Under new registration requirements introduced by Israel’s Ministry of Diaspora Affairs and Combating Antisemitism, NGOs have been required to submit lists of their Palestinian employees for review and to refrain from criticism of Israel.

A number of NGOs did not comply with the requirement to disclose the identities of their Palestinian staff, citing safety concerns amid reports that Israel has deliberately targeted and killed aid workers in Gaza.

As a result, the registrations of 37 international NGOs lapsed on 31 December 2025. The organisations will be required to withdraw by 1 March 2026 if their registrations are not renewed.

The aid ban comes as Israel has passed laws prohibiting the supply of water and electricity to UNRWA, the UN agency for Palestinian refugees.

Michael West Media wrote to the Minister for Foreign Affairs, Penny Wong, and Department of Foreign Affairs and Trade (DFAT) seeking clarification on Australia’s position regarding Israel’s suspension of humanitarian organisations operating in Gaza.

The questions included whether Australia intended to publicly condemn Israel’s decision to ban aid organisations; how the government assessed the move’s compatibility with international humanitarian law, including Israel’s obligations under the Geneva Conventions; and whether Australia would join or support diplomatic statements or measures alongside other countries calling for the ban to be lifted.

DFAT declined to provide a comment on the record, while Minister Wong did not respond to the request for comment.

In correspondence with MWM, DFAT instead provided a statement “for use in reporting, not for attribution”. In their response, the Department referred to a previous joint statement signed by Minister Wong calling on Israel to allow aid into Gaza.

International condemnation rises
The refusal to comment comes as the UN Secretary-General, multiple governments and at least 53 international NGOs have publicly condemned Israel’s suspension of 37 aid organisations from operating in Gaza and the occupied West Bank, warning it will severely restrict humanitarian access to Gaza and breach Israel’s obligations under international law.

The foreign ministers of Canada, Denmark, Finland, France, Iceland, Japan, Norway, Sweden, Switzerland and the United Kingdom issued a joint statement condemning  the aid ban, warning that

UN Secretary-General António Guterres has called on Israel to reverse the measures, warning it “will further exacerbate the humanitarian crisis facing Palestinians”.

On Monday, seven European countries denounced Israel’s policies as incompatible with humanitarian principles and obligations under international law.

In a joint letter, 53 international aid organisations called the ban “a deliberate policy choice with foreseeable consequences”.

“More than 500 humanitarian workers have been killed since 7 October 2023. INGOs cannot transfer sensitive personal data to a party to the conflict since this would breach humanitarian principles, duty of care and data protection obligations,” the letter stated.

NGOs in limbo
Médecins Sans Frontières (MSF), one of the largest medical providers operating in Gaza, said it remained in a state of uncertainty.

“Our registration expired as of the 31st of December,” said Ashley Killeen, director of engagement at Médecins Sans Frontières Australia and New Zealand. “We are still trying to have dialogue with Israeli authorities to try and maintain some type of access.”

“At this point in time, we are still continuing to try and negotiate and stay in Gaza. It’s a fragile moment.”

Killeen said claims that MSF had failed to comply with the new registration process were inaccurate.

“We’ve fully engaged in the process announced in July, we submitted the majority of the required information,” she said.

However, Killeen said MSF was unwilling to comply with the requirement to provide the identities of its Palestinian staff due to safety concerns. She stated that

Providing the names of our staff is an ethical red line that we’re not willing to cross.

“Fifteen of our colleagues have been killed since the start of this war by Israeli forces. We have an obligation to safeguard the rights of our staff, and that is why we’re not willing to provide the staff list of our Palestinian colleagues in Gaza.”

Delivering 1 in 3 babies
MSF has operated in Gaza since 1989 and supports six hospitals and two field hospitals.

“We deliver one in three babies in Gaza. I don’t know what their solution would be if MSF were not allowed to operate,” Killeen said.

“The entire health system is decimated. Banning the little aid and services that’s available for those people in there is horrific.”

“We’re not finished yet; there’s a lot more to do.”

ActionAid Australia has also warned that deregistration would severely undermine its ability to operate.

“Being de-registered will severely restrict our ability to bring food, medical supplies and other relief into Gaza, scale operations, and respond at the huge level of humanitarian need,” said Michelle Higelin, ActionAid Australia’s executive director.

“This action by the government of Israel undermines not just ActionAid,

but the entire humanitarian response architecture.

ActionAid has delivered humanitarian assistance and medical support to more than 650,000 displaced people over the past two years.

Impact ‘not abstract’
“The impact is not abstract — it is borne by families already surviving day to day,” Higelin said. “For people in Gaza, this decision will mean less water and food, little or no sanitation, reduced shelter and medical support and increasing exposure to health risks.”

Higelin warned that pregnant women would be particularly affected by the aid ban.

“As we support one of the only functioning maternity hospitals in Gaza, we are particularly concerned about the impacts on pregnant women who are already giving birth in unsterile conditions”

ActionAid reiterated MSF’s concerns regarding the disclosure of the identities of their Palestinian staff.

“We cannot comply with requirements that compel us to hand over sensitive personal data of Palestinian staff and their families or accept political and ideological conditions unrelated to humanitarian work,” Higelin said.

“No humanitarian organisation should be forced to choose between protecting its staff and continuing lifesaving assistance.”

Violation of international humanitarian law
Under international humanitarian law, occupying powers are obliged to ensure the provision of life saving aid to civilians in conflict zones. The 4th Geneva Convention and customary international law require that humanitarian assistance be allowed to reach civilians without undue obstruction.

The International Bar Association’s Human Rights Institute has warned that deliberate obstruction of humanitarian assistance, resulting in hunger and widespread suffering, constitutes a grave violation of international humanitarian law and may amount to war crimes.

Amnesty International Australia has characterised Israel’s broader blockade and systematic obstruction of aid as not only a violation of humanitarian law but as potentially amounting to crimes against humanity, citing provisions of the Geneva Conventions that require occupying powers to ensure the food and medical supplies of the population are met unconditionally. 

“It’s an obligation under international law to provide humanitarian aid. Israel has an obligation to allow aid into Gaza,” said Killeen.

Killeen said MSF was urging the Australian government to do more than reiterate general support for aid access.

International law?
“What we would hope for from our government is that they continue to uphold the principles of international humanitarian law, and in doing so, they would advocate for the rights of organisations like MSF to continue providing aid to people in Gaza,” she said.

Higelin said the moment demanded decisive action from the Australian government.

“This is a watershed moment: one that will make or break the future of civic space and humanitarian assistance in Palestine, which Israel has been occupying unlawfully for decades.

“We urge UN agencies and donor governments, including Australia, to use all available leverage to secure the reversal of this decision. Independent, principled humanitarian operations must be protected to ensure civilians can receive the assistance they urgently need.

“Lives depend upon it.”

Three New Zealanders, who were detained in Israel, after taking part in an international flotilla heading to Gaza, claim they were treated like animals.

