as well as Lebanon, Syria, Yemen and Iran with consequential massive loss of life,” Minto said.

“Rakon’s claims that it has no responsibility over how these ‘dual-use’ technologies are used are not credible.”

Rocket Lab and Rakon have in the past rejected claims over their responsibility.

Speakers at Mount Wellington included the Green Party spokesperson for foreign affairs Teanau Tuiono; Dr Arama Rata, a researcher and lecturer from Victoria University; and Sam Vincent, the legal team leader for the ICC referral.

Law academic Professor Jane Kelsey spoke at the Warkworth picket.

Amnesty International, Human Rights Watch, leading international scholars and the UN Special Committee to investigate Israel’s practices have all condemned Israel’s actions as genocide.

About 1000 pro-Palestinian protesters marked World Press Freedom Day — May 3 — today by marching on the public broadcaster Television New Zealand in Auckland, accusing it of 18 months of “biased coverage” on the genocidal Israeli war against Gaza.

They delivered a letter to the management board of TVNZ from Palestine Solidarity Network (PSNA) co-chair John Minto declaring: “The damage [done] to human rights, justice and freedom in the Middle East by Western media such as TVNZ is incalculable.”

The protesters marched on the television headquarters near Sky Tower about 4pm after an hour-long rally in the heart of the city at a precinct dubbed “Palestine Square” in the Britomart transport hub’s Te Komititanga Square.

Several opposition politicians spoke at the rally, calling for a ceasefire in the brutal war on Gaza that has killed more than 62,000 Palestinians with no sign of a let-up.

Labour Party’s disarmament and arms control spokesperson Phil Twyford was among the speakers that included Green Party co-leader Marama Davidson and Ricardo Menéndez March.

All three spoke strongly in support of Greens co-leader Chlöe Swarbrick’s Member’s Bill to sanction Israel for its unlawful presence in the Occupied Palestinian Territory.

Davidson said the opposition parties were united behind the bill and all they needed were six MPs in the coalition government to “follow their conscience” to support it.

Appeals for pressure
They appealed to the protesters to put pressure on their local MPs to support the humanitarian initiative.

In The Hague this week, the International Court of Justice (ICJ) heard evidence from more than 40 countries and global organisations condemning Israel over its actions in deliberately starving the more than 2 million Palestinians by blockading the besieged enclave for more than the past two months.

Only the United States and Hungary spoke in support of Israel.

A senior diplomat from Qatar, a leading mediator country in the war, told the ICJ that Israel was conducting a “genocidal war against the Palestinian people” and weaponising humanitarian aid.

Mutlaq al-Qahtani, Qatari Ambassador to The Netherlands, also said there were “new trails of tears in the West Bank mirroring Gaza’s fate”.

Among the speakers in the Auckland rally, one of about 30 similar protests for Palestine across New Zealand this weekend, was coordinator Roger Fowler of the Auckland-based Kia Ora Gaza humanitarian aid organisation, who denounced the overnight drone attack on the Gaza-bound Freedom Flotilla aid ship Conscience in international waters after leaving Malta.

The ship was crippled by the suspected Israel attack, endangering the lives of some 30 human rights activists on board. Fowler said: “That’s 2000 km away from Israel, that’s how desperate they are now to stop the Freedom Flotilla.”

He reminded protesters that Marama Davidson and retired trade unionist Mike Treen had been on previous aid protest voyages in past years trying to break the Israeli blockade, but there was no New Zealander on board in the current mission.

Media ‘credibility challenge’
Journalist and Pacific Media Watch convenor Dr David Robie spoke about World Media Freedom Day. He paid a tribute to the sacrifices of 211 Palestinian journalists killed by Israel — many of them targeted — saying Israel’s war on Gaza had become the “greatest credibility challenge for journalists and media of our times”.

Many protesters carried placards declaring slogans such as “TVNZ your biased reporting is shameful. Where is your integrity?”, “Journalists are not targets” and “Caring for the children of Palestine is what it’s about.”

After marching about 1km between Te Komititanga Square and the TVNZ headquarters, the protesters gathered outside the entrance chanting for fairness and balance in the reporting.

“TVNZ lies. For the past 18 months they have been nothing but complicit,” said one Palestinian speaker to a chorus of: “Shame!”

He said: “Every time TVNZ lies, a little boy in Gaza dies.”

