The issue of Australians — and New Zealanders as well — serving in the Israeli military has sparked growing debate as the genocidal war crimes in Gaza mount.

Most of those involved are believed to be dual Israeli-Australian citizens, and under current Australian law, it is not automatically illegal to join a recognised foreign army, reports OnePath.

However, critics say the lack of transparency, including unclear numbers, roles, and oversight, is troubling, especially while international courts are examining serious allegations linked to the conflict.

Proceedings at the International Court of Justice (ICJ), where Israel is on trial for  genocide in a case brought by South Africa, and International Criminal Court (ICC) warrants for Israeli Prime Minister Benjamin Netanyhu and other officials have intensified questions about Australia’s responsibility to monitor its citizens abroad.

According to an Al Jazeera report, more than 50,000 Western nationals — most of them holding US or European Union passports — have joined the Israeli military in its genocidal war that has killed more than 72,000 Palestinians.

The largest number is from the United States — 12,350 dual nationality US-Israel citizens and 1207 multiple nationalities — followed by 6127 French dual national citizens and 337 multiple nationalities, according to data obtained by the Israeli NGO Hatzlacha through Israel’s Freedom of Information Law.

Australia is well down the list with 502 dual nationality soldiers and 119 multiple nationality citizens. New Zealand is 56th with 39 and 11.

Accountability major concern
A major concern being raised is accountability: if any Australians serving in Gaza were involved in alleged war crimes, would they actually be investigated?

Legal experts say Australia has “universal jurisdiction” laws, meaning citizens can theoretically be prosecuted for serious crimes committed overseas, but so far, there has been little public evidence of active investigations.

Critics argue this creates a perception of double standards.

The debate ultimately centres on whether Australia is willing to apply the same scrutiny to its own nationals in foreign conflicts, ensuring that military service abroad does not place individuals beyond the reach of the law.

Similar questions apply to New Zealand.

It’s not too late for Anthony Albanese to withdraw the invitation to the Israeli President, Isaac Herzog. It should be withdrawn for three reasons.

The first is institutional: The President of Israel is a constitutional role that is head of state but not part of the political or military chain of command. The office is similar to that of Australia’s Governor-General, though with somewhat more power.

As head of state, the president embodies and represents the state of Israel.

The International Court of Justice (ICJ) has found that Israel unlawfully occupies the Palestinian territories, has unlawfully purported to annex parts of the Palestinian territories and unlawfully plants, encourages and maintains unlawful settlements in Palestinian territories. The court is also trying a case in which Israel is accused of genocide.

The International Criminal Court has issued arrest warrants against the Israeli Prime Minister and former Defence Minister, citing allegations of war crimes and crimes against humanity. The same court is investigating other senior Israeli military and political leaders on similar charges.

The UN Commission of Inquiry on the occupied Palestinian territory has found evidence of war crimes, crimes against humanity and genocidal intent by Israeli leaders and recommended their prosecution. Israel is a rogue state whose head of state, its supreme representative, should not be permitted to visit Australia.

The second reason is about Herzog himself: The Commission of Inquiry has found that Herzog has incited genocide. Herzog made the statement that all Palestinians, “an entire nation”, are responsible for the Hamas attack on 7 October 2023.

The commission found that, because as president he is not part of the political or military chain of command, he was not responsible for war crimes or crimes against humanity. But the crime of incitement to genocide stands outside the chain of command. It can be committed by any individual. The commission recommended that he be investigated and prosecuted by the International Criminal Court.

Herzog denies this and has qualified his statement, saying “there are many, many innocent Palestinians who don’t agree” with the actions of Hamas. But the UN commission said it viewed that as an effort “to deflect responsibility for the initial statement”.

He has been a vocal head of state and his words have been taken and repeated by Israeli soldiers. Someone who incites genocide does not satisfy the good character test for entering Australia. On the contrary, a person who incites genocide should be arrested on arrival and tried under Australian law and international law for the crime.

Traditionally, a head of state has a special immunity when visiting another country. However, there is now strong legal argument that this immunity does not apply in relation to atrocity crimes, namely war crimes, crimes against humanity and genocide. Australia should not apply immunity in relation to these crimes.

Israel’s Foreign Ministry has previously rejected the commission’s report as “distorted and false”, and Herzog has said his comments have been taken out of context, noting he also said Israeli soldiers would follow international law.

The third reason for withdrawing the invitation relates to us, Australia, and our current situation: The Hanukah massacre on 14 December 2025 has shaken us all. It was an atrocity. Immediately political leaders across the spectrum expressed concerns for “social cohesion”. They said steps were needed to restore social cohesion and called for national unity at a time of crisis.

Eventually a royal commission was appointed for this purpose. And yet it’s hard to imagine a single event at this point in time more likely to harden national division and undermine social cohesion than a visit by the Israeli president. It could be the most divisive state visit to Australia since that of US president Lyndon B Johnson in October 1966 when the Vietnam war was at its height and Australian soldiers were being killed.

What was the Prime Minister thinking when he invited Herzog? In the days after the massacre, he no doubt thought inviting Herzog was a good way to express support for the traumatised Jewish community.

But Herzog is a political leader, not a religious leader. He is divisive in Israel and his visit could be divisive in Australia. If the Prime Minister wanted to support the Jewish community, he would have done better to invite a respected Jewish religious leader.

For reasons of law, ethics and social cohesion, this divisive political visit should be stopped.

The prime minister is widely acclaimed for his willingness to recognise mistakes and change course before it’s too late. He should recognise that he made a terrible mistake, in the emotional, traumatic days after the massacre, in inviting Herzog to visit.

It’s not too late to correct the mistake.

The report came as 70 Palestinians were killed across the Gaza Strip — mostly at aid sites belonging to the widely condemned Gaza Humanitarian Foundation (GHF) — in the last 24 hours.

Soldiers said that instead of using crowd control measures, they shot at crowds of civilians to prevent them from approaching certain areas.

One soldier, who was not named in the report, described the distribution site as a “killing field,” adding that “where I was, between one and five people were killed every day”.

The soldier said that they targeted the crowds as if they were “an attacking force,” instead of using other non-lethal weapons to organise and disperse crowds.

“We communicate with them through fire,” he continued, noting that heavy machine guns, grenade launchers and mortars were used on people, including the elderly, women and children.

The increased attacks, particularly those targeting aid-seekers, come as Gaza’s government Media Office said at least 549 Palestinians had been killed by Israeli forces while trying to get their hands on emergency aid in the last four weeks.

‘Evil of moral army’
Al Jazeera’s senior political analyst Marwan Bishara described what was happening in Gaza was more than the genocode.

“It is the evil of the most moral army in the world,” he said.

Israeli forces continued their attacks across the Gaza Strip on Friday, killing at least three Palestinians in an attack on Khan Younis, in the south, while also heavily bombing residential buildings east of Jabalia in the north.

Medical sources also said a Palestinian fisherman was killed, and others wounded, by Israeli naval gunfire off the al-Shati refugee camp, while he was working.

Gaza’s Ministry of Interior responded to the attacks with a statement, accusing Israel of “seeking to spread chaos and destabilise the Gaza Strip”.

Malnutrition soars
Gazans have continued to desperately seek aid provided by the US and Israel-backed Gaza Humanitarian Foundation, despite the hundreds of people killed at its sites, as malnutrition soars in the territory.

Two infants have died this week due to malnutrition and the ongoing blockade on Gaza.

For weeks now, health officials in the enclave have raised the alarm over the critical shortage of baby formula, but aid continued to be obstructed.

The two infants were buried on Thursday evening, after they were pronounced dead at the Nasser Hospital in Khan Younis. Medical staff said the cause of death was a lack of basic nutrition and access to essential medical care.

One of the infants, identified as Nidal, was only five months old, while the other, Kinda, was only 10 days old.

Mohammed al-Hams, Kinda’s father, told local media that children are dying due to severe malnutrition, sarcastically labelling them “the achievements of Netanyahu and his war”.

“Not a second goes by without a funeral prayer being held in the Gaza Strip,” he continued.

Malnutrition ‘catastrophic’
On Wednesday, Gaza’s Ministry of Health said the humanitarian situation in Gaza had reached “catastrophic” levels, noting that there had been a sharp increase in malnutrition among children, particularly in infants.

According to Palestinian official figures, at least 242 people have died in Gaza due to food and medicine shortages, with the majority of them being elderly and children.