Rana Hamida, Youssef Sammour and Samuel Leason arrived at Auckland International Airport this afternoon, and were greeted by a crowd of supporters and loved ones.

Among the supporters were Green Party co-leader Marama Davidson and MP Ricardo Menéndez March.

Members of the Global Sumud Flotilla, who were detained and deported from Israel last week, reported allegations of physical and psychological abuse by Israeli forces.

Israel’s foreign ministry said the claims were “complete lies”, and the detainees rights were upheld, but Hamida and Sammour claimed conditions were harsh.

“We were there for almost a week, more or less, and we were treated like crap, to be honest,” Sammour said. “We were treated like animals.”

Hamida said: “It was a violation of what humanitarian law is.”

Guards refused medicine
Sammour said one of their fellow prisoners was diabetic, but the guards refused to give him his insulin, but Hamida admitted the hardship they faced was just a fraction of that experienced by the occupants of Gaza.

The flotilla, a group of dozens of boats carrying 500 people — including Swedish climate campaigner Greta Thunberg — had been trying to break Israel’s blockade.

Leason’s father, Adi Leason, earlier told RNZ’s Midday Report he was “immensely proud” of his 18-year-old son.

“We’ve been going to mass every Sunday for 18 years with Samuel, and he must have been listening and taking something of that formation on board. It’s lovely to see a young man with a deep conscience caring so deeply about people who he will never meet and to put himself in harm’s way for them.”

Samuel Leason felt a mix of relief and anger upon returning to New Zealand. He said it was amazing to see his family again, but he felt frustrated that the New Zealand government did not do more to intervene.

The trio said they had not been discouraged and planned to mobilise more than ever.

More than 67,000 Palestinians — mostly women and children — have been killed since Israel launched its retaliation for Hamas’ 2023 attack, which killed about 1200 Israelis.

The first stage of a Gaza ceasefire came into force today.

The consequences of the Israeli genocide in Gaza will be dire. An event of this degree of barbarity, sustained by an international conspiracy of moral inertia and silence, will not be relegated to history as just another “conflict” or a mere tragedy.

The Gaza genocide is a catalyst for major events to come. Israel and its benefactors are acutely aware of this historical reality.

This is precisely why Israeli Prime Minister Benjamin Netanyahu is in a race against time, desperately trying to ensure his country remains relevant, if not standing, in the coming era. He pursues this through territorial expansion in Syria, relentless aggression against Lebanon, and, of course, the desire to annex all occupied Palestinian territories.

But history cannot be controlled with such precision. However clever he may think he is, Netanyahu has already lost the ability to influence the outcome.

He has been unable to set a clear agenda in Gaza, let alone achieve any strategic goals in a 365-square-kilometer expanse of destroyed concrete and ashes. Gazans have proven that collective sumud can defeat one of the most well-equipped modern armies.

Indeed, history itself has taught us that changes of great magnitude are inevitable. The true heartbreak is that this change is not happening fast enough to save a starving population, and the growing pro-Palestinian sentiment is not expanding at the rate needed to achieve a decisive political outcome.

Our confidence in this inevitable change is rooted in history. The First World War was not just a “Great War” but a cataclysmic event that fully shattered the geopolitical order of its time. Four empires were fundamentally reshuffled; some, like the Austro-Hungarian and Ottoman, were erased from existence.

The new world order resulting from the First World War was short-lived. The modern international system we have today is a direct outcome of the Second World War. This includes the United Nations and all the new Western-centric economic, legal, and political institutions that were forged by the Bretton Woods Agreement in 1944.

This includes the World Bank, the IMF, and ultimately NATO, thus sowing the seeds of yet more global conflicts.

The fall of the Berlin Wall was heralded as the singular, defining event that resolved the lingering conflicts of the post-WWII geopolitical struggle, supposedly ushering in a new, permanent global realignment, or, to some, the “end of history.”

History, however, had other plans. Not even the horrific September 11 attacks and the subsequent US-led wars could reinvent the global order in a way that was consistent with US-Western interests and priorities.

Gaza is infinitely small when judged by its geography, economic worth, or political import. Yet, it has proven to be the most significant global event defining this generation’s political consciousness.

The fact that the self-proclaimed guardians of the post-WWII order are the very entities that are violently and brazenly violating every international and humanitarian law is enough to fundamentally alter our relationship with the West’s championed “rule-based order.”

This may not seem significant now, but it will have profound, long-term consequences. It has largely compromised and, in fact, delegitimised the moral authority imposed, often by violence, by the West over the rest of the world for decades, especially in the Global South.

This self-imposed delegitimisation will also impact the very idea of democracy, which has been under siege in many countries, including Western democracies. This is only natural, considering that most of the planet feels strongly that Israel must end its genocide and that its leaders must be held accountable.

Yet, little to no action follows.

The shift in Western public opinion in favor of Palestinians is astounding when considered against the backdrop of total Western media dehumanisation of the Palestinian people and Western governments’ blind allegiance to Israel. More shocking is that this shift is largely the result of the work of ordinary people on social media, activists mobilizing in the streets, and independent journalists, mostly in Gaza, working under extreme duress and with minimal resources.

A central conclusion is the failure of Arab and Muslim nations to factor into this tragedy befalling their own brethren in Palestine. While some are engaged in empty rhetoric or self-flagellation, others subsist in a state of inertia, as if the genocide in Gaza were a foreign topic, like the wars in Ukraine or Congo.

This fact alone shall challenge our very collective self-definition — what it means to be an Arab or a Muslim, and whether such definitions carry supra-political identities. Time will tell.

The Left, too, is problematic in its own way. While not a monolith, and while many on the Left have championed the global protests against the genocide, others remain splintered and unable to form a unified front, even temporarily.

Some leftists are still chasing their own tails, crippled by the worry that being anti-Zionist would earn them the label of antisemitism. For this group, self-policing and self-censorship are preventing them from taking decisive action.

History does not take its cues from Israel or Western powers. Gaza will indeed result in the kind of global shifts that will affect us all, far beyond the Middle East.

For now, however, it is most urgent that we use our collective will and action to influence one single historical event: ending the genocide and the famine in Gaza.

The rest will be left to history, and to those who wish to be relevant when the world changes again.

New Zealand has joined 24 other countries in calling for an end to the war in Gaza, and criticising what they call the inhumane killing of Palestinians.

The countries — including Britain, France, Canada and Australia plus the European Union — also condemed the Israeli government’s aid delivery model in Gaza as “dangerous”.

“We condemn the drip feeding of aid and the inhumane killing of civilians, including children, seeking to meet their most basic needs of water and food.”

They said it was “horrifying” that more than 800 civilians had been killed while seeking aid, the majority at food distribution sites run by a US- and Israeli-backed foundation.

“We call on the Israeli government to immediately lift restrictions on the flow of aid and to urgently enable the UN and humanitarian NGOs to do their life saving work safely and effectively,” it said.

