The managers of the New Zealand’s $86 billion Super Fund failed to properly address human rights issues when considering whether to exclude companies from its investments, the High Court has found

Justice Simon Mount granted an application by the Palestine Solidarity Network Aotearoa (PSNA) for judicial review of Guardians of New Zealand Superannuation’s policies relating to ethical investment.

In a decision released today, Justice Mount declared parts of the fund’s policy documents, standards and procedures, and its sustainable investment framework were “unreasonable and unlawful”.

The court also ordered the crown entity to pay PSNA’s legal costs.

PSNA co-chair John Minto said the decision was a victory for Palestinian rights, while Guardians of New Zealand Superannuation said it was considering its next move.

The sovereign wealth fund was created in 2001 to help provide for New Zealander’s superannuation costs.

By law, Guardians are required to invest the funds on a prudent commercial basis, manage and administer the fund with best-practice portfolio management, and avoid prejudice to New Zealand’s reputation as “a responsible member of the world community”.

Backbone of case
That last duty formed the backbone of the case taken by PSNA, who have long lobbied the Guardians to divest from companies it claims to be complicit in human rights abuses in the occupied Palestinian territories.

The Guardians excluded development, construction and technology companies involved in settlements in the Occupied Palestinian Territories in 2012.

In 2021, following years of lobbying by PSNA, the Guardians also excluded five Israeli banks from its portfolio on the grounds there was an unacceptable risk the banks were materially contributing to breaches of human rights standards and that engaging with the banks themselves was unlikely to be effective.

PSNA continued to request the exclusion of other investments due to alleged human rights breaches and focused on four companies that featured on a United Nations Human Rights Council database of companies trading with illegal Israeli settlements — Airbnb, Booking.com, Expedia, and Motorola.

Justice Mount said the chief executive of the Guardians replied to the group in mid-2024 noting none of the companies “currently meets the exclusion threshold under our Sustainable Investment Framework”.

In later correspondence, the Guardians’ head of sustainable investment reiterated that stance, which led PSNA to indicate it would seek the judicial review.

In his findings, Justice Mount noted the Guardian’s 2020 policy documents identified several standards and benchmarks that were later removed — including the Principles for Responsible Investment, principles of the UN Global Compact, and a broad reference to “other good practice standards”.

Earlier policy removed
The earlier policy referred to several sets of standards described as “universally recognised by the world community — with signatories including investment managers, investee companies and the peers of Guardians — and unlikely to be superseded”.

The 2020 policy stated its applicable principles were based on the UN Global Compact, in particular the requirements to support and respect human rights and “no complicity in abuses”.

It also set a threshold for excluding government bonds where there was “widespread condemnation or sanctions by the international community and New Zealand has imposed meaningful diplomatic, economic or military sanctions”.

Justice Mount noted the almost 3000 pages of evidence filed for the judicial review allowed him to gain a picture of how the Guardians had used their policy documents in practice.

The judge noted the Guardians’ approach to excluding investments was not entirely coherent and the policies failed to meet the basic requirements of the law when alleged breaches of human rights standards were concerned.

The Guardians had a duty to reformulate its policy documents to be consistent with the Act, he said.

Minto celebrated the court’s ruling.

Fund raking in money
The group was confident the Super Fund would divest from Airbnb, Booking.com, Expedia and Motorola once it had rewritten its policies to comply with the law, he said.

The High Court judgment showed the Super Fund had invested $67 million in the four companies.

Minto said the fund was raking in money from appalling breaches of international law by Israel in the Occupied Palestinian Territories of Gaza, the West Bank and East Jerusalem.

The country’s leading sovereign wealth fund should be setting the benchmark for all New Zealand investment funds, not deriving money from war crimes and massive human rights abuses, he said.

The lack of a clear grounds to exclude companies from investment because of human rights abuses were particularly problematic, Minto said.

“This is beyond outrageous. Our largest sovereign wealth fund, owned by the government on behalf of the people of New Zealand, has no specific references to human rights standards in its investment exclusions policy.”

The case had revealed the exclusions policy was weakened and direct references to human rights standards were removed the year after the fund divested from five Israeli banks, Minto said.

Replaced with vague policy
“The Super Fund replaced a principled policy with an entirely vague and subjective assessment of companies which meant they could resist pressure from human rights groups such as PSNA.

“The fund was entirely making up legal sounding excuses as it went. It meant they could now keep on their books other companies which abuse the human rights of Palestinians,” he said.

“The Super Fund owes us all an apology and in particular an apology to Palestinians here and in Palestine, whose suffering is helping pay the price of the fund’s increasing wealth.”

Guardians of New Zealand Superannuation chief executive Jo Townsend said the crown entity was still considering its response to the decision.

“We recognise that we are investing on behalf of all New Zealanders, and that gives people a legitimate interest in how we manage the fund,” she said.