Israel’s war on Gaza has killed at least 61,700 Palestinians since October 2023. The war has levelled entire neighbourhoods, and has been called a genocide by leading rights groups, including Amnesty International.

In Auckland last night, visiting Palestinian journalist, author, academic and community advocate Dr Yousef Aljamal spoke about “The unheard voices of Palestinian child prisoners”.

Dr Aljamal, who edited If I Must Die, a compilation of poetry and prose by Refaat Alareer, the poet who was assassinated by the Israelis in 6 December 2023, also described the humanitarian crisis as a “catastrophe” and called for urgent sanctions and political pressure on Israel by governments, including New Zealand.

Aotearoa New Zealand’s Te Pāti Māori has condemned the Israeli navy’s armed interception of the Madleen, a civilian aid vessel attempting to carry food, medical supplies, and international activists to Gaza, including Sweden’s climate activist Greta Thunberg.

In a statement after the Madleen’s communications were cut, the indigenous political party said it was not known if the crew were safe and unharmed.

However, Israel has begun deportations of the activists and has confiscated the yacht and its aid supplies for Gaza.

“This is the latest act in a horrific string of violence against civilians trying to access meagre aid,” said Te Pāti Māori co-leader Debbie Ngarewa-Packer.

“Since May 27, more than 130 civilians have murdered been while lining up for food at aid sites.

“This is not an arrest [of the Madleen crew], it as an abduction. We have grave concerns for the safety of the crew.

“Israel [has] proven time again they aren’t above committing violence against civilians.

“Blocking baby formula and prosthetics while a people are deliberately starved is not border patrol, it is genocide.”

Te Pāti Māori said it called on the New Zealand government to:

• Demand safe release of all crew;
• Demand safe passage of Aid to Gaza;
• Name this blockade and starvation campaign for what it is — genocide; and
• Sanction Israel for their crimes against humanity

Contact has been lost with the Gaza Freedom Flotilla humanitarian aid boat Madleen after Israeli commandos intercepted it in international waters.

The commandos demanded that everyone on board turn off their phones, and the boat lost contact with Al Jazeera Mubasher journalist Omar Faiad as well as its live feed, reports the AJ live tracker.

International Solidarity Movement co-founder Huwaida Arraf confirmed that they had also lost contact with the Madleen.

Arraf, whose ISM is supporting the Gaza Freedom Flotilla, later said from Sicily: “Just moments ago, communication seemed to be cut.”

“So, we have lost all contact with our colleagues on the Madleen.”

“Before that, we know that they had two drones hovering above them that dropped some kind of chemical on the vessel. We don’t know what that chemical was,” she said.

“Some people reported that their eyes were burning. Before that, they were also approached by vessels in a very threatening manner.”

So at least for the last hour the Madleen crew had been threatened by Israeli forces.

“The last we saw, were able to hear from them, they were surrounded . . . by Israeli naval commandos and it looked like the commandos were about to take over the vessel.”

The Freedom Flotilla earlier posted a message on social media saying “Red Alert: The Madleen is currently under assault in international waters.” It also said: “Israel navy ‘here right now, please sound the alarm’.”

A video posted by Palestinian journalist Motaz Azaiza showed Brazilian activist Thiago Avila on board the Madleen wearing a life jacket.

“The IOF [Israel Occupation Forces] is here right now, please sound the alarm. We are being surrounded by their boats,” he said in the video.

“Yes this is an interception, a war crime is happening right now,” he said.

The calls by the Israel Institute of New Zealand for Peter Davis to resign from the Helen Clark Foundation because of comments he made with regard to an ugly, hateful piece of graffiti are absurd.

The graffiti in question said “I hated Jews before it was cool!” On social media, Davis made this comment :

“Netanyahu govt actions have isolated Israel from global south and the west, and have stoked anti-Semitism. Yitzak Rabin was the last leader to effectively foster a political-diplomatic solution to the Israel-Palestine impasse. He was assassinated by a settler. You reap what you sow.”

IMO, this sounds like an expression of sorrow and regret about the conflict, and about the evils it is feeding and fostering. Regardless, the institute has described that comment by Davis as antisemitic.

“‘You cannot claim to champion social cohesion while minimising or rationalising antisemitic hate,’ the institute said. ‘Social trust depends on moral consistency, especially from those in leadership. Peter Davis’s actions erode that trust.’”

For the record, Davis wasn’t rationalising or minimising antisemitic hate. His comments look far more like a legitimate observation that the longer the need for a political-diplomatic solution is violently resisted, the worse things will be for everyone — including Jewish citizens, via the stoking of antisemitism.

The basic point at issue here is that criticisms of the actions of the Israeli government do not equate to a racist hostility to the Jewish people. (Similarly, the criticisms of Donald Trump’s actions cannot be minimised or rationalised as due to anti-Americanism.)

Appalled by Netanyahu actions
Many Jewish people in fact, also feel appalled by the actions of the Netanyahu government, which repeatedly violate international law.

In the light of the extreme acts of violence being inflicted daily by the IDF on the people of Gaza, the upsurge in hateful graffiti by neo-Nazi opportunists while still being vile, is hardly surprising.

Around the world, the security of innocent Israeli citizens is being recklessly endangered by the ultra-violent actions of their own government.

If you want to protect your citizens from an existing fire, it’s best not to toss gasoline on the flames.

To repeat: the vast majority of the current criticisms of the Israeli state have nothing whatsoever to do with antisemitism. At a time when Israel is killing scores of innocent Palestinians on a nightly basis with systematic air strikes and the shelling of civilian neighbourhoods, when it is weaponising access to humanitarian aid as an apparent tool of ethnic cleansing, when it is executing medical staff and assassinating journalists, when it is killing thousands of children and starving the survivors . . . antisemitism is not the reason why most people oppose these evils. Common humanity demands it.

Ironically, the press release by the NZ Israel Institute concludes with these words: “There must be zero tolerance for hate in any form.” Too bad the institute seems to have such a limited capacity for self-reflection.

Footnote One: For the best part of 80 years, the world has felt sympathy to Jews in recognition of the Holocaust. The genocide now being committed in Gaza by the Netanyahu government cannot help but reduce public support for Israel.

It also cannot help but erode the status of the Holocaust as a unique expression of human evil.

One would have hoped the NZ Israel Institute might acknowledge the self-defeating nature of the Netanyahu government policies — if only because, on a daily basis, the state of Israel is abetting its enemies, and alienating its friends.

Footnote Two: As yet, the so-called Free Speech Union has not come out to support the free speech rights of Peter Davis, and to rebuke the NZ Israel Institute for trying to muzzle them.

Colour me not surprised.

The fate of Palestinian Dr Hussam Abu Safiya, director of Kamal Adwan Hospital in northern Gaza, who was “arrested” by Israeli forces last month after defiantly staying with his patients when his hospital was being attacked, featured strongly at yesterday’s medical professionals solidarity rally in Auckland.

The Israeli government bears full responsibility for the life of Dr Abu Safiya’s life amid alarming indications of torture and ill-treatment since his detention.

Euro-Med Human Rights Monitor has received information that Dr Abu Safiya’s health has deteriorated due to the torture he endured during his detention, particularly while being held at the Sde Teyman military base in southern Israel.

Euro-Med Monitor warns of the grave risk to his life, following patterns of deliberate killings and deaths under torture previously suffered by other doctors and medical staff arrested from Gaza since October 2023.

Euro-Med Monitor has documented testimonies confirming that Israeli soldiers physically assaulted Dr Abu Safiya immediately after he left the hospital on Friday, 27 December 2024. He was then directly targeted with sound bombs while attempting to evacuate the hospital in compliance with orders from the Israeli army.

According to testimonies gathered by Euro-Med Monitor, the Israeli army subsequently transferred Dr Abu Safiya to a field interrogation site in the Al-Fakhura area of Jabalia Refugee Camp.

There, he was forced to strip off his clothes and was subjected to severe beatings, including being whipped with a thick wire commonly used for street electrical wiring. Soldiers deliberately humiliated him in front of other detainees, including fellow medical staff.

Transferred to Sde Teyman military camp
He was later taken to an undisclosed location before being transferred to the Sde Teyman military camp under Israeli army control.

Euro-Med Human Rights Monitor has also received information from recently released detainees at the Sde Teyman military camp, confirming that Dr Abu Safiya was subjected to severe torture, leading to a significant deterioration in his health.