“Proposals to remove the Palestinian population into a ‘humanitarian city’ are completely unacceptable. Permanent forced displacement is a violation of international humanitarian law.”

The statement said the countries were “prepared to take further action” to support an immediate ceasefire.

Reuters reported Israel’s foreign ministry said the statement was “disconnected from reality” and it would send the wrong message to Hamas.

“The statement fails to focus the pressure on Hamas and fails to recognise Hamas’s role and responsibility for the situation,” the Israeli statement said.

Having NZ voice heard
Foreign Affairs Minister Winston Peters told RNZ Morning Report, New Zealand had chosen to be part of the statement as a way to have its voice heard on the “dire” humanitarian situation in Gaza.

“The tipping point was some time ago . . .  it’s gotten to the stage where we’ve just lost our patience . . . ”

Peters said he wanted to see what the response to the condemnation was.

“The conflict in the Middle East goes on and on . . .  It’s gone from a situation where it was excusable, due to the October 7 conflict, to inexcusable as innocent people are being swept into it,” he said.

“I do think there has to be change. It must happen now.”

The war in Gaza was triggered when Hamas-led militants attacked Israel on October 7, 2023, killing 1200 people and taking 251 hostages, according to Israeli tallies.

Israel’s subsequent air and ground war in Gaza has killed more than 59,000 Palestinians — including at least 17,400 children, according to the enclave’s Health Ministry, while displacing almost the entire population of more than 2 million and spreading a hunger crisis.

Protesting New Zealanders donned symbolic masks modelled on a Palestinian artist’s handiwork in Auckland’s Takutai Square today to condemn Israel’s starvation as war weapon against Gaza and the NZ prime minister’s weak response.

Coming a day after the tabling of Budget 2025 in Parliament, peaceful demonstrators wore hand-painted masks inspired by Gaza-based Palestinian artist Reem Arkan, who is fighting for her life alongside hundreds of thousands of the displaced Gazans.

The “bodies” represented more than 53,000 Palestinians killed by Israel’s brutal 19-month war on Gaza.

The protest coincided with Prime Minister Christopher Luxon addressing the Trans-Tasman Business Circle in Auckland.

The demonstrators said they chose this moment and location to “highlight the alarmingly tepid response” by the New Zealand government to what global human rights organisations — such as Amnesty International and Human Rights Watch — have branded as war crimes and acts of collective punishment amounting to genocide.

“This week, we heard yet another call for Israel to abide by international law. This is not leadership. It’s appeasement,” said a spokesperson, Olivia Coote.

“The time for statements has long passed. What we are witnessing in Gaza is a humanitarian catastrophe, and New Zealand must impose meaningful sanctions.

“Israel’s actions, including the deliberate targeting of civilian infrastructure, forced displacement, and obstruction of humanitarian aid, constitute grave breaches of the Geneva Conventions of which we are signatories.”

Green Party Co-Leader Chlöe Swarbrick challenged Prime Minister Luxon in Parliament over his government’s response earlier this week, saying: “We’ve had lots of words. We need action.”

Luxon claimed that sanctions were in place — but the only measure taken has been a travel ban on 12 extremist Israeli settlers from the West Bank.

“This is an action that does nothing to protect the more than two million Palestinians in Gaza who face daily bombardment, siege, and starvation,” Coote said.

The protesters are calling on the New Zealand government to act immediately by:

• Imposing sanctions on Israel; and
• Suspending all diplomatic and trade relations with Israel until there is an end to hostilities and full compliance with international humanitarian law.

“This government must not be complicit in atrocities through silence and inaction,” Coote said. “The people of Aotearoa New Zealand demand leadership as the world watches a genocide unfold in real time.”

As Israel unveils its final genocide push, and mass death from starvation looms in Gaza, Western media and politicians are tentatively starting to speak up

Who could have imagined 19 months ago that it would take more than a year and a half of Israel slaughtering and starving Gaza’s children for the first cracks to appear in what has been a rock-solid wall of support for Israel from Western establishments.

Finally, something looks like it may be about to give.

The British establishment’s financial daily, The Financial Times, was first to break ranks last week to condemn “the West’s shameful silence” in the face of Israel’s murderous assault on the tiny enclave.

In an editorial — effectively the paper’s voice– the FT accused the United States and Europe of being increasingly “complicit” as Israel made Gaza “uninhabitable”, an allusion to genocide, and noted that the goal was to “drive Palestinians from their land”, an allusion to ethnic cleansing.

Of course, both of these grave crimes by Israel have been evidently true not only since Hamas’ violent, single-day breakout from Gaza on 7 October 2023, but for decades.

So parlous is the state of Western reporting, from a media no less complicit than the governments berated by the FT, that we need to seize on any small signs of progress.

Next, The Economist chimed in, warning that Israeli Prime Minister Benjamin Netanyahu and his ministers were driven by a “dream of emptying Gaza and rebuilding Jewish settlements there”.

‘Deafening silence on Gaza’
At the weekend, The Independent decided the “deafening silence on Gaza” had to end. It was “time for the world to wake up to what is happening and to demand an end to the suffering of the Palestinians trapped in the enclave”.

Actually much of the world woke up many, many months ago. It has been the Western press corps and Western politicians slumbering through the past 19 months of genocide.

Then on Monday, the supposedly liberal Guardian voiced in its own editorial a fear that Israel is committing “genocide”, though it only dared do so by framing the accusation as a question.

It wrote of Israel: “Now it plans a Gaza without Palestinians. What is this, if not genocidal? When will the US and its allies act to stop the horror, if not now?”

The paper could more properly have asked a different question: Why have Israel’s Western allies — as well as media like The Guardian and FT — waited 19 months to speak up against the horror?

And, predictably bringing up the rear, was the BBC. On Wednesday, the BBC Radio’s PM programme chose to give top billing to testimony from Tom Fletcher, the United Nation’s humanitarian affairs chief, to the Security Council. Presenter Evan Davis said the BBC had decided to “do something a little unusual”.

Unusual indeed. It played Fletcher’s speech in full — all 12 and a half minutes of it. That included Fletcher’s comment: “For those killed and those whose voices are silenced: what more evidence do you need now? Will you act — decisively — to prevent genocide and to ensure respect for international humanitarian law?”

‘Genocide’ from taboo to mainstream
We had gone in less than a week from the word “genocide” being taboo in relation to Gaza to it becoming almost mainstream.

Cracks are evident in the British Parliament too. Mark Pritchard, a Conservative MP and life-long Israel supporter, stood up from the back benches to admit he had been wrong about Israel, and condemned it “for what it is doing to the Palestinian people”.

He was one of more than a dozen Tory MPs and peers in the House of Lords, all formerly staunch defenders of Israel, who urged British Prime Minister Keir Starmer to immediately recognise a Palestinian state.