“We will thoroughly evaluate today’s decision and determine how best to respond to it,” she said.

The UN Human Rights Council database featuring the four companies is from a list of 97 companies involved with illegal Israeli settlements.

The database came about following a 2016 UN Security Council resolution, co-sponsored by New Zealand, that led to diplomatic rupture between the two countries and Israel recalling its ambassador.

Israeli media reported at the time that Prime Minister Benjamin Netanyahu warned Foreign Affairs Minister Murray McCully proceeding with the resolution wold be considered a “declaration of war”.

You are about to meet US Secretary of State Marco Rubio at a time of real global tension.

Moments like this define countries.

My great-grandfather fought fascism.

In 1935, when fascist Italy invaded my country of birth, Ethiopia, then Abyssinia, Emperor Haile Selassie warned the world at the League of Nations. Many countries hesitated. New Zealand didn’t.

Under Prime Minister Michael Joseph Savage, we called for sanctions. We chose principle over power.

We used to be clear about our principles in international politics. We stood against apartheid. We stood against nuclear testing in the Pacific.

In the 2010s, New Zealand went across Africa, the Middle East, Latin America and Asia asking for support to sit on the UN Security Council — not as a powerful country, but as a voice for the powerless.

Many countries trusted us and backed us. And for a time, we honoured that trust.

On 23 December 2016, under [then Foreign Minister] Murray McCully, we backed a UN resolution declaring Israeli settlements illegal under international law. There was pressure. We stood firm.

On 25 March 2026, the UN voted to recognise slavery and the transatlantic slave trade as among the gravest crimes against humanity. Most countries supported it. New Zealand stepped back.

And as of 2026, we still refuse to recognise the State of Palestine while genocide unfolds in Gaza.

Minister, the current global tensions make this even more important. New Zealand is clear on international law when it comes to Iran. We must be just as clear when it comes to the United States and Israel.

As a small trading nation, our economic, diplomatic and security interests depend on international law being applied consistently. If we pick and choose, we weaken that system and we weaken ourselves.

Our reputation was built by standing up and punching above our weight, even when it was uncomfortable.

That is where our soft power came from. We have the potential to be a superpower in soft power.

Right now, we risk losing that by moving closer to powerful countries, even when they are in the wrong.

Minister, take that history with you into that meeting. Be clear. Be consistent. Stand for international law everywhere, not just where it is easy.

People in New Zealand and around the world are watching. And history has a long memory.

“It is leading us all to disaster. Palestine is the place you come thundering, crashing into the buffers, the limits of the Western liberal moral imagination.

“The tragedy and complexity of Israel is that it’s both a product of the most unspeakable racism and a cause of it. Zionism was born from the suffering of Jewish people in Europe, culminating in the Holocaust, from a desire for a safe haven, a territory where Jews would for once be the hosts and not the eternal guests.

“It was framed as a return to a historic biblical homeland. and for its supporters. These two factors give it an entirely different complexion morally from other enterprises where predominantly European populations have settled far-flung parts of the world.

Dispossession and subjugation
“There’s no doubt that the Zionist dream has enormous emotional power. The problem, of course, is the other side of the equation, the people. It was inflicted upon the Palestinians whose experience of dispossession and subjugation was no different from that of countless other peoples subjected to European colonialism.

“In fact, arguably, it’s been considerably worse than many, precisely because of the licence and indulgence granted to the Israeli state.

“Let’s lay out the bold, indisputable facts. In 1948, more than 80 percent of the Palestinian population of what became Israel fled their homes. Now, if you want to believe this was not an act of deliberate ethnic cleansing, fine.

“What’s undeniable is that they were never allowed to return. In 1947, they were there. In 1949, they were not. The granting of the vote to that small fragment of the Palestinian population that remained provided a democratic fig leaf for the new state, one that was blown away once the Israelis occupied Gaza and the West Bank in 1967.

“There Palestinians have no right to vote for the political entity, the state of Israel that controls their lives. Jewish settlers, on the other hand, occupying the same territory do.

“Israel is and has always been a state whose defining feature is that it’s structured to ensure the domination of one ethnicity over another. What else does the term a Jewish state mean?

The Albanese government has rejected a proposal to strip tax-deductible status from Australian charities found to be supporting illegal occupations, amid mounting scrutiny over donations flowing to Israeli settlements and the Israel Defense Forces (IDF).

Michael West Media has identified 5 charities either sending money to the IDF or to parties associated with illegal West Bank settlements in Occupied Palestine.

The proposed amendment, introduced by Greens Senator Mehreen Faruqi, would explicitly bar organisations from receiving deductible gift recipient (DGR) status if they are found to have supported an “illegal occupation”.

“The fact that people are sending money to support the war crimes of the Israeli military and to expand illegal, violent settlements in the West Bank is bad enough, but that Australian taxpayers are subsidising these settlements is completely outrageous,” Faruqi said.