This occurred despite him already being wounded by Israeli air strikes on the hospital, where he worked tirelessly until the facility was stormed and set ablaze by Israeli forces.

The Israeli army has attempted to mislead the public regarding Dr Abu Safiya’s detention and torture.

Pro-Israeli media outlets circulated a misleading promotional video portraying his treatment as humane, even though he was tortured and humiliated immediately after filming.

Euro-Med Monitor warns of the severe implications of Israel’s denial of Dr Abu Safiya’s detention, describing this as a deeply troubling indicator of his fate and detention conditions. This denial also reflects a blatant disregard for binding legal standards.

Physicians for Human Rights — Israel (PHRI) submitted a request on behalf of Dr Abu Safiya’s family to obtain information and facilitate a lawyer’s visit on 2 January 2024. However, the Israeli authorities claimed to have no record of his detention, stating they had no indication of his arrest.

Deep concern over execution risk
Euro-Med Monitor expresses deep concern that Dr Abu Safiya may face execution during his detention, similar to the fate of Dr Adnan Al-Bursh, head of the orthopaedics department at Al-Shifa Hospital in Gaza City, who was killed under torture at Ofer Detention Centre on 19 April 2024.

Dr Al-Bursh had been detained along with colleagues from Al-Awda Hospital in December 2023.

Likewise, Dr Iyad Al-Rantisi, head of the obstetrics department at Kamal Adwan Hospital, was killed due to torture at an Israeli Shin Bet interrogation centre in Ashkelon, one week after his detention in November 2023. Israeli authorities concealed his death for more than seven months.

Dozens of doctors and medical staff remain subjected to arbitrary detention and enforced disappearance in Israeli prisons and detention centres, where they face severe torture and solitary confinement, according to testimonies from former detainees.

The detention of Dr Abu Safiya must be understood within the context of Israel’s ongoing genocide in Gaza, which has persisted for nearly 15 months. His arrest, torture, and potential execution form part of a broader strategy aimed at destroying the Palestinian people in Gaza — both physically and psychologically — and breaking their will.

This strategy includes not only the deliberate destruction of the health sector and the disruption of medical staff operations, particularly in northern Gaza, but also an attack on the symbolic and humanitarian role represented by Dr Abu Safiya.

Despite the grave crimes committed against Kamal Adwan Hospital, its staff, and patients, especially in the past two months, Dr Abu Safiya remained unwavering in his dedication to providing essential medical care and fulfilling his medical duties.

Call on states, UN to take immediate steps
Euro-Med Human Rights Monitor calls on all concerned states, international entities, and UN bodies to take immediate and effective measures to secure the unconditional release of Dr Abu Safiya. His fundamental rights to life, physical safety, and dignity must be protected, shielding him from torture or any cruel, inhuman, or degrading treatment.

Euro-Med Monitor also urges international and local human rights organisations to be granted full access to visit Dr Abu Safiya, monitor his health condition, provide necessary medical treatment, and ensure he is free from human rights violations until his release.

Furthermore, Euro-Med Monitor reiterates its call for the United Nations to deploy an international investigative mission to examine the grave crimes and violations faced by Palestinian detainees in Israeli prisons.

It calls for the immediate release of those detained arbitrarily, for international and local organisations to be granted visitation rights, and for detainees to have access to legal representation.

Euro-Med Monitor expresses regret over the continued inaction of Alice Jill Edwards, the Special Rapporteur on Torture, who has failed to address these atrocities. It condemns her bias and deliberate negligence in fulfilling her mandate and calls for her dismissal.

A new Special Rapporteur who is neutral and committed to universal human rights principles must be appointed.

Additionally, Euro-Med Monitor urges the Special Rapporteur on Extrajudicial, Summary, or Arbitrary Executions, the Working Group on Arbitrary Detention, and the Working Group on Enforced or Involuntary Disappearances to conduct immediate and thorough investigations into crimes committed by the Israeli military in Gaza.

Call for prosecution of Israeli crimes
It calls for direct engagement with victims and families, as well as for reports to be submitted to pave the way for investigative committees, fact-finding missions, and international courts to prosecute Israeli crimes, hold perpetrators accountable, and compensate victims in line with international law.

Euro-Med Human Rights Monitor renews its call for relevant states and entities to fulfil their legal obligations to halt the genocide in Gaza.

This includes imposing a comprehensive arms embargo on Israel, holding it accountable for its crimes, and taking effective measures to protect Palestinian civilians. Immediate steps must also be taken to prevent forced displacement, ensure the return of residents, release arbitrarily detained Palestinians, and facilitate the urgent entry of life-saving humanitarian aid into Gaza without obstacles.

Finally, Euro-Med Monitor demands the withdrawal of Israeli occupation forces from the entire Gaza Strip.

A broad coalition of civil society organisations in Aotearoa New Zealand have signed an open letter to Foreign Affairs Minister Winston Peters urging the coalition government to refuse to accept the credentials of a new Israeli ambassador while the state continues to disregard international law and to commit war crimes.

The term of Israel’s ambassador to New Zealand, Ran Yaakoby, has ended as the Israeli military continues its more than 14-month genocide in Gaza, the International Criminal Court (ICC) has issued arrest warrants for Israel’s Prime Minister Benjamin Netanyahu and former Defence Minister Yoav Gallant for crimes against humanity and war crimes, and the International Court of Justice (ICJ) has declared Israel’s occupation of Palestine illegal.

About 40 civil society organisations and prominent individuals at institutions have signed the open letter.

The ICJ has made it clear that all states parties — including New Zealand — have obligations not to recognise, and not to render aid or assistance in maintaining the situation created by measures that are illegal under international law.

The international community has failed to hold Israel to account for its actions.

Kate Stone from Justice for Palestine, one of the signatory organisations, said in a statement: “As we say in the letter, while ambassadors usually provide an important avenue for dialogue, it is clear that the Israeli regime is not prepared to respond to the concerns of the New Zealand government, or the international community more broadly, and intends to continue to disregard international law.

“This is about demonstrating that there are consequences for Israel’s actions in breach of international law, and at the expense of Palestinian human rights.”

Just this week, the Israeli government announced its decision to close its embassy in Dublin, citing Ireland’s decision to join the ICJ case considering whether Israel is committing genocide in Gaza.

Clearly, Israel is not prepared to maintain diplomatic relations with states that seek to uphold international law.

Those who have signed the letter are urging the New Zealand government to not maintain diplomatic relations with Israel until it is prepared to comply with international law.

“New Zealand should stand with those seeking to uphold international law and human rights, not with those seeking to avoid accountability for their actions which have resulted in the deaths of over 40,000 Palestinians.” said Kate Stone.

We are aware that the term of the current Israeli ambassador is coming to an end. We, the undersigned organisations, urge you, on behalf of the New Zealand government, to refuse to accept the credentials of a replacement ambassador while Israel continues to disregard international law.

The Israeli regime is currently committing a genocide in Gaza and the International Criminal Court has issued warrants for the arrest of Prime Minister Benjamin Netanyahu and former Defence Minister Yoav Gallant for crimes against humanity and war crimes. The International Court of Justice’s advisory opinion from July 2024 declared Israel’s occupation of Palestine illegal and identified numerous international law obligations that Israel is violating, manifesting in systematic breaches of Palestinians’ fundamental human rights.

The current Israeli regime, and any representative of that regime, is flagrantly flouting international law and has ignored all calls for it to cease its illegal activities in Gaza and the wider Occupied Palestinian Territories. It is quite clear that Israel intends to continue expanding its illegal settlements in the West Bank and East Jerusalem, and to re-settle Gaza — changing the facts on the ground to such an extent that a two-state solution, or any just solution, becomes an impossibility.

The ICJ makes it clear that all states parties — including New Zealand – have obligations not to recognize, and not to render aid or assistance in maintaining the situation created by measures that are illegal under international law. The failure of the international community to hold Israel to account for its actions is undermining the integrity of the rules-based international order that New Zealand relies upon.

While ordinarily a diplomatic mission provides an avenue for dialogue, it is clear that the Israeli regime is not prepared to respond to the concerns of the New Zealand government.

Therefore, we urge you to announce that New Zealand will not maintain diplomatic relations with Israel until it demonstrates that it is prepared to comply with its international obligations. Please do not accept diplomatic credentials from a regime carrying out war crimes.