Their move followed an open letter published by 36 members of the Board of Deputies, a 300-member body that claims to represent British Jews, dissenting from its continuing support for the slaughter. The letter warned: “Israel’s soul is being ripped out.”

Pritchard told fellow MPs it was time to “stand up for humanity, for us being on the right side of history, for having the moral courage to lead.”

Sadly, there is no sign of that yet. Research published last week, based on Israeli tax authority data, showed Starmer’s government has been lying even about the highly limited restrictions on arms sales to Israel it claimed to have imposed last year.

Despite an ostensible ban on shipments of weapons that could be used in Gaza, Britain has covertly exported more than 8500 separate munitions to Israel since the ban.

More weapons details
This week more details emerged. According to figures published by The National, the current government exported more weapons to Israel in the final three months of last year, after the ban came into effect, than the previous Conservative government did through the whole of 2020 to 2023.

So shameful is the UK’s support for Israel in the midst of what the International Court of Justice — the World Court — has described as a “plausible genocide” that Starmer’s government needs to pretend it is doing something, even as it actually continues to arm that genocide.

More than 40 MPs wrote to Foreign Secretary David Lammy last week calling for him to respond to allegations that he had misled the public and Parliament. “The public deserves to know the full scale of the UK’s complicity in crimes against humanity,” they wrote.

There are growing rumblings elsewhere. This week French President Emmanuel Macron called Israel’s complete blockade on aid into Gaza “shameful and unacceptable”. He added: “My job is to do everything I can to make it stop.”

“Everything” seemed to amount to nothing more than mooting possible economic sanctions.

Still, the rhetorical shift was striking. Italy’s Prime Minister, Giorgia Meloni, similarly denounced the blockade, calling it “unjustifiable”. She added: “I have always recalled the urgency of finding a way to end the hostilities and respect international law and international humanitarian law.”

“International law”? Where has that been for the past 19 months?

Similar change of priorities
There was a similar change of priorities across the Atlantic. Democratic Senator Chris van Hollen, for example, recently dared to call Israel’s actions in Gaza “ethnic cleansing”.

CNN’s Christiane Amanpour, a bellwether of the Beltway consensus, gave Israel’s deputy Foreign Minister, Sharren Haskel, an unusually tough grilling. Amanpour all but accused her of lying about Israel starving children.

Meanwhile, Josep Borrell, the recently departed head of European Union foreign policy, broke another taboo last week by directly accusing Israel of preparing a genocide in Gaza.

“Seldom have I heard the leader of a state so clearly outline a plan that fits the legal definition of genocide,” he said, adding: “We’re facing the largest ethnic cleansing operation since the end of the Second World War.”

Borrell, of course, has no influence over EU policy at this point.

This is all painfully slow progress, but it does suggest that a tipping point may be near.

If so, there are several reasons. One — the most evident in the mix — is US President Donald Trump.

It was easier for The Guardian, the FT and old-school Tory MPs to watch the extermination of Gaza’s Palestinians in silence when it was kindly Uncle Joe Biden and the US military industrial complex behind it.

Trump forgets ‘his bit’
Unlike his predecessor, Trump too often forgets the bit where he is supposed to put a gloss on Israeli crimes, or distance the US from them, even as Washington ships the weapons to carry out those crimes.

But also, there are plenty of indications that Trump — with his constant craving to be seen as the top dog — is increasingly annoyed at being publicly outfoxed by Netanyahu.

This week, as Trump headed to the Middle East, his administration secured the release of Israeli soldier Edan Alexander, the last living US citizen in captivity in Gaza, by bypassing Israel and negotiating directly with Hamas.

In his comments on the release, Trump insisted it was time to “put an end to this very brutal war” — a remark he had very obviously not coordinated with Netanyahu.

Notably, Israel is not on Trump’s Middle East schedule.

Right now seems a relatively safe moment to adopt a more critical stance towards Israel, as presumably the FT and Guardian appreciate.

Then there is the fact that Israel’s genocide is reaching its endpoint. No food, water or medicines have entered Gaza for more than two months. Everyone is malnourished. It is unclear, given Israel’s destruction of Gaza’s health system, how many have already died from hunger.

Skin-and-bones children
But the pictures of skin-and-bones children emerging from Gaza are uncomfortably reminiscent of 80-year-old images of skeletal Jewish children imprisoned in Nazi camps.

It is a reminder that Gaza — strictly blockaded by Israel for 16 years before Hamas’ 7 October 2023 breakout — has been transformed over the past 19 months from a concentration camp into a death camp.

Parts of the media and political class know mass death in Gaza cannot be obscured for much longer, not even after Israel has barred foreign journalists from the enclave and murdered most of the Palestinian journalists trying to record the genocide.

Cynical political and media actors are trying to get in their excuses before it is too late to show remorse.

And finally there is the fact that Israel has declared its readiness to take hands-on responsibility for the extermination in Gaza by, in its words, “capturing” the tiny territory.

The long-anticipated “day after” looks like it is about to arrive.

For 20 years, Israel and Western capitals have conspired in the lie that Gaza’s occupation ended in 2005, when Israel’s then prime minister, Ariel Sharon, pulled out a few thousand Jewish settlers and withdrew Israeli soldiers to a highly fortified perimeter encaging the enclave.

Always under Israeli occupation
In a ruling last year, the World Court gave this claim short shrift, emphasising that Gaza, as well as the Palestinian territories of the West Bank and East Jerusalem, had never stopped being under Israeli occupation, and that the occupation must end immediately.

The truth is that, even before the 2023 Hamas attacks, Israel had been besieging Gaza by land, sea and air for many, many years. Nothing — people or trade — went in or out without the Israeli military’s say-so.

Israeli officials instituted a secret policy of putting the population there on a strict “diet” – a war crime then as now — one that ensured most of Gaza’s young became progressively more malnourished.

Drones whined constantly overhead, as they do now, watching the population from the skies 24 hours a day and occasionally raining down death. Fishermen were shot and their boats sunk for trying to fish their own waters. Farmers’ crops were destroyed by herbicides sprayed from Israeli planes.

And when the mood took it, Israel sent in fighter jets to bomb the enclave or sent soldiers in on military operations, killing hundreds of civilians at a time.

When Palestinians in Gaza went out week after week to stage protests close to the perimeter fence of their concentration camp, Israeli snipers shot them, killing some 200 and crippling many thousands more.

Yet, despite all this, Israel and Western capitals insisted on the story that Hamas “ruled” Gaza, and that it alone was responsible for what went on there.

Fiction important to West
“That fiction was very important to the Western powers. It allowed Israel to evade accountability for the crimes against humanity committed in Gaza over the past two decades – and it allowed the West to avoid complicity charges for arming the criminals.

Instead, the political and media class perpetuated the myth that Israel was engaged in a “conflict” with Hamas — as well as intermittent “wars” in Gaza — even as Israel’s own military termed its operations to destroy whole neighbourhoods and kill their residents “mowing the lawn”.