“Supporting these heinous crimes deserves investigation, not a tax deduction.”

The amendment, circulated in the Senate as part of the Treasury Laws Amendment (Supporting Choice in Superannuation and Other Measures) Bill 2025, would insert a new provision into the Income Tax Assessment Act 1997 denying DGR endorsement to any entity that has “advocated, prepared, planned, assisted in, financed, fostered, supported … or contributed to the establishment, maintenance or expansion of the illegal occupation”.

It would also empower the foreign affairs minister to formally declare what constitutes an “illegal occupation” for the purposes of the law.

Charities funding illegal settlements
This year, MWM released a series of investigations revealing that Australian charities are funnelling tax-deductible donations to projects linked to Israeli settlements in the occupied West Bank, which are illegal under international law, as well as to initiatives supporting IDF soldiers.

In the Senate debate on the amendment, Greens Senator Penny Allman-Payne cited the findings of the MWM investigations.

She highlighted figures showing that Jewish National Fund Australia had remitted more than $125 million to Israel since 2009, while the United Israel Appeal Refugee Relief Fund had transferred approximately $376 million since 2013 via Keren Hayesod, with a portion of these funds used for settlement expansion and IDF-linked programmes.

Allman-Payne also referenced the activities of the Chai Charitable Foundation, which earlier this year hosted fundraisers for organisations providing direct support to IDF soldiers and settlement communities, including in Tekoa and Hebron, before removing the campaigns following questioning by MWM.

“It is obviously of significant concern if there are charitable organisations in Australia that are funnelling funds to illegal occupiers and illegal settlements,” Allman-Payne told the Senate.

She noted that the Australian Charities and Not-for-profits Commission (ACNC) had received 896 complaints relating to 88 charities in connection with the Israel-Gaza conflict between October 2023 and December 2025.

“Given that these donations are tax-deductible . . .  that effectively means taxpayers are subsidising illegal occupation and militarisation,” she said.

Government rejects amendment
In response, Finance Minister Katy Gallagher stated that the government would not support the Greens amendment, arguing that existing regulatory frameworks already prohibit unlawful conduct by charities.

“There is no DGR category or purpose that allows charities to support illegal activities at home or abroad,” Gallagher said.

She pointed to the ACNC’s governance standards, which require charities to operate lawfully and remain accountable, as well as external conduct standards governing overseas activities.

However, Gallagher acknowledged a key limitation: those standards require compliance with Australian law, but

do not extend to conduct under international law.

Charities operating overseas must take “reasonable steps” to ensure proper governance and compliance with Australian legal obligations, including sanctions, anti-money laundering and counter-terrorism financing laws, she said.

Organisations found to be in breach risk losing their charitable registration, which can in turn lead to the loss of DGR status.

Referral for investigation
Gallagher suggested that concerns about specific organisations should be referred to the ACNC for investigation.

Faruqi said the government’s position amounted to wilful inaction.

“The Labor government clearly wants to keep its head in the sand and is looking the other way while this happens,” she said.

“This is just another example of the government’s complicity in the ethnic cleansing of Palestine.

“It is two-faced for the Government to say it supports a Palestinian state while effectively subsidising its destruction.”

Minister Gallagher and Andrew Leigh (Assistant Minister for Productivity, Competition, Charities and Treasury) were contacted for comment.

Regulatory obligations
A spokesperson from Leigh’s office provided the following response:

“The government expects all registered charities to meet their regulatory obligations and to obey all Australian laws. This is a condition of maintaining charitable status.

“The ACNC is the independent regulator of charities and complaints involving conduct that could harm people or involving the misuse of a charity for terrorism purposes or to foster extremism are a compliance priority for the ACNC.

“The ACNC already has powers to revoke the charitable status of charities involved in serious illegal activity.”

Amnesty International has condemned Israeli authorities over unleashing a series of unlawful measures deliberately designed to dispossess Palestinians in the occupied West Bank — including East Jerusalem — and to make the annexation of the territory an irreversible reality.

These decisions since December 2025 represent an unprecedented escalation – in scale and speed – in Israel’s project to expand illegal settlements.

They facilitate the takeover of more Palestinian land, authorise a record number of new settlements, expanding existing ones, and formalise registration of land in the West Bank as Israeli state property.

While successive Israeli governments have pursued policies aimed at expanding settlements and entrenching occupation and apartheid, the latest measures underscore how the current Israeli government has turbocharged these efforts, in the shadow of the genocide in Gaza.

“What we are witnessing is a state, led by a Prime Minister wanted by the International Criminal Court on charges of war crimes and crimes against humanity, openly gloating about its defiance of international law,” said Erika Guevara-Rosas, Amnesty International’s senior director for research, advocacy, policy and campaigns.