Another Palestinian speaker, Nadine, said: “Every time the media lies, a little girl in Gaza dies.”

Deputation delivers TVNZ letter
A deputation from the protesters delivered the letter from PSNA’s John Minto addressed to the TVNZ board chair Alastair Carruthers but found the main foyer main entrance closed so the message was left.

Minto’s two-page letter calling for an independent review of TVNZ’s reporting on Palestine and Israel said in part:

“Over the past 18 months of industrial scale killing of Palestinians by the Israeli military in Gaza we have been regularly appalled at the blatantly-biased reporting on the Middle East by Television New Zealand.

“TVNZ’s reporting has been relentlessly and virulently pro-Israel. TVNZ has centred Israeli narratives, Israeli explanations, Israeli justifications and Israeli propaganda points on a daily basis while Palestinian viewpoints are all but absent.

“When they are presented they are given rudimentary coverage at best. More often than not Palestinians are presented as the incoherent victims of Israeli brutality rather than as an occupied people fighting for liberation in a situation described by the International Court of Justice as a “plausible genocide”.

“This pattern of systemic bias and unbalanced reporting is not revealed by TVNZ’s complaints system which focuses on individual stories rather than ingrained patterns of pro-Israel bias.

“Every complaint we have made to TVNZ has, with one minor exception, been rejected by your corporation with the typical refrain that it’s not possible to cover every aspect of an issue in a single story but that over time the balance is made up.

“Our issue is that the bias continues throughout TVNZ’s reporting on a story-by-story, day-by-day basis — the balance is never achieved. The reporting goes ahead just the way the pro-Israel lobby is happy with.”

The rest of the letter detailed many examples of the alleged systematic bias, such as failing to describe Gaza, West Bank and East Jerusalem and as “Occupied” territory as they are designated under international law, and failing to state the illegality of Israel’s military occupation.

Minto concluded by stating: “It is prolonging Israel’s illegal occupation, its apartheid policies, its ethnic cleansing and theft of Palestinian land. TVNZ is part of the problem – a key part of the problem.”

The letter called for an independent investigation.

Former US President Barack Obama has taken to social media to praise Harvard’s decision to stand up for academic freedom by rebuffing the Trump administration’s demands.

“Harvard has set an example for other higher-ed institutions — rejecting an unlawful and ham-handed attempt to stifle academic freedom, while taking concrete steps to make sure all students at Harvard can benefit from an environment of intellectual inquiry, rigorous debate and mutual respect,” Obama wrote in a post on X.

He called on other universities to follow the lead.

Harvard will not comply with the Trump administration’s demands to dismantle its diversity programming, limit student protests over Israel’s genocidal war on Gaza, and submit to far-reaching federal audits in exchange for its federal funding, university president Alan M. Garber ’76 announced yesterday afternoon.

“No government — regardless of which party is in power — should dictate what private universities can teach, whom they can admit and hire, and which areas of study and inquiry they can pursue,” he wrote, reports the university’s Harvard Crimson news team.

The announcement comes two weeks after three federal agencies announced a review into roughly $9 billion in Harvard’s federal funding and days after the Trump administration sent its initial demands, which included dismantling diversity programming, banning masks, and committing to “full cooperation” with the Department of Homeland Security.

Within hours of the announcement to reject the White House demands, the Trump administration paused $2.2 billion in multi-year grants and $60 million in multi-year contracts to Harvard in a dramatic escalation in its crusade against the university.

More focused demands
On Friday, the Trump administration had delivered a longer and more focused set of demands than the ones they had shared two weeks earlier.

It asked Harvard to “derecognise” pro-Palestine student groups, audit its academic programmes for viewpoint diversity, and expel students involved in an altercation at a 2023 pro-Palestine protest on the Harvard Business School campus.

It also asked Harvard to reform its admissions process for international students to screen for students “supportive of terrorism and anti-Semitism” — and immediately report international students to federal authorities if they break university conduct policies.

It called for “reducing the power held by faculty (whether tenured or untenured) and administrators more committed to activism than scholarship” and installing leaders committed to carrying out the administration’s demands.

And it asked the university to submit quarterly updates, beginning in June 2025, certifying its compliance.

Garber condemned the demands, calling them a “political ploy” disguised as an effort to address antisemitism on campus.