Israel, of course, viewed Gaza as its lawn to mow. And that is precisely because it never stopped occupying the enclave.

Even today Western media outlets collude in the fiction that Gaza is free from Israeli occupation by casting the slaughter there — and the starvation of the population — as a “war”.

But the “day after” — signalled by Israel’s promised “capture” and “reoccupation” of Gaza — brings a conundrum for Israel and its Western sponsors.

Until now Israel’s every atrocity has been justified by Hamas’ violent breakout on 7 October 2023.

Israel and its supporters have insisted that Hamas must return the Israelis it took captive before there can be some undefined “peace”. At the same time, Israel has also maintained that Gaza must be destroyed at all costs to root out Hamas and eliminate it.

Goals never looked consistent
These two goals never looked consistent — not least because the more Palestinian civilians Israel killed “rooting out” Hamas, the more young men Hamas recruited seeking vengeance.

The constant stream of genocidal rhetoric from Israeli leaders made clear that they believed there were no civilians in Gaza — not “uninvolved” –– and that the enclave should be levelled and the population treated like “human animals”, punished with “no food, water or fuel”.

Finance Minister Bezalel Smotrich reiterated that approach last week, vowing that “Gaza will be entirely destroyed” and that its people would be ethnically cleansed — or, as he put it, forced to “leave in great numbers to third countries”.

Israeli officials have echoed him, threatening to “flatten” Gaza if the hostages are not released. But in truth, the captives held by Hamas are just a convenient pretext.

Smotrich was more honest in observing that the hostages’ release was “not the most important thing”. His view is apparently shared by the Israeli military, which has reportedly put that aim last in a list of six “war” objectives.

More important to the military are “operational control” of Gaza, “demilitarization of the territory” and “concentration and movement of the population”.

With Israel about to be indisputably, visibly in direct charge of Gaza again — with the cover stories stripped away of a “war”, of the need to eliminate of Hamas, of civilian casualties as “collateral damage” — Israel’s responsibility for the genocide will be incontestable too, as will the West’s active collusion.

Mossad agents’ letter
That was why more than 250 former officials with Mossad, Israel’s spy agency — including three of its former heads — signed a letter this week decrying Israel’s breaking of the ceasefire in early March and its return to “war”.

The letter called Israel’s official objectives “unattainable”.

Similarly, the Israeli media reports large numbers of Israel’s military reservists are no longer showing up when called for a return to duty in Gaza.

Israel’s western patrons must now grapple with Israel’s “plan” for the ruined territory. Its outline has been coming more sharply into focus in recent days.

In January Israel formally outlawed the United Nations refugee agency Unrwa that feeds and cares for the large proportion of the Palestinian population driven off their historic lands by Israel in earlier phases of its decades-long colonisation of historic Palestine.

Gaza is packed with such refugees – the outcome of Israel’s biggest ethnic cleansing programme in 1948, at its creation as a “Jewish state”.

Removing Unrwa had been a long-held ambition, a move by Israel designed to help rid it of the yoke of aid agencies that have been caring for Palestinians – and thereby helping them to resist Israel’s efforts at ethnic cleansing – as well as monitoring Israel’s adherence, or rather lack of it, to international law.

Private contractor scheme
For the ethnic cleansing and genocide programmes in Gaza to be completed, Israel has needed to produce an alternative system to Unrwa’s.

Last week, it approved a scheme in which it intends to use private contractors, not the UN, to deliver small quantities of food and water to Palestinians. Israel will allow in 60 trucks a day — barely a tenth of the absolute minimum required, according to the UN.

There are several catches. To stand any hope of qualifying for this very limited aid, Palestinians will need to collect it from military distribution points located in a small area at the southern tip of the Gaza strip.

In other words, some two million Palestinians will have to crowd into a location that has no chance of accommodating them all, and even then will have only a tenth of the aid they need.

They will have to relocate too without any guarantee from Israel that it won’t continue bombing the “humanitarian zones” they have been herded into.

These military distribution zones just so happen to be right next to Gaza’s sole, short border with Egypt — exactly where Israel has been seeking to drive the Palestinians over the past 19 months in the hope of forcing Egypt to open the border so the people of Gaza can be ethnically cleansed into Sinai.

Under Israel’s scheme, Palestinians will be screened in these military hubs using biometric data before they stand any hope of receiving minimum calorie-controlled handouts of food.

Once inside the hubs, they can be arrested and shipped off to one of Israel’s torture camps.

Torture and abuse rife
Just last week Israel’s Haaretz newspaper published testimony from an Israeli soldier turned whistleblower — confirming accounts from doctors and other guards — that torture and abuse are rife against Palestinians, including civilians, at Sde Teiman, the most notorious of the camps.

Last Friday, shortly after Israel announced its “aid” plan, it fired a missile into an Unrwa centre in Jabaliya camp, destroying its food distribution centre and warehouse.

Then on Saturday, Israel bombed tents used for preparing food in Khan Younis and Gaza City. It has been targeting charity kitchens and bakeries to close them down, in an echo of its campaign of destruction against Gaza’s hospitals and health system.

In recent days, a third of UN-supported community kitchens — the population’s last life line — have closed because their stores of food are depleted, as is their access to fuel.

According to the UN agency OCHA, that number is rising “by the day”, leading to “widespread” hunger.

Facing ‘catastrophic hunger’
The UN reported this week that nearly half a million people in Gaza — a fifth of the population — faced “catastrophic hunger”.

Predictably, Israel and its ghoulish apologists are making light of this sea of immense suffering. Jonathan Turner, chief executive of UK Lawyers for Israel, argued that critics were unfairly condemning Israel for starving Gaza’s population, and ignoring the health benefits of reducing “obesity” among Palestinians.

In a joint statement last week, 15 UN agencies and more than 200 charities and humanitarian groups denounced Israel’s “aid” plan. The UN children’s fund Unicef warned that Israel was forcing Palestinians to choose between “displacement and death”.

But worse, Israel is setting up its stall once again to turn reality on its head.

Those Palestinians who refuse to cooperate with its “aid” plan will be blamed for their own starvation. And international agencies who refuse to go along with Israeli criminality will be smeared both as “antisemitic” and as responsible for the mounting toll of starvation on Gaza’s population.

There is a way to stop these crimes degenerating further. But it will require Western politicians and journalists to find far more courage than they have dared muster so far. It will need more than rhetorical flourishes. It will need more than public handwringing.

Are they capable of more? Don’t hold your breath.

The Palestine Solidarity Network Aotearoa (PSNA) has launched an open letter calling on the Aotearoa New Zealand government to take action on the future of the besieged enclave of Gaza.

The network is asking Foreign Minister Winston Peters to speak up for the people of New Zealand to at least condemn Israel’s use of humanitarian aid as a weapon of war.

It also wants the government to call for international humanitarian and human rights law to be applied.

The PSNA says New Zealand has an internationally respected voice, and “we are asking the government to use this voice” for a lasting peace.