“Despite hundreds of UN resolutions, Advisory Opinions from the International Court of Justice and global condemnation, Israel continues to brazenly expand illegal settlements, entrenching its cruel system of apartheid and destroying Palestinian lives and livelihoods.

“The unconditional support of the USA government, combined with the pervasive lack of international accountability for Israel’s genocide against Palestinians in Gaza, decades of crimes under international law linked to its unlawful occupation and its system of apartheid, has further emboldened Israel to escalate its illegal actions.

“This includes formalising land grabs with full confidence that it will face no consequences.

“The accelerating expansion of unlawful settlements and the rise in state-backed settler violence and crimes across the occupied West Bank are a direct indictment of the international community’s catastrophic failure to take decisive action.”

On 10 December 2025, the Israel Land Authority published a tender for 3401 housing units in the E1 area, east of Jerusalem in the occupied West Bank.

The plan seeks to expand the illegal settlement of Ma’ale Adumim and create a continuum with occupied East Jerusalem.

This would sever the West Bank in two, permanently rupturing urban Palestinian contiguity between Ramallah, occupied East Jerusalem, and Bethlehem.

Forced transfer of Palestinians
Together with the construction of a bypass road which was set to begin this month, this plan will also lead to the forcible transfer of the Palestinian communities living in the area.

While since the 1990s successive Israeli governments have attempted to implement the E1 plan, it remained largely dormant for decades due to international pressure.

Its current advancement with such speed signifies a government that is brazenly pursuing its settlement expansion agenda amidst insufficient international pushback.

Since its occupation of Palestinian territory in 1967, Israel has introduced and developed an oppressive administrative and legal architecture of dispossession and control against Palestinians.

The current government has been relentlessly accelerating this project by fast-tracking settlement expansion and land seizures.

On 11 December 2025, Israel’s security cabinet approved plans to establish 19 new settlements, bringing the total number approved by the current coalition government to 68 in just three years and the total number of official settlements to about 210.

About 750,000 Israeli settlers currently live illegally in the West Bank, including East Jerusalem.

Retroactive ‘legalisation’
The new settlements include the retroactive “legalisation” of outposts built in violation of even Israel’s own domestic laws.

Credible media reports indicate at least three of these sites sit upon land from which Palestinian communities, such as Ein Samia and Ras Ein al-Ouja, were recently forcibly transferred following state-backed settler violence.

According to Peace Now, an Israeli organisation monitoring settlement expansion, in 2025 alone, a record 86 outposts were established, primarily “herding” or “farming” outposts” which have significantly contributed to the spike in state-backed settler violence and forcible transfer of Palestinian communities.

Protected by the Israeli military and funded by the Israeli Ministry of Agriculture, the outposts have turned the lives of Palestinian farmers and shepherds, particularly in Area C, into a “living hell”.

Settlers in the outposts aggressively prevent Palestinian shepherds from accessing their grazing land, depriving them of their main livelihood, as well as seizing land by force, vandalizing property, stealing livestock and attacking Palestinians and their homes.

According to the Israeli human rights organisation B’Tselem, 21 Palestinian communities were fully or partially uprooted in 2025 as a result of state-backed settler violence.

A mother of three from Ras Ein al-Ouja, near Jericho, told Amnesty International: “The fear of attacks forced us to put our children to bed with their shoes on, because we might have to flee at any moment.”

Freezing cold
In January 2026, she and her family were driven out in the freezing cold along with another 122 families — in total more than 600 Palestinians have been forcibly displaced from this community.

A declaration by the Israeli civil administration on 5 January 2026 designating 694 dunams of land belonging to the Palestinian towns of Deir Istiya, Bidya and Kafr Thulth in the northern West Bank as “state land”.

This was declared along with a series of measures to expand control over the West Bank announced by Israel’s security cabinet on February 8 to mark a further escalation in Israel’s land grabs.

These measures include repealing Jordanian legislation still in force to allow Israeli settlers to purchase Palestinian land without oversight increasing Israeli civil administrative control over planning and construction in Hebron City and Rachel’s Tomb in Bethlehem, as well as granting Israeli authorities new enforcement powers in archaeological sites and in issues related to water and environment in Areas A and B.

On 15 February 2026, the Israeli cabinet issued a decision that amounts to annexation under Israeli law.

It allocated more than 244 million NIS (Israeli shekels) for the establishment of a government mechanism to facilitate land registration in Area C, transferring the powers of land registration from the civil administration to Israel’s Ministry of Justice.

Currently, nearly 58 percent of the land in Area C of the occupied West Bank is unregistered, according to Peace Now.

Seized Palestinian land
Israel has already seized more than half of that area through state land designations.

Palestinians face almost insurmountable hurdles to prove land ownership due to Israel’s archaic interpretation of Ottoman land laws which require Palestinians to provide an array of documents, maps and other records that most Palestinians do not have access to.