“It makes clear that the intention is not to work with us to address antisemitism in a cooperative and constructive manner,” he wrote.

“Although some of the demands outlined by the government are aimed at combating antisemitism, the majority represent direct governmental regulation of the ‘intellectual conditions’ at Harvard.”

Freedom of the press — a bedrock principle of American democracy — is under threat in the United States.

Here at Columbia University Graduate School of Journalism we are witnessing and experiencing an alarming chill. We write to affirm our commitment to supporting and exercising First Amendment rights for students, faculty, and staff on our campus — and, indeed, for all.

After Homeland Security seized and detained Mahmoud Khalil, a recent graduate of Columbia’s School of Public and International Affairs, without charging him with any crime, many of our international students have felt afraid to come to classes and to events on campus.

They are right to be worried. Some of our faculty members and students who have covered the protests over the Gaza war have been the object of smear campaigns and targeted on the same sites that were used to bring Khalil to the attention of Homeland Security.

President Trump has warned that the effort to deport Khalil is just the first of many.

These actions represent threats against political speech and the ability of the American press to do its essential job and are part of a larger design to silence voices that are out of favour with the current administration.

We have also seen reports that Immigration and Customs Enforcement is trying to deport the Palestinian poet and journalist Mosab Abu Toha, who has written extensively in the New Yorker about the condition of the residents of Gaza and warned of the mortal danger to Palestinian journalists.

There are 13 million legal foreign residents (green card holders) in the United States. If the administration can deport Khalil, it means those 13 million people must live in fear if they dare speak up or publish something that runs afoul of government views.

There are more than one million international students in the United States. They, too, may worry that they are no longer free to speak their mind. Punishing even one person for their speech is meant to intimidate others into self-censorship.

One does not have to agree with the political opinions of any particular individual to understand that these threats cut to the core of what it means to live in a pluralistic democracy. The use of deportation to suppress foreign critics runs parallel to an aggressive campaign to use libel laws in novel — even outlandish ways — to silence or intimidate the independent press.

The President has sued CBS for an interview with Kamala Harris which Trump found too favourable. He has sued the Pulitzer Prize committee for awarding prizes to stories critical of him.

He has even sued the Des Moines Register for publishing the results of a pre-election poll that showed Kamala Harris ahead at that point in the state.

Large corporations like Disney and Meta settled lawsuits most lawyers thought they could win because they did not want to risk the wrath of the Trump administration and jeopardize business they have with the federal government.

Amazon and Washington Post owner Jeff Bezos decided that the paper’s editorial pages would limit themselves to pieces celebrating “free markets and individual liberties.”

Meanwhile, the Trump administration insists on hand-picking the journalists who will be permitted to cover the White House and Pentagon, and it has banned the Associated Press from press briefings because the AP is following its own style book and refusing to refer to the Gulf of Mexico as the Gulf of America.

The Columbia Journalism School stands in defence of First Amendment principles of free speech and free press across the political spectrum. The actions we’ve outlined above jeopardise these principles and therefore the viability of our democracy. All who believe in these freedoms should steadfastly oppose the intimidation, harassment, and detention of individuals on the basis of their speech or their journalism.

About 200 demonstrators gathered in the heart of New Zealand’s biggest city Auckland today to welcome the Gaza ceasefire due to come into force tomorrow, but warned they would continue to protest until justice is served with an independent and free Palestinan state.

Jubilant scenes of dancing and Palestinian folk music rang out across Te Komititanga square amid calls for the Israeli ambassador to be expelled from New Zealand and for the government to halt holiday worker visas for “Zionist terrorist” soldiers or reservists.

While optimistic that the temporary truce in the three-phase agreement agreed to between the Hamas resistance fighter force and Israel in Doha, Qatar, on Wednesday would be turned into a permanent ceasefire, many speakers acknowledged the fragility of the peace with at least 116 Palestinians killed since the deal — mostly women and children.

Many parts of the complex 42-day first phase of the agreement have the potential to derail peace.

“We have won . . . won. We are there, we are here. We are everywhere,” declared  defiant Gaza survivor Dr Abdallah Gouda, whose family and other Palestinian community members in Aotearoa have played a strong solidarity role alongside activist groups during the 15-month genocidal war waged on the besieged 365 sq km enclave.

He said the struggle would go on until Palestine was finally free and independent; Palestinians would not leave their land.