Amnesty International officials at a rally in Auckland today doubled down on their global report this week accusing Israel of genocide and called on Aotearoa New Zealand to take more action over the atrocities in the besieged enclave of Gaza.

The global human rights movement’s 296-page fully documented report says Israel has “unleashed hell and destruction on Palestinians in Gaza brazenly, continuously and with total impunity”.

The allegations have enraged the Tel Aviv government and stirred the unaffiliated Israeli chapter of Amnesty International to distance itself from the “genocide” allegation while admitting “serious crimes are being committed in Gaza, that must be investigated”.

Speaking at the weekly rally in Te Komititanga Square in the heart of Auckland today, Amnesty International Aotearoa’s people power manager Margaret Taylor said the report was “irrefutable”.

“Israel has committed and is — this very minute — committing genocide against Palestinians in the occupied Gaza Strip,” she said and was supported with loud shouts of “shame, shame!”

Al Jazeera reports that 50 people were killed in the latest Israeli attacks on central Gaza’s Nuseirat refugee camp — in which the death toll included six children and five women — and the Indonesian Hospital in northern Gaza’s Beit Lahiya district.

The report examines in detail Israel’s violations in Gaza over nine months between 7 October 2023 and early July 2024.

‘Firsthand accounts, satellite photography’
“Amnesty International interviewed hundreds of people with firsthand accounts. We analysed photos and video footage of the devastation, the remains of weaponry, corroborated with satellite photography, and we reviewed a huge range of data sets, repirts and statements by UN agencies, humanitarian organisations, human rights groups, and senior Israeli government officials and military leaders,” said Taylor.

“As I said before, this is irrefutable.”

Noting that the “atrocity crimes” against Israelis by Hamas on 7 October 2023, which triggered the current war — although brutal repression against the Palestinians has been extensively reported since the Nakba in 1948 — “do not justify genocide”.

The publication of the report has been welcomed around the world by many humanitarian and human rights groups but condemned by Israel and criticised by its main backer, the United States.

In a statement, the Israeli Foreign Minister claimed: “The deplorable and fanatical organisation Amnesty International has produced a fabricated report that is entirely false and based on lies.”

Last month, the international Criminal Court (ICC) issued arrest warrants for Israel Prime Minister Benjamin Netanyahu and former Foreign Minister Yoav Gallant for alleged war crimes and crimes against humanity.

The International Court of Justice (ICJ) is also investigating Israel over “plausible genocide” in a case brought by South Africa and supported by at least 18 other countries.

Israel’s actions had brought Gaza’s population to the “brink of collapse”, said the Amnesty International report.

“Its brutal military offensive had killed more than 42,000 Palestinians [now more than 44,000], including over 13,300 children, and injured over 97,000 more, by 7 October 2024, many of them in direct or deliberately indiscriminate attacks, often wiping out entire multigenerational families.

“It has caused unprecedented destruction, which experts say occurred at a level and speed not seen in any other conflict in the 21st century, levelling entire cities and destroying critical infrastructure, agricultural land and cultural and religious sites.

“It thereby rendered large swathes of Gaza uninhabitable.”

NZ needs to take action
Taylor told the rally that New Zealand needed to take more action over the genocide, such as:

• Publicly recognise that Israeli authorities are committing the crime of genocide and commit to strong and sustained international action;
• Ban imports from illegal settlements as well as investment in companies connected to maintaining the occupation; and
• Do everything possible to facilitate Palestinian people seeking refuge to come to Aotearoa New Zealand and receive support.

In RNZ’s Checkpoint programme on Thursday, Amnesty International Aotearoa’s advocacy and movement building director Lisa Woods said the organisation had worked to establish the intent behind Israel’s acts in Gaza, adding that they meet the definition of genocide.

The series of air strikes analysed in the report had hit civilian homes in densely populated urban areas.

“No evidence was found that any of these strikes were directed at a military objective,” she said.

“The report found that the way these attacks were conducted is that they were conducted in ways that were designed to cause a very high number of fatalities and injuries among the civilian population.”

Today’s Palestine rally also devoted part of its activities to preparing a series of on-the-spot submissions to the Treaty Principles Bill amid many “Kill the bill” tee-shirts, banners and placards.

A community broadcaster in Aotearoa New Zealand has appealed for an end to the “sadistic cruelty” and the “out in the open genocide” by Israel in Gaza and the occupied Palestine territories.

In an open letter, Lois Griffiths, co-presenter of the environmental, social justice and current affairs programme Earthwise on Plains FM, has criticised the “injustices imposed by colonialism” and has cited Bethlehem Lutheran pastor Munther Isaac in saying “Gaza today has become the moral compass of the world”.

Her letter is published by Asia Pacific Report to mark the UN International Day of Solidarity with the Palestinian People.

The open letter by Griffiths says:

But we need to learn world history too.

Coincidentally, I am in the middle of reading Israeli journalist Gideon Levy’s most recent book The Killing of Gaza: reports on a catastrophe.

Levy has been there many times, reporting first hand about the sadistic cruelty imposed on its people, a cruelty that began in 1948.

He explains that Hamas promotes armed resistance as a last resort. Any other approach has been ignored

The Israeli regime is being accused now of war crimes. But war crimes have been going on for decades.

But it sickens me to even think of what is happening now. It is genocide, genocide out in the open.

In the words of Bethlehem Lutheran pastor Munther Isaac: “Gaza today has become the moral compass of the world.”

NERMEEN SHAIKH: In The Hague, the International Criminal Court has issued arrest warrants for Israeli Prime Minister Benjamin Netanyahu and former Defence Minister Yoav Gallant for crimes against humanity and war crimes committed during Israel’s assault on Gaza.

In a statement, the ICC said the Israeli leaders had, “intentionally and knowingly deprived the civilian population in Gaza of objects indispensable to their survival, including food, water, and medicine and medical supplies, as well as fuel and electricity.”

The ICC also issued an arrest warrant for Hamas military commander Mohammed Deif, although Israel’s military claims it killed Deif in a July airstrike.

The ICC arrest warrants come a week after a UN special committee found Israel’s actions in Gaza since October 2023 are, “consistent with genocide,” including using starvation as a weapon of war and recklessly inflicting civilian casualties.

AMY GOODMAN: In related news, on Wednesday, the United States vetoed a Gaza ceasefire resolution at the UN Security Council for the fourth time, and the US Senate rejected a resolution brought by Senator Bernie Sanders that sought to block the sale of US tank rounds, bomb kits and other lethal weapons to Israel. Nineteen senators supported blocking the arms.

For more on all of this, we’re joined by Akbar Shahid Ahmed, senior diplomatic correspondent for HuffPost. His latest piece is “Exclusive: White House Says Democrats Who Oppose Weapons to Israel Are Aiding Hamas.”

Ahmed, thank you so much for being with us. As you write your book on the Biden administration in Gaza called Crossing the Red Line, clearly the ICC has ruled that today by issuing arrest warrants for Israeli Prime Minister Benjamin Netanyahu, as well as the former Defence Minister Yoav Gallant.

Can you talk about the significance of this move?

AKBAR SHAHID AHMED: Yeah, Amy. This is just an absolutely huge development, and it’s significant for a number of reasons. It’s significant because the ICC has come out and amplified and affirmed the allegations of crimes against humanity, of war crimes. This is one more international body.

These are . . . international charges with a great deal of respect. This is a court that most of the world is a member of. And they’re coming out and saying, “Look, we think there are reasonable grounds to believe that these major international red lines have been crossed by the Israelis.”

What’s really important to remember is that this isn’t just a decision about Israel. By extension, it fundamentally is a decision about the United States, which has been the ultimate enabler of Israel’s offensives in Gaza and Lebanon, which are under consideration by the ICC.

And even in this ICC statement today, they point out that in the situations where Israel has addressed concerns over what it describes as starvation as a method of warfare — right? — depriving civilians, Palestinians, of food, water and medical equipment, Israel has really only done so in an extremely arbitrary and, what the ICC judges call, conditional way in response to the US. So, fundamentally, Amy, what we’re seeing is the ICC is saying yet again that Israel and the US, as its major enabler and backer, are in the dark and will continue to be in the dark for years to come.

This kind of adds to a broader picture in which there are now ICC warrants for the sitting Israeli prime minister and former Defence Minister Yoav Gallant, who remains a significant politician in Israel. Simultaneously, there’s the genocide case at the ICJ, the International Court of Justice, which is ongoing and will be ongoing for years to come.