“Land registration is yet another Israeli euphemism for land grabs and dispossession. Make no mistake: full annexation is the goal, and Israel has already laid much of the groundwork for achieving it,” Erika Guevara-Rosas said.

“Ministers in the current Israeli government no longer feel any need to conceal their intentions.

“Israel has totally disregarded its obligations as an Occupying Power towards Palestinian civilians and instead has deliberately and consistently advanced its aggressive annexation agenda, in blatant violation of international law, which categorically prohibits annexation and establishment of settlements in occupied territory.

“These measures are in brazen defiance of the International Court of Justice’s Advisory Opinions of 2004 and 2024, the latter of which unequivocally found Israel’s presence in the OPT to be unlawful.

“A subsequent UN General Assembly resolution set September 2025 as the deadline to end Israel’s unlawful occupation.

“Yet instead of complying, Israel has simply invented new ways to violate international law, further entrenching its unlawful occupation and apartheid — while the international community continues, at best, to pay lip service to Palestinians’ rights and taken no effective action.”

Yet that reputation doesn’t hold true when it comes to Gaza and the Palestinian desire and right to self-determination.

Under the Convention on the Prevention and Punishment of Genocide, states must take positive steps to prevent genocide. The New Zealand government appears to be failing in this obligation.

So far, our ministers have chosen carefully crafted diplomatic language buried under joint country statements to influence the situation in Gaza, while at the same time protecting relationships with allies, particularly the US.

An example of these was a statement issued last month, in which New Zealand joined a group of 28 “concerned” countries to express horror at the “suffering of civilians in Gaza”, which, it says, “has reached new depths”. The statement calls for the lifting of restrictions on the “flow of aid” and demands “an immediate, unconditional and permanent ceasefire.”

Just to be clear, the “flow of aid” is the life-saving food and water that’s needed to prevent the mass starvation of Palestinians as famine driven by Israel deepens.

Demands for a ceasefire have been made on numerous occasions in the UN General Assembly and the UN Security Council, to no effect.

Failure to sanction Israel
Yet countries like New Zealand fail to sanction Israel for its non-compliance. Indeed, they do worse. These same countries continue to trade with Israel, and a number of them continue to provide weapons and arms.

According to trade data, New Zealand in 2023 imported goods and services of US$191 million from Israel and exported US$16.4 million the other way.

Most recently, New Zealand joined 14 other countries to “express the willingness or the positive consideration of our countries to recognise the State of Palestine, as an essential step towards the two-State solution.”

The statement is heavily caveated by saying that “positive consideration” is one option — so it’s not clear if all, or indeed any, of the countries will end up recognising Palestinian statehood.

By contrast, UK Prime Minister Sir Keir Starmer has issued a separate statement, saying the UK would recognise the state of Palestine in September if Israel doesn’t agree to a ceasefire.

Starmer’s concern for the starvation of civilians in Gaza hasn’t stopped the UK from sending military arms to Israel. But this is at least a clearer stance than New Zealand has been able to muster.

More than 147 UN member states out of 193 formally recognise Palestinian statehood now.

Level of solidarity
And while recognition of statehood is largely symbolic, it does signal a level of solidarity with the Palestinian people. Inexplicably, New Zealand has been unwilling to take that step, while calling it a future option under “two-state” diplomacy.

New Zealand has trundled out its support of the two-state solution since at least 1993, reinforced by its co-sponsorship, in 2015-16, of a UN Security Council resolution condemning Israeli settlement expansion.

That resolution declared settlements in occupied territories illegal under international law and urged member states to distinguish in its dealings between Israel and the territories occupied since 1967.

Since then, Israel has continued to transfer its citizens to the West Bank and Gaza. More than 750,000 Israeli settlers are now living illegally in the West Bank and East Jerusalem — areas where a future Palestinian state would be located.

Meanwhile, New Zealand has failed to take any meaningful action — sanctions or suspension of trade, for example — to implement the requirements of the Security Council resolution. That the government consistently frames its response as supporting a two-state solution beggars belief in light of such inaction.

New Zealand’s refusal to sanction Israel is nothing but shameful.

When foreign affairs minister Winston Peters expressed shock about the “intolerable situation” in Gaza, RNZ asked him whether New Zealand would entertain placing sanctions on Israel. He responded by saying that we are a “long, long way off doing that.”

The genocide in Gaza is happening with the support of countries like New Zealand, through inaction and failure to implement sanctions.

And statements about recognising statehood provide the appearance of supporting an end to the genocide, but change nothing in reality.

For Basel and his community, this land isn’t merely territory — it’s identity, livelihood, their past and future.

No Other Land vividly captures the intensity of life in rural Palestinian villages and the everyday destruction perpetrated by both Israeli authorities and the nearby settler population: the repeated demolition of Palestinian homes and schools; destruction of water sources such as wells; uprooting of olive trees; and the constant threat of extreme violence.