“They’re [Israelis] killing us. But Palestinians decided to fight [back] . . . No Palestinians want to leave Gaza. They want to stay . . .”

‘We want to rebuild Gaza’
Dr Gouda said in both Arabic and English to loud cheers, “We promise God, we promise the people that we will never leave.

“We can be starved, we can be killed , but we will never leave.

“We want to rebuild Gaza, we will rebuild hospitals, we will rebuild schools, we will rebuild churches . . .

“We will mend Gaza. It’s not too difficult because Gaza was beautiful, we will rebuild Gaza as the best!”

His son Ali, who has been the most popular cheerleader during the weekly protests, treated the crowd to resounding chants including “Free, free Palestine” and “Netanyahu, you can’t hide”.

Commenting on the ceasefire due to start tomorrow, Palestine Solidarity Network Aotearoa (PSNA) national secretary Neil Scott said: “This is just the end of the beginning — and now we will fight for justice.”

Scott said the continued struggle included the BDS — boycott, divest, sanctions — campaign. He appealed to the crowd to check their BDS apps and then monitor their “cupboards at home” to remove and boycott Israeli-sourced products.

He also said the PSNA would continue to keep pressing the NZ government to ban Israelis with military service visiting New Zealand on working holiday visas.

“Even now, stop allowing young Zionist terrorists — because that’s what they are — to come to Aotearoa to live among the decent people of New Zealand and wash the blood off their hands and feel innocent again,” Scott said.

“Not a chance, we are pushing this government to end that working holiday visa.”

Speakers also called for the expulsion of the Israeli ambassador from New Zealand.

New Palestine documentary
In his final chant, Ali appealed to the crowd: “Raise and wave your Palestinian flags and keffiyeh.”

Future rallies will include protest marches in solidarity with Palestine.

RNZ reports that New Zealand’s Justice for Palestine co-convenor Samira Zaiton said she would only begin to breathe easy when the ceasefire began on Sunday.

“It feels as though I’m holding my breath and there’s a sigh of relief that’s stuck in my throat that I can’t quite let out until we see it play out.”

In Sydney, Australian Jewish author Antony Loewenstein, who visited New Zealand in 2023 to speak about his award-winning book, The Palestine Laboratory, has been a consistent and strong critic of Israel throughout the war.

“I often think about what Israel has unleashed in Gaza — the aim is complete devastation, and Palestinians there have a long history of suffering under this arrogant and criminal war-making,” he said today in a post on X.

“My first visit to Gaza was in July 2009, six months after Israel’s Operation Cast Lead war, and I made a short film about what I saw and heard:”

A global civil society watchdog has condemned Fiji for blocking protest marches over the Palestine genocide by Israel and clamping down on a regional Pacific university demonstration with threats.

However, while the Civicus Monitor rates the state of civic space in Fiji as “obstructed” it has acknowledged the country for making some progress over human rights.

“While the government took steps in 2023 to repeal a restrictive media law and reversed travel bans on critics, the Public Order (Amendment) Act, which has been used to restrict peaceful assembly and expression and sedition provisions in the Crimes Act, remains in place,” said the Civicus Monitor in a statement on its website.

“The police have also restricted pro-Palestinian marches” — planned protests against Israel’s genocide against Gaza in which more than 44,000 people have been killed, mostly women and children.

The monitor said the Fiji government had “continued to take steps to address human rights issues in Fiji”.

In July 2024, it was reported that the Fiji Corrections Service had signed an agreement with the Fiji Human Rights and Anti-Discrimination Commission to provide them access to monitor inmates in prison facilities.

In August 2024, a task force known as Fiji’s National Mechanism for Implementation, Reporting, and Follow-up (NMIRF) was launched by the Attorney-General Graham Leung.

The establishment of the human rights task force is to coordinate Fiji’s engagement with international human rights bodies, including the UN human tights treaty bodies, the Universal Periodic Review and the Special Procedures of the Human Rights Council.

In September 2024, it was announced that a Truth and Reconciliation Commission (TRC) would be established to investigate and address human rights violations since 1987.

TRC steering committee chair and Assistant Minister for Women Sashi Kiran said that they were working on drafting a piece of legislation on this and that the commission would operate independently from the government.