The letter says:

Kia ora Mr Peters,

The situation in Occupied Gaza has reached another crisis point.

Last Sunday [March 2], Israel announced it was ending its January ceasefire agreement with Palestinian groups resisting the occupation and was once more imposing a total ban on humanitarian aid entering Gaza.

Israel says this is because it wants to extend the first phase of the ceasefire agreement rather than negotiate phase two which would see the agreed withdrawal of Israeli troops from Gaza. The renewed blockade on food, water, fuel and medical supplies has been widely condemned as a breach of the ceasefire agreement and the use of “starvation as a weapon of war” by Palestinian groups, international aid organisations and many governments.

The United Nations Secretary General António Guterres has called for “humanitarian aid to flow back into Gaza immediately”. Israel has refused this request.

Compounding the crisis is US President Donald Trump’s recently declared intention to permanently remove all the Palestinian people of Gaza and send them to other countries such as Egypt and Jordan so Gaza can be rebuilt as a US territory in the Middle East — in his words “the riviera of the Middle East”.

Israel has accepted this US proposal but Palestinians and the vast majority of governments and civil society groups around the world are appalled at the scheme.

To this point our government has not commented on either Israel’s new blockade of humanitarian supplies into Gaza or the US President’s plan for ethnic cleansing of the Palestinian territory.

Back in December 2023, when the government was commenting, the Prime Minister stated “…Israel must respect international humanitarian law. Civilians and civilian infrastructure must be protected…Safe and unimpeded humanitarian access must be increased and sustained.”

None of this has happened in the more than 14 months since.

We are asking our government to speak out once more on behalf of the people of New Zealand to, at the very least, condemn Israel’s use of humanitarian aid as a weapon of war and to call for international humanitarian and human rights law to be applied.

We believe the way forward for peace and security for everyone who calls the Middle East home is for all parties to follow international law and United Nations resolutions so that a lasting peace can be established based on justice and equal rights for everyone in the region.

New Zealand has an internationally respected voice which can make a strong contribution to this end. We are asking the government to use this voice.

Labour supports sanctions against Israel
Meanwhile, the opposition Labour Party said it would support Green Party co-leader Chloe Swarbrick’s member’s bill calling for sanctions against Israel for its illegal occupation of the Palestinian Territories.

“The International Court of Justice (ICJ) declared the decades-long occupation illegal and called for Israel’s withdrawal, and for countries like New Zealand to take action,” Labour associate foreign affairs spokesperson Phil Twyford said in a statement.

“The New Zealand government recently voted at the UN General Assembly for a resolution calling for sanctions against Israel on this issue.

“Labour has been calling for stronger action from the government on Israel’s invasion of Gaza, including intervening in South Africa’s case against Israel in the International Court of Justice, creation of a special visa for family members of New Zealanders fleeing Gaza, and ending government procurement from companies operating illegally in the Occupied Territories.”

Twyford said New Zealand had long recognised Israel’s occupation of the West Bank, Gaza and East Jerusalem as illegal.

In 2016, the then National government co-sponsored a successful Security Council resolution that Israel’s settlements in the Occupied Territories were illegal.

New Zealand has taken another shameful act in its tone deaf approach to Israel’s War on Gaza this week by declaring Hamas a “terrorist entity” at a time when millions are marching worldwide for an immediate ceasefire and a lasting peace founded on an independent state of Palestine.

It would have been more realistic and just to condemn Israel for its genocidal war and five months of atrocities.

Instead, it has been corralled into the Five Eyes clique with an increasingly isolated United States as it continues to support the war with taxpayer funded armaments and providing the cloak of diplomacy.

It was really unwise of Prime Minister Christopher Luxon’s coalition government to declare the Hamas political wing as terrorist, after already having declared the military wing terrorist in 2010.

Many argue around the world with increasing insistence that actually Israel is a rogue terrorist state.

Also, it is very unlikely that Benjamin Netanyahu will succeed in his aims of “destroying” the Hamas movement, whatever the final outcome of the war.

As John Minto points out, Palestinian resistance movements have the right under international law to take up arms to fight against their colonial occupiers just as the African National Congress (ANC) had the right to take up arms to fight for freedom in apartheid South Africa.

Hamas represents an ideal, an independent Palestinian state and that can never be defeated.

Factions meet for unity
The various factions of the Palestinian resistance and political movements, including Fatah and Hamas, have been meeting in Moscow this week to settle their differences and stitch together a framework for a “Palestinian government of unity” as a basis for the future political architecture of independence.

The United Nations General Assembly in 1969 — two years after the 1967 Six Day War when Israel seized Gaza from Egypt and Occupied West Bank from Jordan — recognised and reaffirmed “the inalienable rights of the Palestinian people to self-determination”.

This includes the right to choose their own representatives, including Hamas, a nationalist independence movement defending their illegally occupied territory, not a “terrorist” movement that the US and Israel try to have the world believe.

They are still very likely to be in the post-war line-up ending the status quo after five decades of illegal military occupation of Palestinian lands and the rash of illegal Israeli settlements.

American economist and public policy analyst Professor Jeffrey Sachs summed up the reality over Israel’s colonial settler project in an interview this week by describing the Netanyahu government as a “murderous gang” and “zealots”, warning that “they are not going to stop”.

“Israel has deliberately starved the people of Gaza. Starved. I am not using an exaggeration.

“I’m talking literally starving a population,” said the director of the Centre for Sustainable Development at New York’s Columbia University.

‘Israel is criminal’
“Israel is a criminal. Israel is in non-stop war crime status. Now, I believe, it is in genocidal status, and it is without shame, without remorse, without truth, without insight into what it is doing.

“But what it is doing is endangering Israel’s fundamental security because it is driving the world to believe that the Israeli state is not legitimate.

“This will stop when the United States stops providing the munitions to Israel. It will not be by any self-control in Israel. There is none in this government.

“This is a murderous gang in government right now. These are zealots. They have some messianic vision of controlling all of today’s Palestinian lands. They are not going to stop.

“They believe in ethnic cleansing, or worse, depending on whatever is needed. And it is, again, the United States, which is the sole support. And it our mumbling, bumbling president and the others that are not stopping this slaughter.”

In addition, to the growing massive protests around the world against the Israeli extremism, a growing number of countries and organisations, inspired by two International Court of Justice cases against Israel — one by South Africa alleging genocide by Israel and the other by the UNGA seeking a ruling on the legality of Israel’s military occupation of Palestine — have introduced lawsuits.

A Dutch court last month ordered the government to block all exports of F-35 fighter jet parts to Israel following concern that the country may be violating international laws such as the Genocide Convention.

Follow-up lawsuit
South Africa is preparing a follow-up lawsuit against the US and the UK for “complicity” in Israel’s war crimes in Gaza. South African lawyer lawyer Wikus Van Rensburg said: “The United States must now be held accountable for the crimes it committed.”