While this 95-minute slice of Palestinian life opened the world’s eyes, most are unaware that No Other Land takes place in an area of the West Bank that is ground zero for any viable future Palestinian state.

Designated as “Area C” under the Oslo Peace Accords, it constitutes 60% of the occupied West Bank and is where the bulk of Israeli settlements and outposts are located. It is a beautiful and resource-rich area upon which a Palestinian state would need to rely for self-sufficiency.

For decades now, Israel has been using military rule as well as its planning regime to take over huge swathes of Area C, land that is Palestinian — lived and worked on for generations.

This has been achieved through Israel’s High Planning Council, an institution constituted solely of Israelis who oversee the use of the land through permits — a system that invariably benefits Israelis and subjugates Palestinians, so much so that Israel denies access to Palestinians of 99 percent of the land in Area C including their own agricultural lands and private property.

‘This is apartheid’
Michael Lynk, when he was serving as UN Special Rapporteur on the Situation of Human Rights in the Occupied Palestinian Territories, referred to Israel’s planning system as “de-development” and stated explicitly: “This is apartheid”.

The International Court of Justice recently affirmed what Palestinians have long known: Israel’s planning policies in the West Bank are not only discriminatory but form part of a broader annexation agenda — a violation of international humanitarian law.

To these ends, Israel deploys a variety of strategies: Israeli officials will deem certain areas as “state lands”, necessary for military use, or designate them as archaeologically significant, or will grant permission for the expansion of an existing settlement or the establishment of a new one.

Meanwhile, less than 1 percent of Palestinian permit applications were granted at the best of times, a percentage which has dropped to zero since October 2023.

As part of the annexation strategy, one of Israel’s goals with respect to Area C is demographic: to move Israelis in and drive Palestinians out — all in violation of international law which prohibits the forced relocation of occupied peoples and the transfer of the occupant’s population to occupied land.

Regardless, Israel is achieving its goal with impunity: between 2023 and 2025 more than 7,000 Palestinians have been forcibly displaced from their homes in Area C due to Israeli settler violence and access restrictions.

At least 16 Palestinian communities have been completely emptied, their residents scattered, and their ties to ancestral lands severed.

Israel’s settler colonialism on steroids
Under the cover of the international community’s focus on Gaza since October 2023, Israel has accelerated its land grab at an unprecedented pace.

The government has increased funding for settlements by nearly 150 percent; more than 25,000 new Israeli housing units in settlements have been advanced or approved; and Israel has been carving out new roads through Palestinian lands in the West Bank, severing Palestinians from each other, their lands and other vital resources.

Israeli authorities have also encouraged the establishment of new Israeli outposts in Area C, housing some of the most radical settlers who have been intensifying serious violence against Palestinians in the area, often with the support of Israeli soldiers.

None of this is accidental. In December 2022, Israel appointed Bezalel Smotrich, founder of a settler organisation and a settler himself, to oversee civilian affairs in the West Bank.

Since then, administrative changes have accelerated settlement expansion while tightening restrictions on Palestinians. New checkpoints and barriers throughout Area C have further isolated Palestinian communities, making daily life increasingly impossible.

Humanitarian organisations and the international community provide much-needed emergency assistance to help Palestinians maintain a foothold, but Palestinians are quickly losing ground.

As No Other Land hit screens in movie houses across the world, settlers were storming homes in Area C and since the Oscar win there has been a notable uptick in violence. Just this week reports emerged that co-director Hamdan Ballal was himself badly beaten by Israeli settlers and incarcerated overnight by the Israeli army.

Israel’s annexation of Area C is imminent. To retain it as Palestinian will require both the Palestinian Authority and the international community to shift the paradigm, assert that Area C is Palestinian and take more robust actions to breathe life into this legal fact.

The road map for doing so was laid by the International Court of Justice who found unequivocally that Israel’s occupation of the West Bank and Gaza is unlawful and must come to an end.

They specified that the international community has obligations in this regard: they must not directly or indirectly aid Israel in maintaining the occupation and they must cooperate to end it.

With respect to Area C, this includes tackling Israel’s settlement policy to cease, prevent and reverse settlement construction and expansion; preventing any further settler violence; and ending any engagement with Israel’s discriminatory High Planning Council, which must be dismantled.

With no time to waste, and despite all the other urgencies in Gaza and the West Bank, if there is to be a Palestinian state, Palestinians in Area C must be provided with full support – political, financial, and legal — by local authorities and the international community, to rebuild their lives and livelihoods.

After all, Area C is Palestine.

New Plymouth has admitted it has investments in companies active in illegal Israeli settlements on occupied Palestinian land, contrary to New Zealand government foreign policy and United Nations rulings.

The revelation comes a week after Mayor Neil Holdom refused a request from Parihaka Pā and all the district’s iwi to make sure the council was not invested in companies profiting from the settlements.