“In recent months, the police once again blocked an application by civil society groups to hold a march for Palestine, while university unions were threatened with a pay dock for their involvement in a strike,” the Civicus Monitor said.

Police deny Palestine solidarity march
“The authorities have continued to restrict the right to peaceful assembly, particularly around Palestine.”

On 7 October 2024, the police denied permission for a march in the capital Suva by the NGO Coalition on Human Rights in Fiji.

The Fiji Police Force ACP Operations Livai Driu was quoted as saying: “The decision was made based on security reasons.”

“The march was intended to express solidarity with the Palestinian people amidst the ongoing genocide and humanitarian crisis in Gaza. The coalition’s application to hold the march was met with repeated delays and questioning by government authorities,” said the Civicus Monitor.

“The coalition said that this was ‘reminiscent of a dictatorial system of the past’.

The coalition added: “It is shameful that the Fiji Coalition Government which has lauded itself internationally and regionally as being a promoter of human rights and peace has continued to curtail the rights of its citizens by denying permit applications calling for an end to the genocide in Gaza.”

Activists also pointed out the double standards by the police, as permits were provided to a group in support of Israel to march through Suva and wave the Israeli flag, said the Civicus Monitor.

“The restriction around protests on Palestine and waving the Palestinian flag has persisted for over a year.

“As previously documented, the activists have had to hold their solidarity gatherings in the premises of the FWCC office as the police have restricted solidarity marches, under the Public Order (Amendment) Act 2014.

“The law allows the government to refuse permits for any public meeting or march deemed to prejudice the maintenance of peace or good order.

“It has often been misused by the authorities to restrict or block peaceful gatherings and demonstrations, restricting the right to peaceful assembly and association.

“Protest gatherings at FWCC have also faced intimidation.”

The UN Human Rights Council and human rights groups have called for the repeal of restrictive provisions in the law, including the requirement for a police permit for protests, which is inconsistent with international standards.

These restrictions on solidarity marches for Palestine are inconsistent with Fiji’s international human rights obligations under the International Covenant on Civil and Political Rights (ICCPR) which guarantees freedom of expression and peaceful assembly.

These actions also contravene Fiji’s constitution that guarantees these rights.

University threatens union members
In October 2024, members of the Association of the University of the South Pacific (USP) and the University of the South Pacific Staff Union who went on strike were reportedly threatened by the university, reported the Civicus Monitor.

The human resource office said they would not be paid if they were not in office during the strike.

The unions commenced strike action on 18 October 2024 in protest against the alleged poor governance and leadership at the university by vice-chancellor Pal Ahluwalia and the termination of former staff union (AUSPS) president Dr Tamara Osborne Naikatini, calling for her to be reinstated.

“The unions expressed dissatisfaction following the recent release of the Special Council meeting outcome, which they say misleadingly framed serious grievances as mere human resource issues to be investigated rather than investigating [Professor] Ahluwalia.

“The unions say they have been raising concerns for months and called for Ahluwalia to be suspended and for a timely investigation.”

Alongside the staff members currently standing in protest were also several groups of students.

On 24 October 2024, the students led a march at the University of the South Pacific Laucala campus that ended in front of the vice-chancellor’s residence. The students claimed that Professor Ahluwalia did not consider the best interests of the students and called for his replacement.

The USP is owned by 12 Pacific nations, which contribute a total 20 percent of its annual income, and with campuses in all the member island states.

Amnesty International officials at a rally in Auckland today doubled down on their global report this week accusing Israel of genocide and called on Aotearoa New Zealand to take more action over the atrocities in the besieged enclave of Gaza.

The global human rights movement’s 296-page fully documented report says Israel has “unleashed hell and destruction on Palestinians in Gaza brazenly, continuously and with total impunity”.

The allegations have enraged the Tel Aviv government and stirred the unaffiliated Israeli chapter of Amnesty International to distance itself from the “genocide” allegation while admitting “serious crimes are being committed in Gaza, that must be investigated”.

Speaking at the weekly rally in Te Komititanga Square in the heart of Auckland today, Amnesty International Aotearoa’s people power manager Margaret Taylor said the report was “irrefutable”.

“Israel has committed and is — this very minute — committing genocide against Palestinians in the occupied Gaza Strip,” she said and was supported with loud shouts of “shame, shame!”