Nicaragua is suing Germany at the ICJ for funding Israel – its export of weapons and munitions to the country has risen ten-fold since the Hamas deadly attack on Israel last October 7 — and cutting aid to the UN Palestinian refugee agency (UNRWA), the major humanitarian agency in Gaza.

It has called for emergency measures that would force Germany to cease military aid to Israel, and restart funding to the UNRWA.

Nicaragua lawyers said in their lawsuit that the action was necessary because of Germany’s “participation in the ongoing plausible genocide and serious breaches of international humanitarian law” in Gaza.

Instead of joining the US-led coalition in the Red Sea operation against the Houthis, who are targeting US, UK and Israeli-linked ships to disrupt maritime trade in support of the Palestinians, New Zealand would have been more constructive by joining the South African case against Israel in The Hague.

Principle before profit if New Zealand is really committed to international rules based diplomacy.

Nicaragua lawyers said in their lawsuit that the action was necessary because of Germany’s “participation in the ongoing plausible genocide and serious breaches of international humanitarian law” in Gaza.

No time to be ‘neutral’
This is no time to be “neutral” over the War on Gaza, there are fundamental issues of global justice and human rights at stake. As various global aid officials have been saying, every day that passes without a ceasefire and a step towards an independent Palestine as a long-term solution means more children dying of starvation or from the bombing.

The death toll is already a staggering more than 30,000 — mostly women and children. The war is clearly directed at the people of Gaza, collective punishment.

Australian columnist Caitlin Johnstone warns against neutrality, advice that might have been heeded by New Zealand’s foreign affairs advisers.

“At least be real with yourself that by refusing to pick a position you are licking the boot of a nuclear-armed ethnostate that is backed by the most powerful empire the world has ever seen.”

And that impunity needs to end.

The initial contribution would include $2.5 million to the International Committee of the Red Cross (ICRC) and a further $2.5 million to the World Food Programme (WFP) under the umbrella of the United Nations appeal.

The Defence Force also remains on standby to help with evacuations of New Zealanders from the area, if required.

In a statement, caretaker Prime Minister Chris Hipkins said he was “deeply saddened” by the deaths and conflict in Israel and the occupied Palestinian territories.

“The situation continues to evolve rapidly, and New Zealand is joining other likeminded countries to support those civilians and communities affected by the conflict.

“The ICRC protects and assists victims of armed conflicts under international humanitarian law, and is working to gain access to people held hostage, distributing cash and other assistance to displaced people, and providing essential medical assistance and supplies.”

With the Erez and Kerem Shalom crossings shut, the Rafah border was the only way into and out of the Gaza Strip for people and also for humanitarian aid. But that had shut in October too.

Safe passage
Western countries are also getting involved to try to secure safe passage through Rafah for both foreign passport holders in Gaza and humanitarian aid, and there have been conflicting reports about whether it would open temporarily or not.

The WFP aid would help address food insecurity concerns in Gaza and the West Bank, and ensure emergency stock was prepared once access was guaranteed, Hipkins said.

“New Zealand calls for rapid and unimpeded humanitarian access to enable the delivery of crucial life-saving assistance.

“We call on all parties to respect international humanitarian law, and uphold their obligations to protect civilians, and humanitarian workers, including medical personnel.”

Both the ICRC and WFP act with full independence and neutrality.

With the Labour-led government being in the caretaker position and trying to transition to the National Party after the general elections, the decision for aid had been made after consultation with National leader Christopher Luxon, Hipkins’ statement read.

Luxon said he was appreciative of the communication between the outgoing government and the incoming one.

“It’s important that the government owns those decisions, we are consulted, and when we’re consulted we can give our support.”

NZDF on standby
On Monday, the Ministry of Foreign Affairs and Trade said most New Zealanders who were registered as being in Israel had already left, but 50 Kiwis were still there, and 20 were registered as being in the occupied Palestinian territories (Gaza and the West Bank).

But the government has asked for the New Zealand Defence Force to remain on standby in case it is needed to help with evacuations.

“While not everyone wanting to leave can necessarily get themselves to a departure point, the government has requested NZDF to remain on standby to deploy if necessary,” Hipkins said.

“Commercial routes remain the best option to depart the region, and MFAT is actively providing consular assistance to New Zealanders who remain in the affected region,” he said.

“Anyone who wishes to depart should take the earliest commercial opportunity to do so.”

New Zealand was also working with its partners on evacuation points for people who could not access commercial routes, but Hipkins acknowledged “the security situation on the ground make this difficult”.

Hamas has responded to Israel’s escalating violence with an unprecedented attack. This is not a new tragedy; it is an extension of the same old cycle.

We grieve all the losses of this calamity, and we call on our government not to speak the same old words but to finally act.

To call today’s act “unprovoked” is wilful blindness. Choose your timeframe; choose your provocation.

Israel is carrying out the longest, now-illegal, now-apartheid occupation in modern history. Gaza has been illegally blockaded for 17 years, confining more than two million mostly civilian human beings in deteriorating conditions, subjecting them to repeated bombardments and ceaseless deprivation.

More than 200 Palestinians have been killed in 2023 so far, including four the other day. The latest of Israel’s settler-state pogroms in the West Bank took place in Huwara one day before Hamas’s action.

Hamas’s attack is a response to longterm and escalating, immediate violence.

The blockade wall that was breached is an illegal structure. A million children have been born behind that wall; did you expect them to sit quietly?

Wall deserves to fall
That wall deserves to fall — but we, here in Aotearoa and throughout the world, should have brought it down with diplomatic and economic and legal sanctions long before it came to this.

Now Hamas’s violent resistance has broken through the wall.

Palestinians have a legal right to armed resistance, but no one has a right to unlimited violence. There is no honour in attacking civilians in their homes or bombing Gazan apartment buildings.

It is a core principle of international humanitarian law that the violations of one armed group do not release another armed group from its constant obligation to uphold the rights of civilians. Armed groups are responsible to the law, to the idea of minimising the harm done in this world.

We who demand the protection of Palestinian civilians can best do that by calling for the protection of all civilians: human rights are either everyone’s rights or they are nothing.

If we lose sight of that, the world becomes even more dangerous — and Palestinians have always borne the brunt of that danger.

No military solution
There is no military solution. Solutions call for political will here, outside Israel/Palestine.

The rage and despair accumulated through generations and decades of brutality will not reset. Do not call for the return to the status quo ante because it was intolerable, unjust and illegal.

We, here in Aotearoa New Zealand, need to act on the basis of law and the equal rights of human beings to protection, to justice, to self-determination.

We call on our government to initiate, to pick up the phone and lead in mustering international action.

An International Criminal Court official in the Pacific is calling on all parties in the Afghanistan conflict to respect humanitarian law.

Thousands of foreign nationals, including Afghanis who worked for international agencies, are fleeing the conflict as Taliban forces seized control of the country.