The shareholdings sparked a hostile debate with Holdom accusing councillor Bali Haque of politicising the district’s nest-egg for virtue signalling, and Haque in turn questioning the mayor’s honesty and integrity.

The investments were made from New Plymouth District Council’s $400 million Perpetual Investment Fund (PIF).

The money is managed by Mercer in a passive fund, which automatically follows an index of companies and chooses which shares to buy.

Eight companies invested in by Mercer have been named by the UN as enabling and profiting from the expansion of Israeli settlements in Palestinian Occupied Territories:

• Motorola Solutions — the security arm of the mobile phone maker.
• Travel companies Expedia, Airbnb, and Booking Holdings which owns Booking.com and other sites.
• French multinational railways manufacturer Alstom
• Three Israeli banks, including the country’s first and third biggest — which often offer concessionary loans to settlers.

Less than $1m involved
Less than a million dollars is involved, just a quarter of one percent of New Plymouth’s PIF.

Haque wanted Mercer to be told that NPDC strongly disagrees with investing in companies active in the settlements and wants the investments ended as soon as possible.

He also proposed that the council-owned company overseeing the fund — the PIF Guardians — bring more advice on the process and cost of divestment if Mercer did not act.

“We need to do something,” Haque said.

“It’s small, I understand less than a million we’re talking about, but it is significant in terms of the impact . . .  This is something we can actually do and control.”

Mayor Neil Holdom repeated his explanation to the Parihaka delegation for opposing any action.

“Given the deeply sensitive and complex nature of the Israeli-Palestine conflict we’ve gotta approach this with a great deal of care and it’s my view that supporting this could be seen as taking a position in a dispute that has profound emotional and personal significance for members of our community on both sides.”

‘A terrible conflict’
The Mayor then turned to Haque.

“It is clear councillor Haque cares deeply about this issue and wants this debate and in the desperation to signal his personal conviction now wants to start playing politics with the PIF.

“It’s a terrible conflict, it’s a disaster for everybody involved but now someone wants to drag our community’s $400 million investment fund into this and make it a political football, to make a political point.”

Haque, clearly shocked, said it was Holdom himself who had told him to bring the motion to the Council Controlled Organisations committee.

“I’m staggered that now you have now done an about face and turned the tables . . .  You were the very person who encouraged me to put this very motion to this committee and now you are attacking me personally for actually acting on the basis of what you asked me to do.

“So my respect — with respect — has declined in your honesty and integrity.”

Pearce barely kept control of the meeting.

Once tempers cooled, the Mayor explained that advice from the PIF Guardians was that the low-cost passive fund offered no control over Mercer’s decision and putting the funds in different management could cost up to $3.2 million a year in higher fees.

Holdom said he had told Haque of the advice.

Haque said that he had adjusted his proposal in response and read Holdom’s text message advising him to bring a proposal to instruct Mercer to comply with UN resolutions.

“We heard that it might be expensive but I’d quite like to know what it is we’re up for if Mercer decides not to act on the basis of what we’re saying,” said Haque.

Councillors Haque, Carson Matthews, and Bryan Vickery voted for Haque’s proposal.

They were defeated by Mayor Holdom and councillors Pearce, Murray Chong and Max Brough.

Councillor David Bublitz abstained, wanting the PIF to divest shares linked to any conflict anywhere in the world.

NZ co-sponsored Resolution 2334
New Zealand in 2016 co-sponsored UN Security Council Resolution 2334, declaring Israeli settlements in Palestine a violation of international law.

The resolution obliges states and entities “to withdraw all recognition, aid and assistance to Israel’s illegal presence in the occupied Palestine territory.”

In July this year, the International Court of Justice (ICJ) ruled that Israel’s settlements in Gaza and West Bank are illegal and ordered Israel to stop building new settlements and evacuate existing ones.

In September, the UN General Assembly — including Foreign Minister Winston Peters — called on all States to make sure their people, companies and entities and authorities “do not act in any way that would entail recognition or provide aid or assistance in maintaining the situation created by Israel’s illegal presence in the Occupied Palestinian Territory.”

Amnesty International’s research has found sufficient basis to conclude that Israel has committed and is continuing to commit genocide against Palestinians in the occupied Gaza Strip, the organisation has revealed in a landmark new investigative report.

The 294-page report documents how, during its military offensive launched in the wake of the deadly Hamas-led attacks in southern Israel on 7 October 2023, Israel has “unleashed hell and destruction on Palestinians in Gaza brazenly, continuously and with total impunity”.

An Amnesty International statement made along with releasing the investigation says that the Aotearoa New Zealand government “can and should take action”, for example:

• Publicly recognise that Israeli authorities are committing the crime of genocide and commit to strong and sustained international action;
• Ban imports from illegal settlements as well as investment in companies connected to maintaining the occupation; and
• Do everything possible to facilitate Palestinian people seeking refuge to come to Aotearoa New Zealand and receive support.