Al Jazeera reports that 50 people were killed in the latest Israeli attacks on central Gaza’s Nuseirat refugee camp — in which the death toll included six children and five women — and the Indonesian Hospital in northern Gaza’s Beit Lahiya district.

The report examines in detail Israel’s violations in Gaza over nine months between 7 October 2023 and early July 2024.

‘Firsthand accounts, satellite photography’
“Amnesty International interviewed hundreds of people with firsthand accounts. We analysed photos and video footage of the devastation, the remains of weaponry, corroborated with satellite photography, and we reviewed a huge range of data sets, repirts and statements by UN agencies, humanitarian organisations, human rights groups, and senior Israeli government officials and military leaders,” said Taylor.

“As I said before, this is irrefutable.”

Noting that the “atrocity crimes” against Israelis by Hamas on 7 October 2023, which triggered the current war — although brutal repression against the Palestinians has been extensively reported since the Nakba in 1948 — “do not justify genocide”.

The publication of the report has been welcomed around the world by many humanitarian and human rights groups but condemned by Israel and criticised by its main backer, the United States.

In a statement, the Israeli Foreign Minister claimed: “The deplorable and fanatical organisation Amnesty International has produced a fabricated report that is entirely false and based on lies.”

Last month, the international Criminal Court (ICC) issued arrest warrants for Israel Prime Minister Benjamin Netanyahu and former Foreign Minister Yoav Gallant for alleged war crimes and crimes against humanity.

The International Court of Justice (ICJ) is also investigating Israel over “plausible genocide” in a case brought by South Africa and supported by at least 18 other countries.

Israel’s actions had brought Gaza’s population to the “brink of collapse”, said the Amnesty International report.

“Its brutal military offensive had killed more than 42,000 Palestinians [now more than 44,000], including over 13,300 children, and injured over 97,000 more, by 7 October 2024, many of them in direct or deliberately indiscriminate attacks, often wiping out entire multigenerational families.

“It has caused unprecedented destruction, which experts say occurred at a level and speed not seen in any other conflict in the 21st century, levelling entire cities and destroying critical infrastructure, agricultural land and cultural and religious sites.

“It thereby rendered large swathes of Gaza uninhabitable.”

NZ needs to take action
Taylor told the rally that New Zealand needed to take more action over the genocide, such as:

• Publicly recognise that Israeli authorities are committing the crime of genocide and commit to strong and sustained international action;
• Ban imports from illegal settlements as well as investment in companies connected to maintaining the occupation; and
• Do everything possible to facilitate Palestinian people seeking refuge to come to Aotearoa New Zealand and receive support.

In RNZ’s Checkpoint programme on Thursday, Amnesty International Aotearoa’s advocacy and movement building director Lisa Woods said the organisation had worked to establish the intent behind Israel’s acts in Gaza, adding that they meet the definition of genocide.

The series of air strikes analysed in the report had hit civilian homes in densely populated urban areas.

“No evidence was found that any of these strikes were directed at a military objective,” she said.

“The report found that the way these attacks were conducted is that they were conducted in ways that were designed to cause a very high number of fatalities and injuries among the civilian population.”

Today’s Palestine rally also devoted part of its activities to preparing a series of on-the-spot submissions to the Treaty Principles Bill amid many “Kill the bill” tee-shirts, banners and placards.

The PANG media team at this month’s Pacific International Media Conference in Fiji caught up with independent journalist, author and educator Dr David Robie and questioned him on his views about decolonisation in the Pacific.

Dr Robie, editor of Asia Pacific Report and deputy chair of Asia Pacific Media Network (APMN), a co-organiser of the conference, shared his experience on reporting on Kanaky New Caledonia and West Papua’s fight for freedom.

He speaks from his 40 years of journalism in the Pacific saying the United Nations and the Pacific Islands Forum need to step up pressure on France and Indonesia to decolonise.

This interview was conducted at the end of the conference, on July 6, and a week before the Melanesian Spearhead Group (MSG) leaders called for France to allow a joint United Nations-MSG mission to New Caledonia to assess the political situation and propose solutions for the ongoing crisis.

The leaders of the subregional bloc — from Fiji, FLNKS (Kanak and Socialist National Liberation Front of New Caledonia), Papua New Guinea, Solomon Islands and Vanuatu — met in Tokyo on the sidelines of the 10th Pacific Islands Leaders Meeting (PALM10), to specifically talk about New Caledonia.