And there’s the Geneva Conventions conference underway next year regarding kind of similar issues — right? — violations of international law, laws of war and the Israeli grave abuses that are alleged. So, the US and Israel will be kind of on trial on the international stage for years to come.

NERMEEN SHAIKH: So, Akbar, would you say that this move is mostly a symbolic one? Because, as you pointed out, of course, most countries are members of the International Criminal Court, but in this instance, perhaps most importantly, neither Israel nor the US are.

AKBAR SHAHID AHMED: Right, Nermeen. And that’s something that the ICC judges did get into today — right? — because Israel said, “Look, the International Criminal Court doesn’t have jurisdiction over us.” That said, the state of Palestine is a member of the court, and that’s why this becomes a relevant and interesting thing, because you’ve seen European nations recognise Palestine as a state. You’ve seen Palestine join the United Nations General Assembly over just last year.

So, yes, while the US and Israel continue to reject international scrutiny by the ICC, by the ICJ, of Israel’s conduct in Gaza and the occupied West Bank and Lebanon, there’s a growing international push to kind of challenge that, right?

And I think you will see the Biden administration and the incoming Trump administration assertively push back against the ICC. The Trump administration did actually target the ICC directly when President Trump was last in office, threatening to put sanctions on ICC officials. And we also know from reporting that the Israelis have spied on and threatened the ICC themselves, according to reporting by The Guardian. So, yes, there will be increased pressure.

But I think we’re really in a place that no one thought we would be even a few months ago, right? I think even the prospect of the ICC prosecutor successfully getting these warrants issued, it was initially thought that would be quite quick. It’s taken a long time. The fact that judges were able to issue those warrants suggests that even though it’s an uphill battle to get this international scrutiny, there’s a real determination and clear will.

And we’ve seen a lot of states turn around and say over 13 months, right? Since the October 7 attack by Hamas within Israel that did spark this current round of fighting, there have been calls to say, “We don’t want this to escalate,” right?

The US’s allies, Western countries have said, “We want to resolve this. We don’t want you on trial. Can the US and Israel please change course?” And what you’ve seen is a defiance from Tel Aviv and from Washington to say, “Actually, no, we’re continuing these wars.”

So, that does take it to a different forum to kind of change the policy.

NERMEEN SHAIKH: And, Akbar, could you also — while we’re looking at the way in which international organisations, multilateral ones, are responding to this, what about the latest vote at the Security Council and the fact that the US blocked it for the fourth time, a ceasefire vote?

AKBAR SHAHID AHMED: It’s really striking at this point — right? — to see the Biden administration totally alone. And you see how this develops over the course of the war. Initially, the US was able to get Britain, even France, kind of abstaining, standing with them.

And now, 13 months in, where conduct hasn’t changed, and you still have daily strikes that are killing dozens, sometimes over a hundred civilians, you have a mounting death toll of mostly women and children, the US is totally alone, where it’s shielding Israel on the world stage diplomatically.

And this is really important to see in the context of the Biden administration as an outlier even among American presidents and administrations. When President Barack Obama was in office, after he was in the lame-duck period that Biden is in now, he actually did abstain at the UN Security Council and said, “You know what? Go ahead and pass a resolution that Israel doesn’t like,” because tacitly the US acknowledged there was a basis, there were credible grounds for that resolution, which in that instance was about Israeli settlement activity.

Here, what you’re seeing from the Biden administration, even in their dying days — right? — two months to go, there’s an obstinacy, a defiance, and a real commitment to shielding Israel, even if they are totally alone against now their closest allies — Britain, France and everyone else on the Security Council.

So, I think the context of that veto kind of presages whatever may come in the next two months in terms of the Biden administration allowing any UN scrutiny of the wars.

AMY GOODMAN: Akbar, I want to play Palestine’s envoy to the United Nations, Majed Bamya, speaking yesterday.

MAJED BAMYA: There is no right to mass killing of civilians. There is no right to starve an entire civilian population. There is no right to forcibly displace a people. And there is no right to annexation. This is what Israel is doing in Gaza. …

Maybe for some, we have the wrong nationality, the wrong faith, the wrong skin color. But we are humans! And we should be treated as such. Is there a UN Charter for Israel that is different from the charter we all have? Tell us. Is there an international law for them, an international law for us? Do they have the right to kill, and the only right we have is to die?

AMY GOODMAN: This is Democracy Now!, The War and Peace Report. I’m Amy Goodman.

We turn to Israel’s war on Gaza. A special UN committee has reported Israel’s actions in Gaza are “consistent with the characteristics of genocide”. Another report by Human Rights Watch finds Israel has committed war crimes and crimes against humanity through its mass forced displacement of Gaza’s civilians.

This comes as the Biden administration has decided to continue arming Israel, even though aid groups say Israel has failed to meet a US-imposed 30-day deadline to increase the flow of food and humanitarian aid into Gaza.

We go now to Deir al-Balah in Gaza, where we’re joined by Arwa Damon, founder of INARA, a nonprofit currently providing medical and mental healthcare to children in Gaza. She previously spent 18 years at CNN, including time as a senior international correspondent.

Thanks so much for being with us, Arwa. This is your fourth trip back to Gaza since October 7, 2023. Tell us what you see there:

ARWA DAMON: You know, Amy, you think you can’t get worse, and then it does. You think people, quite simply, could never cope with these deteriorating conditions, and yet somehow they do. It’s a situation that they have been forced into.

Arguably, the conditions when it comes to access of humanitarian organisations and our ability to distribute aid, aid actually getting into the strip, we’re talking about the lowest levels yet. And this is exactly during the timeframe that the US had given to Israel to actually improve the situation. We’ve seen it getting significantly worse.

We’re not just talking about a shortage in things like flour, food, water, fresh vegetables, you know, hygiene kits. We’re also talking about shortages in what’s available on the commercial market. So, even if you somehow had money to be able to go buy what you need, it quite simply isn’t here.

These hospitals that we keep talking about as being partially functioning, what does that actually mean? It means that if you show up bleeding, someone inside is going to try to stop the bleed, but do they actually have what they need to save your life? No. I was inside visiting some kids here at Al-Aqsa earlier today and over the weekend.

There’s a little 2-year-old boy here whose brain you can see pulsing through his skin. His skull bone was removed. This little boy was not stabilising properly because the ICU was missing a pediatric-sized tracheostomy tube. Now, luckily, we were able to, you know, source some of them, and he has now stabilised, and he is off the ventilator.

But this really gives you an idea of just how serious the situation here is.

People are gathering to demonstrate for things like flour, for bread, for whatever it is that you can imagine. Winter is coming. The rains are coming. This means flooding is coming.

And on top of just, you know, water flooding, we’re also anticipating that the sewage sites are going to be flooding, as well. Aid organizations need to be able to have the capacity and the ability to, you know, shift those sites to areas where they’re not going to pose even more of a health hazard to the community.

So, I mean, it’s a complete and total nightmare. It’s beyond being a nightmare.

AMY GOODMAN: If you can talk about this latest report? The special UN committee says Israel’s actions in Gaza are “consistent with the characteristics of genocide,” coming at the same time as a Human Rights Watch report, and UNRWA talks about famine being imminent in northern Gaza.

ARWA DAMON: So, if we’re talking specifically about the north, the northern province of Gaza, this is an area where Israel launched its military operation there nearly four weeks ago. We have seen people repeatedly being forcibly displaced from their homes. There is very little access to medical assistance there.

There has been absolutely no humanitarian assistance delivered there for about the last month. People are starving. They are dying. And it’s not just bombs that are killing people, it’s also disease.

So, when we look at the nature of what is happening in Gaza, you can’t spend a day here, Amy, and not come away with the notion that you are witnessing a population that is being slowly exterminated. And I say “slowly” because, yes, bombs kill quickly, but disease and starvation, they are slow killers. And that is what a lot of people are facing here.

And talk to anybody in Gaza, and there’s absolutely no doubt in their mind that, one, they are living through their own annihilation, and, two, what Israel is doing in the northern part is going to be repeated elsewhere.

And this is also part of why you see a reluctance among the population to want to evacuate, because Gazans know, Palestinians know that when they leave, they’re not going to be able to go back home. This is what history has taught them.

And there is this very real, ingrained fear among the population here right now that what they’re going through at this moment is not the end. There is actually a real sense that the worst is yet to come.