Suicide bombers struck the crowded gates of Kabul airport with at least two explosions on Thursday, causing a bloodbath among civilians, shutting down the Western airlift of Afghans desperate to flee the Taliban regime.

The death toll from the attack is at least 175, including 13 US soldiers, according to media reports.

The attacks came amid ongoing chaos around the airport amid the American withdrawal after 20 years in the region.

Fijian lawyer Ana Tuiketei-Bolabiu has reiterated the Hague Court’s call for all parties to the hostilities to fully respect their obligations under international humanitarian law, including by ensuring the protection of civilians.

She said the ICC may exercise jurisdiction over any genocide, crime against humanity or war crime committed in Afghanistan since the country joined the court in 2003.

First woman counsel
Tuiketei-Bolabiu became the first woman counsel appointed to the Hague Court in April last year. In September, she was elected to the Defence and Membership Committee of the ICC’s Bar Association.

She told RNZ Pacific she is concerned about reports of revenge killings and persecution of women and girls in Afghanistan.

“It’s just an evolving and deteriorating situation in Afghanistan,” she said.

“The UN Security met in New York to discuss the situation in Afghanistan and what was interesting to hear from the Afghani UN ambassador Ghulam Isaczai confirming his concerns on human rights violations for girls, women and human rights defenders, and journalists, including the internally displaced people.

“He also elaborated on the fear of the Kabul residents from the house-to-house search carried out by the Taliban, registering of names and the hunt for people.

“The UN meeting also discussed safety, security, dignity and peace but also trying to protect the lives and the movement of women and children, the international community, displaced people and even the food and all the other humanitarian care that is supposed to be given to the people there.

“We’re hoping that the international human rights laws will actually be observed.”

UN chief Antonio Guterres has also called for an end to the fighting in Afghanistan.

Challenges for prosecutor
Tuiketei-Bolabiu said challenges lay ahead for the Hague Court’s new prosecutor, Karim Khan, who replaced Fatou Bensouda in June this year.

Khan inherits the long-running investigation by his predecessor into possible crimes committed in Afghanistan since 2003.

Those included alleged killings of civilians by the Taliban, as well as the alleged torture of prisoners by Afghan authorities, and by American forces and the CIA in 2003-2004.

Tuiketei-Bolabiu said the ICC only approved a formal investigation in March 2020, which prompted then US President Donald Trump to impose sanctions on Bensouda.

“In May, Afghanistan pleaded with Bensouda for a deferral of the ICC prosecution investigation, arguing that the government was already conducting its own inquiries, mostly focusing on alleged Taliban crimes,” she said.

“Under ICC rules, the court only has power to prosecute crimes committed on the territory of member states when they are unwilling or unable to do so themselves.”

It is not yet clear how the ICC will proceed with the current investigation.

Interests of justice
But Tuiketei-Bolabiu is adamant justice will prevail.

“In March last year, the ICC appeals chamber judges found that in the interest of justice investigations should proceed by the prosecution on war crimes since 2003 including armed conflicts and other serious crimes that fall within the jurisdiction of the courts and that includes the Taliban, Afghan national police, other security forces and the CIA,” she said.

“What’s interesting now is the ICC does not have a police force so it solely relies on member states for arrests and investigations. Now the political landscape in Afghanistan has extremely changed.

“The cooperation with the ICC prosecutions office to support the court’s independence will become a bigger challenge in the future.”

UN Human Rights Council meets
The UN Human Rights Council held a special session this week to address the serious human rights concerns and the situatiation in Afghanistan.

The meeting was called by the council’s Afghanistan and Pakistan members.

Discussions were centred on the appointment of a committee to investigate crimes against humanity.

Tuiketei-Bolabiu said any evidence from the human rights council would help the court’s investigations.

But Amnesty International said the UN council has failed the people of Afghanistan.

In a statement, Amnesty said the meeting neglected to establish an independent mechanism to monitor ongoing crimes under international law and human rights violations and abuses in Afghanistan.

“Such a mechanism would allow for monitoring and reporting on human rights violations and abuses, including grave crimes under international law, and to assist in holding those suspected of criminal responsibility to justice in fair trials.”

However, the calls were ignored by UNHRC member states, who adopted by consensus a weak resolution which merely requests further reports and an update by the UN High Commissioner for Human Rights in March 2022, which adds little to the oversight process already in place.

“The UN Human Rights Council special session has failed to deliver a credible response to the escalating human rights crisis in Afghanistan. Member states have ignored clear and consistent calls by civil society and UN actors for a robust monitoring mechanism,” said Agnès Callamard, Amnesty International’s secretary-general.

“Many people in Afghanistan are already at grave risk of reprisal attacks. The international community must not betray them, and must urgently increase efforts to ensure the safe evacuation of those wishing to leave,” she said.

Amnesty International said member states must now move beyond handwringing, and take meaningful action to protect those feeling the conflict in Afghanistan.

The multi-billion-dollar NZ Super Fund  – New Zealand’s state pension fund – has finally divested from five of Israel’s biggest banks due to their funding of illegal settlement construction in the Occupied Palestinian Territories.

New Zealand Green Party MP Golriz Ghahraman said the party welcomed the decision, telling The Spinoff:

“Our nation’s values and legal obligations have been long in breach by investments facilitating what the United Nations has consistently called an illegal occupation, causing the suffering of the Palestinian people, and leading to a number of other breaches of humanitarian law.”

A Palestine Solidarity Network Aotearoa (PSNA) statement last week said that Palestinian supporters in Aotearoa-New Zealand had frequently complained about these banks to the NZ Super Fund, especially following a 2018 report by Human Rights Watch which identified their active participation in settlement building in breach of international law.

In 2012, the NZ Super Fund ended its investment with three Israeli companies on ethical grounds. These were companies that were directly building illegal settlements on Palestinian land.

Palestine Solidarity Network Aotearoa spokesperson Janfrie Wakim said that the NZ Super Fund had, at last, conducted a thorough investigation and reached a firm conclusion that it would be unethical to continue to invest in these banks.

“There is a wealth of reliable information and law that makes any continuing NZ Super Fund investment with these banks untenable. No New Zealand institution should provide any support to the ongoing dispossession of the Palestinian people in their homeland and the brutal Israeli occupation,” she said.

“The fund still has investments in other Israeli companies, and the fund says it will be paying close attention to any future reports from the United Nations High Commissioner for Human Rights about the culpability of other Israeli companies in illegal settlement construction.”

NZ government ‘lagging behind’
Janfrie Wakim also said that the NZ Super Fund divestment decision – and the evidence it had used – had shown up what she called a “dreadful lagging behind” by the New Zealand government.

“The NZ Super Fund divested in weapons manufacturer Elbit Systems in its first round of Israeli disinvestment in 2012,” Wakim said.

“Yet, the New Zealand government has admitted to buying military equipment, ground tested on Palestinians, from Elbit Systems, which is the very same company which the NZ Super Fund dropped from its portfolio in 2012.”