They included Fiji’s Sitiveni Rabuka, PNG’s James Marape, Solomon Islands’ Jeremiah Manele, and Vanuatu’s Charlot Salwai.

In his interview with PANG (Pacific Network on Globalisation), Dr Robie also draws parallels with the liberation struggle in Palestine, which he says has become a global symbol for justice and freedom everywhere.

“I should mention Palestine as well because essentially it’s settler colonisation.

“What we’ve seen in the massive protests over the last nine months and so on there has been a huge realisation in many countries around the world that colonisation is still here after thinking, or assuming, that had gone some years ago.

“So you’ll see in a lot of protests — we have protests across Aotearoa New Zealand every week —  that the flags of Kanaky, West Papua and Palestine fly together.

“The people see these as symbolic of the repression and injustice all over the world.”

The Aotearoa Caravan For a Free Palestine arrived in Auckland at the weekend and was greeted and supported by a large rally and march downtown before heading for Hamilton on the next stage.

“260 days of wives becoming widows.  260 days of mothers becoming children-less.  260 days of schools being bombed, of mosques being bombed, of churches being bombed,  260 days of hunger, of starvation, of deprivation of necessities,” said a speaker at the rally describing the human cost of Israel’s genocidal war on Gaza.

Green Party MP Steve Abel condemned the weak role of both politicians and news media in New Zealand over the war, saying a major problem was a “lack of political analysis and lack of media analysis”.

He called on the Fourth Estate to do better in informing the public about the “truth of the war – it’s not a war, it’s genocide”.

A solidarity organiser, Reverend Chris Sullivan, said the caravan of protesters were travelling from Cape Reinga to Parliament to urge the New Zealand government to take stronger action to end the war and unfolding genocide in Gaza.

The caravan participants also hope to help build a lasting peace based on a just solution to the suffering of the Palestinian people.

Last night they were welcomed to Auckland by local solidarity acitivists with shared kai at the Whānau Maria in Ponsonby.

The caravan called on the government to:

• Issue a clear public statement condemning Israel’s war crimes and affirming the ICJ ruling on the plausibility of genocide. Demand that Israel adhere to international law, including the Genocide Convention which recognises Palestinians’ right to protection from genocide; and demand an end to the illegal occupation and apartheid.

• Sanction Israel until it complies with international law and respects Palestinian rights. Following the precedent set by the Russia Sanctions Act 2022, New Zealand should act with similar resolve against Israel and any entity aiding its war crimes and genocide.
• Recognise Palestinian Statehood: This is a vital step towards ensuring justice for Palestinians and is the foundation for full equitable participation in international relations. While New Zealand endorses its support for a two-state solution, it does not recognise Palestine as a state, only Israel. This lack of recognition leaves Palestinians who are living under illegal occupation, vulnerable to ongoing settler violence.
• Grant visas to Palestinian New Zealanders’ families: Allow the families of Palestinian New Zealanders in Gaza to reunite in safety. Similar visas were granted to Ukrainians within a month of Russia’s invasion. Palestinians deserve the same consideration.
• Increase UNRWA funding: The United Nations Relief and Works Agency (UNRWA) provides critical humanitarian assistance to Palestinians in Gaza and surrounding regions and the New Zealand government should meet its legal and humanitarian responsibilities by increasing aid funding to a level that reflects the severity of the humanitarian crisis. 

Reverend Sullivan drew attention to a statement on June 20 by the Irish Catholic Bishops that called for “courageous world leadership” to stop the war in the Holy Land:

“This war is an attack on all of humanity.  When people are deprived of basic human dignity and of necessary humanitarian aid, we are all made poorer,” the statement said.

“Efforts by the United Nations to address the humanitarian crisis are welcome.  But, the people of the Holy Land — and around the globe — need clear and courageous leadership from world leaders.

“Who is prepared to put the plight of people and the dignity of every human person as the overriding priority in bringing this outrage to an end?

“In the words of Pope Francis during his Angelus address on June 2, ‘it takes courage to make peace, far more courage than to wage war.’  Let us pray that leaders will show courage now at this vital moment.”

Catholics, and all people of good will, were invited to pray and to lobby members of Parliament for the New Zealand government to provide that “clear and courageous leadership” for peace and justice in the Holy Land.