And they feel completely and totally abandoned by the international community, by global leaders, not to mention the United States. And everyone is convinced that right now Israel is going to have even more free rein to do whatever it is that it wants here.

When you talk to people about what it is that they’re going through, they do feel as if every single aspect of trying to survive here has been carefully orchestrated by Israel so that it is able to sort of meet America’s bare minimum of standards, to allow America sufficient cover to say, “Oh, no, there’s improvement that’s happening.”

And yet, actually, at the core of it is just another way to continue to kill the population.

AMY GOODMAN: And as you talk about the United States, which has given tens of billions of dollars in military aid to Israel, they did recently set a 30-day deadline to increase the flow of food and humanitarian aid into Gaza, but the US has decided to keep arming Israel despite this and despite the number of officials in the State Department and other parts of the US government who have quit over this.

ARWA DAMON: Yeah, and let’s just look at the numbers. Let’s just look at what happened when the US started the clock for that 30-day deadline to improve humanitarian assistance. We saw, very shortly afterwards, the number of trucks accessing Gaza dip significantly, down to 30 a day, keeping in mind that one of the key demands that the US had was that aid be increased to at least 350 trucks.

So we saw this, you know, decrease consistent of roughly 30 trucks a day for most of the month of October. Now, in November, that number did go up to around 60-70, but we’re still talking about, you know, falling extraordinarily short, providing barely 20% of what it is that the population here needs.

We saw less access to these besieged areas in the north, where people are effectively trapped or having to basically risk their lives. We’ve had numerous instances where aid has been delivered to the Kamal Adwan Hospital in the north, for example, where, shortly after medical evacuation teams have arrived there, there have been strikes.

You have this very ingrained fear that exists among people right now, especially in the north, where some of them are saying, “Don’t deliver anything, because right after you’re delivering, strikes are happening.”

And just to illustrate how it is that we try to move, so if we’re moving from south to north, for example, or even if we’re moving within the northern areas, those movement requests have to be approved by Israel. And aid organisations are increasingly wary of moving around with what we call soft-skin cars, which is basically your normal vehicle that we use to move around in, because of the increasing frequency of instances at Israeli checkpoints where aid convoys have been shot at by IDF troops after receiving the green light.

The OK to cross through, which means that for a lot of aid organizations, movement is limited to those who have access to armoured vehicles, vehicles that are more secure. And those don’t really exist in Gaza in high numbers at all. And we’re not allowed to bring in more to sort of beef up our capacity to be able to move around safely.

I mean, no matter which way you look at it, Amy, you’re constantly faced by numerous obstacles that don’t need to be there. It feels very deliberate, not to mention the complete and total breakdown of security. Now we have numerous looting instances of aid trucks.

We’ve repeatedly asked the Israeli side to be able to use alternative routes, to be able to use secured routes. Those requests are not being met.

I mean, it’s just — it’s such an impossible situation to operate in. I feel like I keep saying the same thing over and over and over again each time I come in. And the words to demonstrate how much worse it’s getting, quite simply, lack in our vocabulary.

AMY GOODMAN: You also wrote a piece recently, “The Devastation of Lebanon,” for New Lines. And we had this headline, The Washington Post reporting a close aide to Netanyahu told Donald Trump and his son-in-law Jared Kushner that Israel is rushing to advance a ceasefire deal in Lebanon as a gift to Trump ahead of his January inauguration. Your response to the significance of Trump’s election and what it means to the people of Lebanon and Gaza?

ARWA DAMON: You know, first of all, anyone who lives in the Middle East and anyone who’s kind of been focusing on the Middle East knows very well that it really doesn’t matter who’s in the White House. Whether it’s Republican or Democrat, that really is not going to change significantly US policy towards this region.

But the thing that we’ve been hearing, specifically when it comes to the re-election of Donald Trump, is at least he’s not lying to us. At least whatever America is going to let Israel do, it’s going to be done faster. So, if our end is coming, at least it’s going to come faster.

Whereas when it comes to, you know, specifically the Biden administration, the sense is that the Democrats are far more willing to allow this slower, more painful death. But the end result, no matter who it is, people are fully convinced, is exactly the same.

And all people really want right now is for this to end. People are suffocated. They’re crushed. They cannot keep going like this. And they very much feel as if, you know, no matter what it is, no matter who it is, Arabs are viewed by the United States and by the Western world as somehow being less than . . . their lives are not that valuable.

You constantly hear people in Gaza — and we were hearing the same thing in Lebanon — making comments like, “Well, you know, America, it doesn’t care if we live or die. It doesn’t care how much we suffer. Our lives don’t matter to them.” And that is not really a perspective that changes all that much, no matter who is sitting in Washington.

AMY GOODMAN: We just have 30 seconds, Arwa. Why did you give up journalism for humanitarian work? What do you think you can accomplish at INARA that you couldn’t do as a journalist?

ARWA DAMON: There’s a certain sort of privilege of being able to spend extensive periods of time with people and really get to know who they are. And I feel as if, you know, moving around in the humanitarian sphere, I’m getting a different understanding of sort of people’s emotional journeys, what it actually takes to be able to provide them with assistance.

And it’s provided me a different way of being able to continue to sort of share people’s stories and experiences, but also be able to immediately at least try to provide assistance. You know, the challenge that we have when we’re out in the field as journalists is that you don’t always see the impact.

But when you’re in the humanitarian space, there’s a certain kind of magic when you’re able to just bring a smile to a child’s face. And I needed that.

The Palestine Solidarity Network Aotearoa (PSNA) has written to the Minister for Space Judith Collins and Rocket Lab CEO Peter Beck to warn that satellites being launched from the Māhia Peninsula are “highly likely” to conduct surveillance for Israel.

And also to assist in the commission of war crimes in Gaza and in Lebanon, said PSNA national chair John Minto.

“Three companies are of particular concern to us: BlackSky Technology, Capella Space, and HawkEye 360,” Minto said in a statement.

“In particular, BlackSky has a US$150 million contract to supply high temporal frequency images and analysis to Israel,” Minto said.

“We believe it is highly likely that BlackSky provides data to Israel which it uses to target civilian infrastructure across Gaza and Lebanon.”

Minto said that PSNA understood that Rocket Lab had launched satellites for BlackSky since 2019.

The advocacy group also aware that by the end of 2024, Rocket Lab was expected to begin deploying BlackSky’s constellation of next generation earth observation satellites, with improved capability.

Asking for suspension
“We are asking the minister and Rocket Lab to suspend all further satellite launches for BlackSky, full stop,” Minto said.

“For Capella Space and HawkEye 360, we are asking that the minister suspend satellite launches from the Māhia Peninsula until an investigation has taken place to assure New Zealanders that further launches will not put us in breach of our commitments under international law.

“New Zealanders don’t want our country used to support war crimes committed by Israel or any other country”, he said.

“If we are serious about our responsibilities under international law, including the Genocide Convention, then we must act now.”

Stopping the satellite launches was the “least we can do”.

A PSNA support lawyer, Sam Vincent, said: “New Zealand has solemn responsibilities under international law which must trump any short-term profit for Rocket Lab or the convenience of our government.”

He said that all three companies were sponsors of a geospatial intelligence conference in Israel taking place in January 2025 [Ramon GeoInt360], of which the Israel Ministry of Defence and BlackSky were “leading partners” and HawkEye 360 and Capella Space were sponsors.

Minto added: “All the alarm bells are ringing. These companies are up their eyeballs in support for Israel.”

NERMEEN SHAIKH: Israel’s deadly siege on northern Gaza has entered a 30th day. Early week, the World Health Organisation managed to deliver some medical supplies to the Kamal Adwan Hospital, but on Thursday, Israeli fighter jets bombed the hospital’s third floor, where the supplies were being stored.

Al Jazeera reports Israeli forces are continuing to shell Beit Lahia, the scene of multiple massacres last week. On Wednesday, an Israeli attack on a market in Beit Lahia killed at least 10 Palestinians. Earlier in the week, Israel struck a five-story residential building, killing at least 93 people, including 25 children.

Meanwhile, at the United Nations, the UN Special Rapporteur on the Occupied Palestinian Territory, Francesca Albanese, has released a major report accusing Israel of committing genocide.

Albanese concludes that Israel’s war on Gaza is part of a campaign of, “long-term intentional, systematic, state-organised forced displacement and replacement of the Palestinians” . The report is titled Genocide as Colonial Erasure.