Lisa Woods, advocacy and movement building director at Amnesty International Aotearoa New Zealand, said: “This research and report demonstrate that Israel has carried out acts prohibited under the Genocide Convention, with the specific intent to destroy Palestinians in Gaza.

“It’s not enough to say ‘never again’. The New Zealand government has to publicly call this what it is — genocide.

“We’re asking the Prime Minister and Foreign Minister to show leadership. New Zealand has a responsibility to act.”

Ban illegal settlement products
Woods said that in addition to acknowledging that this was genocide, the New Zealand government must ban products from the illegal Israeli settlements in the Occupied Palestinian Territory — “and open the doors to Palestinians who are desperately seeking refuge.”

Agnès Callamard, secretary-general of Amnesty International, said about the new report:

“These acts include killings, causing serious bodily or mental harm and deliberately inflicting on Palestinians in Gaza conditions of life calculated to bring about their physical destruction.

“Month after month, Israel has treated Palestinians in Gaza as a subhuman group unworthy of human rights and dignity, demonstrating its intent to physically destroy them.

“Our damning findings must serve as a wake-up call to the international community: this is genocide. It must stop now.”

Callamard said that states that continued to transfer arms to Israel at this time must know they are “violating their obligation to prevent genocide and are at risk of becoming complicit in genocide”.

She said that all states with influence over Israel, particularly key arms suppliers like the US and Germany — but also other EU member states, the UK and others — must act now to bring Israel’s atrocities against Palestinians in Gaza to an immediate end.

Population facing starvation
Over the past two months the crisis has grown particularly acute in the North Gaza governorate, where a besieged population is facing starvation, displacement and annihilation amid relentless bombardment and suffocating restrictions on life-saving humanitarian aid, Callamard said.

“Our research reveals that, for months, Israel has persisted in committing genocidal acts, fully aware of the irreparable harm it was inflicting on Palestinians in Gaza,” she said.

“It continued to do so in defiance of countless warnings about the catastrophic humanitarian situation and of legally binding decisions from the International Court of Justice (ICJ) ordering Israel to take immediate measures to enable the provision of humanitarian assistance to civilians in Gaza.

“Israel has repeatedly argued that its actions in Gaza are lawful and can be justified by its military goal to eradicate Hamas. But genocidal intent can co-exist alongside military goals and does not need to be Israel’s sole intent.”

Amnesty International said in its statement that it had examined Israel’s acts in Gaza closely and in their totality, taking into account their recurrence and simultaneous occurrence, and both their immediate impact and their cumulative and mutually reinforcing consequences.

The organisation considered the scale and severity of the casualties and destruction over time. It also analysed public statements by officials, finding that prohibited acts were often announced or called for in the first place by high-level officials in charge of the war efforts.

“Taking into account  the pre-existing context of dispossession, apartheid and unlawful military occupation in which these acts have been committed, we could find only one reasonable conclusion: Israel’s intent is the physical destruction of Palestinians in Gaza, whether in parallel with, or as a means to achieve, its military goal of destroying Hamas,” Callamard said.

Atrocities ‘can never justify Israel’s genocide’
“The atrocity crimes committed on 7 October 2023 by Hamas and other armed groups against Israelis and victims of other nationalities, including deliberate mass killings and hostage-taking, can never justify Israel’s genocide against Palestinians in Gaza.”

According to the statement, international jurisprudence recognises that the perpetrator does not need to succeed in their attempts to destroy the protected group, either in whole or in part, for genocide to have been committed.

The commission of prohibited acts with the intent to destroy the group, as such, was sufficient.

The report examines in detail Israel’s violations in Gaza over nine months between 7 October 2023 and early July 2024.

Amnesty International interviewed 212 people, including Palestinian victims and witnesses, local authorities in Gaza, healthcare workers, conducted fieldwork and analysed an extensive range of visual and digital evidence, including satellite imagery.

It also analysed statements by senior Israeli government and military officials, and official Israeli bodies.

On multiple occasions, the organisation shared its findings with the Israeli authorities but had received no substantive response at the time of publication.

Unprecedented scale and magnitude
The organisation said Israel’s actions following Hamas’s deadly attacks on 7 October 2023 had brought Gaza’s population to the brink of collapse.

Its brutal military offensive had killed more than [44,000] Palestinians, including more than 13,300 children, and wounded or injured more than 97,000 others by 7 October 2024, many of them in direct or deliberately indiscriminate attacks, often wiping out entire multigenerational families.

Israel had caused unprecedented destruction, which experts say occurred at a level and speed not seen in any other conflict in the 21st century, levelling entire cities and destroying critical infrastructure, agricultural land and cultural and religious sites, Amnesty International said.

It thereby rendered large swathes of Gaza uninhabitable.