AMY GOODMAN: Francesca Albanese is now facing intensifying personal attacks from Israeli and US officials. She was set to brief Congress earlier last week, but the briefing was cancelled. On Tuesday, the US Ambassador to the United Nations, Linda Thomas-Greenfield, wrote on social media, “As UN Special Rapporteur Albanese visits New York, I want to reiterate the US belief she is unfit for her role. The United Nations should not tolerate antisemitism from a UN-affiliated official hired to promote human rights.”

On Wednesday, Francesca Albanese spoke at the United Nations and responded to the US attacks.

FRANCESCA ALBANESE: I have the same shock that you have, looking at how the United States is behaving in this context, in the context of the genocide that is unfolding in Gaza. I’m not — I’m not surprised that they attack anyone who speaks to the facts that are, frankly, on our watch in Gaza. And they do that so brutally because they feel called out, because it’s not that it’s that the United States is simply an observer. The United States is being an enabler in what Israel has been doing.

AMY GOODMAN: That was UN Special Rapporteur Francesca Albanese speaking at the United Nations on Wednesday. She joins us here in our studio.

Welcome back to Democracy Now! Thanks so much for joining us.

Well, before we get you to further respond to what the US and Israel is saying, can you lay out the findings of your report?

Colonial Erasure’: UN expert Francesca Albanese on Israel’s “intent to destroy” Gaza Video: Democracy Now!

FRANCESCA ALBANESE: Absolutely. First of all, thank you for having me.

I have to say that this report is the second I write on — and I present to the United Nations on the topic of genocide. And it has been very reluctantly that I’ve taken on the responsibility to be the chronicler of — the chronicler of an unfolding genocide in Gaza.

In March this year, I concluded that there were reasonable grounds to believe that Israel had committed at least three acts of genocide in Gaza, like killing members of the protected group, Palestinians; inflicting severe bodily and mental harm; and creating conditions of life that would lead to the destruction of the group. And the reason why I identified these were not just war crimes and crimes against humanity is because I identified an intent to destroy.

And I understand that even in this country, people are quite confused about what is genocidal intent, because it’s not a motive. One can have many motives to commit a crime. And I understand genocide is a very insidious one, and it’s difficult to identify what’s a motive. But this is not about the motives. The intent to commit genocide is the determination to destroy, which is fully evident in — especially in the Gaza Strip, as I identified in — as argued in March already.

The reason why I continue to write about genocide — and, in fact, this report walks on the heels of the previous one — is in order to better explain the intent, especially state intent, because there is another misunderstanding that there should be a trial of the alleged perpetrators in order to have — to attribute responsibility to a state.

No, because not only you have had acts committed that should have been prevented by the — in a rule of law, in a proclaimed rule of law system like Israel, where there is the government, the Parliament, the judiciary, working as checks and balances, genocide has not only been not prevented, [it] has been enabled through the various organs of the state.

And I explain what has happened as of October 7, which has provided the opportunity to escalate violence, to build on the rage and on the fury of many Israelis, turning the soldiers into willful executioners, is that there was already a plan, hatred.

I mean, the Palestinians, like Ilan Pappé says, are victims not of war, but of a political ideology that has been unleashed. Palestinians have always been an unwanted encumbrance in the Israeli mindset, because they are an obstacle both as an identity and as legal status to the realisation of Greater Israel as a state for Jewish Israelis only.

NERMEEN SHAIKH: So, we’ll go back to — because I do want to ask about the Israeli state institutions that you name and the branches of the Israeli state that have been involved in forming this state’s intent. But if you could elaborate on the point that you make, the difference between intent and motive, and in particular what you say in the report about how it’s critical to determine genocidal intent, “by way of inference”?

You know, that’s a different phrasing than one has heard in all of this conversation about genocide so far. If you explain what you mean by that and what such a determination makes possible? So, rather than just looking at genocidal intent in other forms, what it means to infer genocidal intent?

FRANCESCA ALBANESE: So, first of all, what constitutes genocide is established by Article II of the Genocide Convention, which creates a twofold obligation for member states, to prevent genocide so genocide doesn’t have to complete itself. When there is a manifestation of intent, even genocidal intent, there is already an obligation to intervene, because a crime is unfolding.

And then there is an obligation to punish. How the jurisprudence, especially after Rwanda and after former Yugoslavia, there have been cases both for criminal proceedings, where individual perpetrators have been investigated and tried, and [the] responsibility of the state, litigated before the International Court of Justice. This is how the jurisprudence on genocide has developed.

And the intent has been further elaborated upon what the Genocide Convention says. And while it might be difficult to have direct intent, meaning to have — it’s difficult but not impossible, in fact, to have a state official say, “Yes, let’s go and destroy everyone” — although I do believe that there is direct intent in this genocide in Gaza.

But the court also established that genocide can be inferred from the scale of the attack on the people, the nature of the attack, the general conduct. And what it says is that normally there should be a holistic approach in order to identify intent, which is exactly what I’ve done.

And indeed, this is why I proposed in this report what I called the triple lens approach. We need to look at the conduct, like the totality of the conduct, instead of studying with a microscope each and every crime. We need to look at the whole, against the totality of the people, the Palestinians as such, in the totality of the land, that Israel has slated as its own by divine design.

NERMEEN SHAIKH: No, absolutely. And then, if you could — the other precedent you’ve just spoken about — of course, Rwanda and former Yugoslavia — another case that you cite in the International Court of Justice is The Gambia v. Myanmar. So, how is that comparable to what we see happening in Gaza? Why is that a relevant example and different from both Rwanda and former Yugoslavia?

FRANCESCA ALBANESE: Let me tell you what I see as the major differences in the case of Israel, because it’s a very complex discussion. But in all four cases, there is a toxic combination of hatred, ideological hatred, which has informed political doctrines. And this is true in all the various contexts we are mentioning. The other common element is that there is [a] combination of crimes. Like, forced displacement is not an act of genocide per se, but the jurisprudence says that it can contribute to corroborate the intent.

But, again, mass killing or mass destruction of property, torture and other crimes against a person, which translate into an infliction of physical and mental harm to the group, not individuals as such, but individuals as part of the group, these are common elements to all genocides.

What I find characteristic in this one is, first of all, this is not — I mean, the state of Israel is not Myanmar and is not Rwanda 30 years ago. This is not war-torn former Yugoslavia. This is a state which has a separation of powers, different organs, as I said, checks and balances. And let me give you a specific example, because you asked me to comment on the state functions.

In January this year, the International Court of Justice issued a set of preliminary measures in the context of its identification, before even looking at the merits of the case initiated by South Africa for Israel’s breach, alleged breach, of the Genocide Convention, which identified the plausibility of risk for the rights protected — of the rights of the Palestinians protected under the Genocide Convention, which means plausibility — it’s semantics, but it’s plausibility that genocide might be committed against the Palestinians in Gaza.

And the provisional measures included an obligation to investigate and prosecute the various cases of incitement, genocidal incitement, that the court had already identified. And it mentions leaders, senior leaders, of the Israeli state. Has there been any investigation? Has there been any prosecution?

But I’m telling you more. The genocidal statements didn’t resonate as shocking in the Israeli public, not only because there was rage, an enormous rage and animosity, of course. I mean, this is understandable, that the facts of October 7 were brutal and traumatized the people.

But at the same time, hatred against the Palestinians and hate speech, it’s not something that started on October 7. I do remember, and I do remember the shock I felt because no one was reacting, and years ago, there were Israeli ministers talking of — freely, of killing, justifying the killing of Palestinians’ mothers and children because they would turn into terrorists.

AMY GOODMAN: Francesca Albanese, talk about the title of your report, Genocide as Colonial Erasure.

FRANCESCA ALBANESE: This is another element which I think — and, in fact, it’s the most important, where we see the difference between this genocide and others, because there is a settler-colonial component. And again, if you look at what the International Court of Justice in July this year concluded, when it decided that the — when it found that Israel’s 57 years of occupation in Gaza, the West Bank and East Jerusalem is unlawful and needs to be withdrawn totally and unconditionally, as rapidly as possibly, which the General Assembly says by September 2025.

The court said that it amounts to — that the colonies amount to — have led to a process of annexation and racial segregation and apartheid. And these are the features of settler colonialism, the taking of the land, the taking of the resources, displacing the local population and replacing it. This has been a feature.

Now, it is in this context that we need to analyse what is happening today. And by the way, don’t believe, don’t listen only to Francesca Albanese. Listen to what these Israeli leaders and ministers are saying — reoccupying Gaza, retaking Gaza, recolonising Gaza, reconquesting Gaza. This is what they are saying.

And there are settlers on expeditions, not only to Gaza but also to Lebanon. So, this is why I say that the main difference, the main feature of this genocide, apart all the horrible aspects of it, is that this is the first settler-colonial genocide to be ever litigated before a court, an international court.

And this is why coming to this country, which is a country birthed from a genocide, when I meet the Native Americans, for example, I feel the pain of these people. And I say if we manage to build on the intersectionality of Indigenous struggle, the cry for justice behind this case for Palestine will resonate even louder, because it will somewhat be an act of atonement from the settler-colonial endeavor, which has sprouted out of Europe, toward Indigenous peoples. So there is a lot of symbolism behind it.

NERMEEN SHAIKH: And, you know, the analogy — first of all, you talked about the case brought by South Africa, so what they share, apart from South Africa and Israel-Palestine, is both the fact that they were colonial-settler states, as well as the fact that apartheid has been established as having occurred in both places.

Now, in the case of South Africa, it was a decision that was taken by the United Nations at the time of apartheid, was unseating South Africa from the General Assembly. There have been calls now to do the same with Israel. So, if you could — if you could comment on that?

And then, I just want to quote another short sentence from your report, in which you say, “As the world watches the first live-streamed settler-colonial genocide, only justice can heal the wounds that political expedience has allowed to fester.” So, if you could talk about the International Court of Justice’s case in that context, what role you think they can play, South Africa’s case, in resolving or addressing — seeing and addressing this wound?

FRANCESCA ALBANESE: First of all, let me unpack the question of the unseating Israel, because this is one of the recommendations I made in my report. Under Article 6 of the UN Charter, a member state can be suspended of its credentials or its membership by the General Assembly upon recommendation of the UN Security Council. And the first criticism I got is that we cannot do that, because every states commit international law violations. Absolutely. Absolutely.

But there are two striking features here. First, Israel is quite unique in maintaining an unlawful occupation, which has deemed such by — in at least one full occasion, but again, there was already a case brought before the ICJ in 2004, so there have been two ICJ advisory opinions.

There is a pending case for genocide. There has been the violations of hundreds of resolutions by the — on Israel — over occupied Palestinian territory, by the Security Council, the General Assembly, the Human Rights Council, and steady violation of international humanitarian law, human rights law, the Apartheid Convention, the Genocide Convention. So this is quite unique.

But all the more, this year alone, Israel has conducted an attack, an unprecedented attack, against the United Nations. It has attacked physically, through artillery, weapons, bombs, UN premises. Seventy percent of UNRWA offices and UNRWA buildings, clinics, distribution centers have been hit and shelled by the Israeli army.

Two hundred and thirty UN staff members have been killed by Israel in Gaza alone. UN peacekeepers in Lebanon have been attacked. And this doesn’t even take into account the smear, the defamation against senior UN officials, the declaration of the secretary-general as persona non grata, the referring to the General Assembly as a “cloak of antisemites”.

Again, this has mounted to a level — the hubris against the United Nations and international law has been unchecked and unbounded forever, but now, especially after the Knesset passed a law outlawing UNRWA, declaring UNRWA a terrorist organisation, and therefore disabling it from its capacity to deliver aid and assistance especially in Gaza and the West Bank and East Jerusalem, this is the nail in the coffin of the UN Charter.

And it can also contribute to that sense of colonial erasure, because here it’s not just at stake the function of a UN body — and UNRWA is a subsidiary body of the General Assembly, so it’s even more serious. But there is the capacity of UNRWA to deliver humanitarian aid in a desperate situation, and also the fact that UNRWA is seen by Israel as the symbol of Palestinian identity, especially the Palestinian refugees. So there is an attempt to erase Palestinianness, including by hitting UNRWA.

AMY GOODMAN: I want to ask you about your trip here, as we begin to wrap up. The US Ambassador to the United Nations, Linda Thomas-Greenfield, quoted on — tweeted on Tuesday, “As UN Special Rapporteur Albanese visits New York, I want to reiterate the US belief she is unfit for her role. The United Nations should not tolerate antisemitism from a UN-affiliated official hired to promote human rights.” If you can further address their charge of antisemitism against you?

FRANCESCA ALBANESE: Yeah.

AMY GOODMAN: And talk about what happened. You were supposed to come to Congress and speak and brief them, but that was cancelled this week.

FRANCESCA ALBANESE: Yes, it was canceled. But let me — first of all, I’m very embarrassed to read this, because a senior US official who writes this, I mean, it shows a little bit of desperation. I’m sorry, but, you know, I’m very candid.

And let me unpack my antisemitism for the audience. So, what I’ve been accused of — the reason why I’ve been accused of antisemitism — is because I’ve allegedly compared the Jews to the Nazis. Never done. Never done.

What I’ve said, what I’ve done is saying, and I keep on saying, that history is repeating itself. I’ve never done such a comparison where I draw the parallel. It’s on the behaviour of member states who have the legal and moral obligation to prevent atrocities, including an unfolding genocide.

In the past, they have done nothing — nothing — until the end of the Second World War, to prevent the genocide of the Jews and the Roma and Sinti. And they’ve done nothing to prevent the genocide of the Bosnians.

And they’ve done nothing to prevent the genocide of the Rwandans. And they are doing the same today. This is where I insist that now, compared to when there was the Holocaust, now we have a human rights framework that should prevent this. The Genocide Convention to prevent this. So, this is one of the points.

The second point, — which leads to portray me as an antisemite, which is really offensive — is that I’ve said that October 7 was not — I’ve contested, I’ve challenged the argument that October 7 was an antisemitic attack. October 7 was a crime, was heinous. And again, I’ve condemned the acts that were directed against the Israeli civilians, and expressed solidarity with the victims, with the families. I’ve been in contact with the families of the hostages.

But I’ve also said the hatred that led that attack, that prompted that attack, to the extent it hit civilians, not the military, but it was prompted not by the fact that the Israelis are Jews, but the fact that the Israelis — I mean, the Israelis are part of that endeavor that has kept the Palestinians in a cage for 17 years and, before, under martial law for 37 years. And Palestinians have tried — it’s true they have used violence, but before violence, they have tried dialogue. They have tried collaboration. They have tried a number of means to access justice, and they have gone nowhere.

I can — I mean, let me relate just this case, because last year I worked with children. And someone who was 17 years old before October 7 last year had never set foot out of Gaza. This is the reality. And I spoke with children while I was writing my report on “unchilding”, the experience of Palestinians under Israeli occupation. And one of them — I mean, there were these two girls fighting, because one of them had been able to go to Israel and the West Bank because she had cancer and could be treated, and the other was jealous, because, she said, “At least she was sick, and she could go, she could travel. I’ve never seen the mountains.”

And again, this doesn’t justify violence, but, please, please, put things in context. And even Israeli scholars have said claiming that October 7 was prompted by antisemitism is a way to decontextualize history and to deresponsibilise Israel.

I condemn Israel not because it’s a Jewish state. It’s not about that, but because it’s in breach of international law through and through. And were the majority of Israelis Buddhists, Christians, atheists, it would be the same. I would be as vocal as I am now.

NERMEEN SHAIKH: Francesca, just one last question, and we only have a minute. Your recent book, J’Accuse, you take the title, of course, from the letter Émile Zola wrote during the Dreyfus Affair to the French president. You came under severe criticism for the choice of that title. Could you explain why you chose it and what it means in this context?

FRANCESCA ALBANESE: Absolutely. I have the sense that whatever I say comes under scrutiny and criticism. But J’Accuse is — first of all, it’s the title that was proposed by the editor, the publisher. And I was against it until October 7.

When I saw the narrative, the dehumanization of the Palestinians after October 7, and what it was legitimising, I said, “This is the title. We need to use it,” because I draw the parallel between what is happening to the Palestinians and what has happened to other groups, particularly the Jewish people in Europe.

I say the Holocaust was not just about the concentration camps. The Holocaust was a culmination of centuries of discrimination, and the previous decades had led the Jewish people in Europe to be kicked out of jobs, professions, to be treated like subhumans, as animals. And it’s this dehumanisation that we need to look at in the face today, in the eyes today, and recognise as leading to atrocity crimes.
